The Council of the City of Bakersfield, California, pursuant to the provisions of the "Street Vacation .Act of 1941,11 being Divi- sion 9 of the Streets and Highways Code of the State of California, does hereby resolve as follows: Section 1: That it is the intention of the Council of the City of Bakersfield, California, to order the vacation of an alley within said City, described as follows, to wit: All of the alley (33 feet in width) running Easterly and Westerly through Block 255, .Bakersfield, as said alley and block are shown on Map of the City of Bakersfield, recorded November 25, 193, in Book 1 of Baps at pages 13 and 14, Records of Kern County, California; reserving and excepting from said vacation, the permanent easement, and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across the alley proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables,, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the alley proposed to be vacated. 1. That it is determined by the Council of the City of Bakers- field that the public convenience and necessity require the reserva- tion of said easements and the proceedings hereunder are taken subject to such reservations and exceptions. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of the City of Bakersfield, in the City Hall, Bakersfield, California. Section 2: That the hour of 8 o'clock P.11.1 of the 21st day of .April, 1947, in the Council Chambers in the City Hall, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the Council and offer evidence in relation thereto. Section I: That the Superintendent of Streets of the City of Bakersfield, California, be and he is hereby directed to cause "Notice of Street 'Vacation" to be posted as required by the said "Street Vacation Act of 1941711 being Division 9 of the Streets and Highways Code of the State of California; and the Council of said City hereby elects to proceed under the provisions of said Act. Section 4: The City Clerk shall certify to the passage of this Resolution, and shall cause the same to be posted on the bulletin board at the City Hail of said City within fifteen (1 5) days after its passage. 2.
