HomeMy WebLinkAboutRES NO 12-34_s RESOLUTION 12 34 A RESOLUTION ORDERING THE CLOSING OF A PORTION OF 31ST STREET IN THE CITY OF BAEERSFIELD, CALIFORNIA. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows; WHEREAS, the Council of the City of Bakersfield did on the 16th day of April, 1934, pass its Resolution of Intention No. 615, to order the following work to be done, to -wit; That the following described portion of 31st Street be closed, and that the lands included within the boundaries of such portion as described be abandoned: save and except the perpetual right and easement to use and enjoy any or all of the property described herein, for the purpose of constructing, reconstructing, installing, laying. maintaining or re- pairing the following: A sewer line and all of its component parts used or enjoyed in connection therewith; also any other instrumen- talities of sanitation; also water pipes, fire hydrants and appliances for fire protection and all appurtenances there- to belonging; also water pipes and connections for the distribution of a domestic water supply; also any other public system or thing and all of its component parts which may be used and enjoyed in connection therewith, that the City of Bakersfield may de- sire to place, or to have placed therein. That the following described portion of 31st Street between the westerly line of Chester Avenue and the northeasterly line of Golden State Avenue be closed and the land included within the boun- daries of such portion as described be abandoned. The lands necessary and convenient to be abandoned for said purpose are particularly described as follows: Beginning at the point formed by the intersection of the westerly line of Chester Avenue and the northerly line of 31st Street, as said streets and avenue are shown on that certain map entitled "Map of the City of Bak- ersfield, Kern County, California," re- corded in the office of the County Re- corder of Kern County, California, No- vember 25, 1898; and running thence westerly along the northerly line of said 31st Street to the northeasterly line of Golden State Avenue as said Golden State Avenue is established and acquired by "Acquisition and Improve- ment District No. 3" of the County of Kern, California; thence southeasterly along the northeasterly line of said Golden State Avenue to the southerly line of 31st Street; thence easterly along the southerly line of 31st Street to the westerly line of Chester Avenue; thence northerly along the westerly line of Chester Avenue to the northerly line of 31st Street and the point of be- ginning. Excepting, however, from the above described parcel of land a portion thereof described as follows: Beginning at a point in the northerly line of 31st Street 122 feet westerly from the westerly line of Chester Ave- nue; thence southerly and parallel with the westerly line of Chester Ave- nue 82.5 feet to the southerly line of 31st Street; thence westerly along the southerly line of 31st Street a distance of 20 feet ; thence northerly and parallel with the westerly line of Chester Ave- nue 82.5 feet, to the northerly line_ of 31st Street; thence easterly along the northerly line of 31st Street a distance of 20 feet to the point of beginning; being the extension southerly of the alley running northerly and southerly through Block 605, City of Bakersfield. All of the herein proposed work and improvement shall be done in pursuance of an act of the Legislature of the State of California, entitled "AN ACT TO PROVIDE FOR THE LAYING OUT, OPENING, EXTENDING, WIDENING, STRAIGHTENING OR CLOSING UP, IN WHOLE OR IN PART ANY STREET, SQUARE, LANE, ALLEY, COURT OR PLACE WITHIN MUNICIPALITIES AND TO CONDEMN AND ACQUIRE ANY AND ALL LAND NECESSARY OR CONVENIENT FOR THAT PUR- POSE," approved March 6, 1889, and the several acts amendatory thereof or supplemental thereto. For further particulars reference is hereby made to Resolution of Intention No. 615, on file in the office of the City Clerk of the City of Bakersfield. WHEREAS, no objections have been filed against said work and improvement, and more than ten (10) days have elapsed after the expiration of the time of publication of said notices of the passage of said Resolution, and the Council of the City of Bakersfield has acquired jurisdiction to order said work as proposed in said Resolution to be done; NON, THEREFORE, IT IS HEREBY ORDERED, that said work and improvement be done as aforesaid and as specifically described in said Resolution of Intention No. 615, and that said portion of 31st Street be closed, as said street is shown on that certain map entitled "Map of the City of Bakersfield, Kern County, California, filed in the office of the County Recorder of Kern Count-,; -, California, November 25, 1898.
