HomeMy WebLinkAboutROI NO 0678RESOLUTION OF INTENTION NO. 678 RESOLUTION OF INTENTION TO IMPROVE PUBLIC IMPRC W,'MENT DISTRICT NO. 678 IN THE CITY OF BAKErRSFIELD, CALIFORNIA. BE IT RESOLVED by the Council of the City of Bakersfield, as follows: That it is the intention of the City Council of the City of Bakersfield, to order the following wo rk to be done and improve- ment to be made in said City, to wit: The construction of 6" sanitary sewer of vitrified clay pipe in Dobrusky Drive and Snyder Lane and the construction of an 8" sanitary sewer of vitrified clay pipe in N Street, together with manholes, lampholes and "Y" branches. All of said work is to be done in accordance with the plan and profile approved by the City Council of the City of Bakersfield, and adopted by said Council on the 14th day of February, 1950, said plan and profile being entitled "Plan for Public Improvement District No. 678," which plan and profile is on file in the office of the City Clerk of the City of Bakersfield, and is hereby referred to and by such reference made a part and portion hereof, and in this connec- tion said plan and profile also shows the exact location of the aforesaid work and improvement. The proceedin�:s herein were recommended in writing by the Health Officer of the City of Bakersfield on the 1st day of February, 1950, as necessary as a health measure and said recommendation was spread upon the minutes of the Council of the City of Bakersfield; and that on the 6th day of February, 1950, such necessity was found to exist by Resolution of the City Council adopted by an affirmative vote of more than four - fifths of the members thereof, in accordance with the provisions of Section 2808 of the Streets and Highways Code. Said contemplated work and improvement in the opinion of 1. said City Council is of more than local or ordinary public benefit, and said Council hereby makes the costs and expenses of said work and improvement chargeable upon a district, which district said City Council hereby declares to be the district benefited by said work and improvement and to be ass esseto pay the costs and expenses thereof, and which said district is bounded and described as follows: Beginning at the point of intersection of the northerly line of Terrace Way with the easterly boundary line of the Virginia Tract as said Terrace Way and Virginia Tract are shown on the map of the Virginia Tract, recorded in Map Book 3, Page 70, Official Records of fern County, Cali- fornia; thence northerly along the easterly boundary line of the Virginia Tract to a point distant northerly 130.00 feet, mea ured at right angles, from the northerly line of Terrace Way thence easterly along a line parallel to and distant northerly 130.00 feet, measured at right angles, from the northerly, line of Terrace Way to a point distant westerly 130.00 feet, measured at right angles from the westerly line o:" County Road No. lR7 , as said road was conveyed by deed recorded in Book 818, Page 221, Official Records of Kern County, California; thence northerly along a line paral- lel to and distant westerly 130.00 feet, measured at right angles, from the westerly line of said County Road No. 1075, to a point distance southerly 130.00 feet measured at right angles from the southerly line of Snyder Lane; thence westerly along a line parallel to and distant southerly 130.00 feet, measured at right angles from the southerly line of Snyder Lane to a point in the easterly boundary line of the Virginia Tract; thence northerly along the easterly boundary line of the Virginia Tract to the southwest corner of Tract No. 1061, as per map recorded in Map Book 4, rages 112 and 113, Official Records of Kern County, California; thence northerly along the westerly boundary line of said Tract No. 1061 N. 00 031 E. 122.00 feet thence N. 310 571 E. 319.36 feet; thence N. 25° 041 E. 20.4 • feet; thence S. 890 401 E. 303.08 feet; thence N. 60 Olt _W. 34.00 feet to a point in the southerly line of an alley, 20.00 feet in width, as shown on map of said Tract No. 1061; thence easterly along the southerly line of said alley a distance of 422.23 feet, more or less, to a point of intersection with the easterly boundary line of said Tract No. 1061; thence southerly along the easterly line of said Tract No. 1061, to the southeasterly corner of said Tract; said corner being on the northerly line of Lot 12, in Section 6, T. 30 S., R. 28 E. Y. D. B. &M., as said lot is shown on "Kern County Sales Map No. 1 of Lands of J. D. Iiaggin" filed for record in the Office of the County Recorder of Kern County, California, May 3, 1889; thence southerly, parallel with the westerly line of said Lot 12, to a point of intersection with the southerly line of Terrace :day; thence westerly along the southerly line of Terrace ':Iraq to a point of intersection with the southerly pro- longation of the easterly boundary line of the Virginia Tract; thence northerly alone; the southerly prolongation of the easterly boundary line of the Virginia Tract to the point of beginning. 2. All of the herein proposed work shall be done in pursuance of an act of the Legislature of the State of California, designated the "Improvement Act of 1911" approved April 7, 1911, and all acts amendatory thereof. Notice is hereby given that Serial Bonds shall be issued in the manner and form provided in Part 5 of the Improvement Act of 1911, to represent unpaid assessments of Twenty -five Dollars (025.00) or over, which said bonds shall bear interest at the rate of six per cent (6%) per annum and the last installment of which bonds shall mature ten (10) years from the second day of January next succeeding the next October fifteenth following their date. Notice is further given that on Monday, the 6th day of March, 1950, at 8 o'clock P.M., in the Council Chambers in the City Hall, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons having any objections to the proposed work or improvement may appear before said City Council and show cause wh7 said proposed improvement should not be carried out in accordance with said Resolution. The City Clerk of said City shall cause this Resolution of Intention to be published twice in the Bakersfield Press, a daily news- paper printed, published and circulated in said City of Bakersfield and hereby designated for that purpose by said City Council, and shall give notice of the adoption of said Resolution of Intention by mailing notices, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said work and improvement, whose names and addresses appear on the last equalized assessment roll or as known to the Clerk The Street Superintendent of said City of Bakersfield shall cause to be conspicuously posted along the lines of said contemplated work and improvement and along all the open streets within said district, notice of the passage of this Resolution of Intention in the manner and form required by law. ------ 000 - - - - -- 3 I HEREBY CERTIFY that the foregoing Resolution of Intention was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 14th day of February, 1950, by the following vote: AYES: CARNAKIS, CROSS, KUEHN, MORELOCK, SHURLEY, SIEMON, VANDERLM NOES:- ---- -- - -- -- -- -- - -- --- ----- ------ ABSENT: - - -- il-'srT` ¢- ------- --- ----- ------- ---- -- City C er and �Ex-Ufficlo Clerk of the Council of the City of Bakersfield.
