The COUM11 of the City of Bakersfield, California, pursuant to the previs %as of the "Street Vacation Act of 1%19" being Divi- sion 9 of the Streets and Highways Code of the State of California, does hereby resolve as felleNsa 3" g"s That it is the intention of the Council of the City of Bakersfield, California, to order the vacation, of an alley within said City, described as follows, to wits All of the north -south alley is Block , Bernard - W itioa, between the northerllyy line 01 the East- Met alloy is said Block and the southerly line of Bernard Street, as said Block is shows on "The Revised hap of tks Bernard Addition to Sera," filed is the oldie• of the County Recorder of Kern County, June 18, 1ft, in leap Book It page 433 reserving and excepting from said vacation, the permanent easement and right at any tine, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in,, upon,, ever and across the alley proposed to be vacatMd and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe limes, telegraphic and telephone lines, railroad lines, and for this transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the alley proposed to be vaeated. 1. That it is determined by the Covnail of the City of Bakers- field that the public convenience and necessity require the reserva- tion of said ""mats and the proceedings hereunder are taken subject to such reservations and exceptions. For further particulars as to the proposed vacation, reference is hereby made to a sap on file in the office of the City Clerk of the City of Bakersfield, In the City Bail, Bakersfield, California. Section 2s That the hour of 8 o'clock P. M., of the 26th day of August, 19469 in the Council Chambers in the City Hail, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the Council and offer evidence in relation thereto. Section Is That the Superintendent of Streets of the City of Bakersfield, California, be and he is hereby directed to cause "'Notice of Street Vacation" to be posted as required by the said "Street Vacation Act of 19419" being Division 9 of the Streets and Highways Code of the State of California; and the Council of said City hereby elsets to proceed under the provisions of said Act. Section 4s The City Clerk shell certify to the passage of this Resolution, and shall cause the same to be posted on the bulletin board at the City Ball of said City within fifteen (15) days after its passage. -- - - -- 040 - --- -- P.
