L2, A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKSRSFIELD CALIFORNIA DECLARING ITS IN- TENTION TO ORDER THE V.A,6ATION OF AN ALLEY IN MOCK 264, IN THE CITY OF BAKERSFIELD, CALI- FORNIA. The Council of the City of Bakersfield, California, pursuant to the provisions of the 118treet Vacation .Act of 1 941," being Divi- sion 9 of the Streets and Highways Code of the State of California, does hereby resolve as follows: Section 1: That it is the intention of the Council of the City of Bakersfield, California, to order the vacation of an alley within said City, described as follows, to wit: That certain parcel of land now used for alley purposes that was deeded to the City of Bakersfield by the Kern County Land Company and recorded October 39 1930 in Book 373, at page 3827 of the Official Records of Kern County, California, and described as follows: Beginning at the southwest corner of Lot 6, Block 264 on the northerly boundary of 17th Street in the City of Bakersfield; thence 20 feet easterly along the northerly boundary of said 17th Street to a point; thence 37.55 feet northerly and parallel to the west boundary of said Lot 6 to a goint; thence 103.1 feet at an angle to the right of 34 47' to a point; thence 24.35 feet westerly and parallel to the northerly boundary of said 17th Street to a point; thence 95.4 feet to an angle to the left of 550 13' to a point in the west boundary of said Lot 6; thence 43.87 feet southerly along the west boundary of said Lot 6 to the point of beginning. And also that certain remaining 20 feet wide central por- tion of the original 33 feet wide alley in Block No. 264 as said Block is shown on the Map of the City of Bakers- field recorded in Map Book 1, pages 13 -14 November 257 1898 that lies between the easterly terminus of that portion of said. alley, vacated under Resolution of Inten- tion No. 637 dated December 11 1941, and a line 30 feet distant westerly from and parallel with the northerly extension of the easterly line of Lot 8 in said Block; reserving and excepting from said vacation, the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across the alley pro- posed to be vacated and pursuant to any existing franchises or re- 1. newals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures fpr the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the alley proposed to be vacated. That it is determined by the Council of the City of Bakersfield that the public convenience and necessity require the reservation of said easements and the proceedings hereunder are taken subject to such reservations and exceptions. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of the City of.Bakersfield, in the City Hall, Bakersfield, California. Section 2: That the hour of 8 o'clock P.M., of the 14th day of March, 1949, in the Council Chambers in the City Hall, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the Council and offer evidence in relation thereto. Section 3: That the Superintendent of Streets of the City of Bakersfield, California, be and he is hereby directed to cause "Notice of Street Vacation" to be posted as required by the said "Street Vacation Act of 1941,11 being Division 9 of the Streets and Highways Code of the State of California; and the Council of said City hereby elects to proceed under the provisions of said Act. Section 4: The City Clerk shall certify to the passage of this Resolution, and shall cause the same to be posted on the bulletin board at the City Hall of said City within fifteen (1 5) days after its passage. ------ 000 ------ 2.
