L (1) A RESOLUTION Ole THE COUNCIL OF THE CITY OF BAIMSr IELD CALIFORNIA DECLA -MiG ITS INTENTION TO OLDER THE VACI`'ION OF POR- TIONS OF 17th STREET AND.CEDAR STREET AND THE ALLEY R WE RUNNING EASTWLY AIM STERLY THROUGH BLOCK 421 D, IN THE CITY OF BAKERS - FIELDG CALIFORNIA. The Council of the City of Bakersfield, California, pursuant to the provisions of the "Street Vacation Act of 1941," being Divi- sion 9 of the Streets and Highways Code of the State of California, does hereby resolve as follows: Section ls That it is the intention of the Council of the City of Bakersfield, California, to order the vacation of portions of certain streets and alley in the City of Bakersfield, more particu- larly described as follows: 1. All that portion of 17th Street lying between the westerly line of A Street and the easterly line of Cedar Street. 2. All that portion of Cedar Street lying between the northerly line of Truxtun.Avenue and a line 142 feet southerly from and parallel with the southerly line of 18th Street. 3. All of the alley running easterly and westerly through Block 421 D. All of said streets and alley are as shown on Lap of Bakersfield, recorded November 25, 1393, in Book 1 of Bdaps at pages 13 and 14, llecords of Kern County, California. reserving and excepting from said vacation, the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across the streets and alley proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures 1. for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the streets and alley proposed to be vacated. That it is determined by the Council of the City of Bakers- field that the public convenience and necessity require the reserva- tion of said easements and the proceedings hereunder are taken subject to such reservations and exceptions. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of the City of Bakersfield, in the City Hall, Bakersfield, California. Section 2: That the hour of 8 o'clock P. L., of the 12th day of November, 1946, in the Council Chambers in the City Hall, Bakers- field, California, be and the same is hereby fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the Council and offer evidence in relation thereto. Section 1: That the Superintendent of Streets of the City of Bakersfield, California, be and he is hereby directed to cause "Notice of Street Vacation" to be posted as required by the said "Street Vacation Act of 1941," being Division 9 of the Streets and Highways Code of the State of California; a4d the Council of said City hereby elects to proceed under the provisions of said Act. Section, 4: The City Clerk shall certify to the passage of this Resolution, and shall cause the same to be posted on the bulletin board at the City Hall of said City within fifteen (15) days after its passage. s •. 2. I 1-MHX3Y CERTIFY that the foregoing Resolution of Intention was passed and adopted by the Council of the City of Bakersfield, at a regular meeting thereof held on the 21st day of October, 1946, by the following vote: AYES: CARWIS, CROSS.
