HomeMy WebLinkAboutRES NO 18-37RESOLU'T'ION 10 18 37 A RESOLUTION ORDERING THE CLOSING OF THE ALLEY IN BL1DCK 356 IN THE CITY OF BAKERK IELD, CALIFORNIA BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERS- FIELD, as follows: WHEREAS, the Council of the City of Bakersfield did on the 7th day of September, 1937, pass its Resolution of Intention No. 621 to order the following work to be done, to -wit: That the following described portion of an alley be closed and the lands included within the boundaries of such portion be abandoned; save and ex- cept the perpetual right and easement to use and enjoy any or all of the prop- erty described herein for the purpose of constructing, 'reconstructing, install- ing, laying, maintaining or repairing the following: A sewer line and all of its component parts used or enjoyed in connection therewith; also any other instrumental- ities of sanitation; also water pipes, fire hydrants and appliances for fire pro- tection and all appurtenances thereto belonging; also water pipes and con- nections for the distribution of a do- mestic water supply; also any other public system or thing and all of its component parts which may be used and enjoyed in connection therewith, that the City of Bakersfield may desire to place or to have placed therein : The alley in Block 356, City of Bak- ersfield, as said block is shown on that certain map entitled "Map of the City of Bakersfield, Kern County, Califor- nia", filed in the office of the County Recorder of Kern County, California, November 25, 1898. All of the herein proposed work and improvement shall be done in pursuance of an act of the Legislature of the State of California, entitled "AN ACT TO PROVIDE FOR THE LAYING OUT, OPENING, EXTENDING, WIDEN- ING, STRAIGHTENING OR CLOS- ING UP, IN WHOLE OR IN PART ANY STREET, SQUARE, LANE, .ALLEY, COURT OR PLACE WITH- IN MUNICIPALITIES AND TO CONDEMN AND ACQUIRE ANY AND ALL LANDS NECESSARY OR CONVENIENT FOR THAT PUR- POSE" approved March 6, 1889, and the several acts amendatory thereof or supplemental thereto. For further particulars reference is hereby made to Resolution of Intention Number 621, on file in the office of the City Clerk of the City of Bakersfield. WHEREAS, the Street Superintendent of the City of Bakers- field did thereupon cause notices of the passage of said Resolution to be posted and published for ten (10) days in the manner as re- quired by law; and WHEREAS, no objections have been filed against said work and improvement, and more than ten (10) days have elapsed after the expiration of the time of publication of said notices of the passage of said Resolution and the Council of the City of Bakersfield has acquired jurisdiction to order said work as pro- posed in said Resolution to be done; NOW, THEREFORE, IT IS HEREBY ORDERED THAT said work and improvement be done as aforesaid and as specifically described in said Resolution of Intention No. 621, and that said alley in Block 356 be closed, as said block is shown on that certain map entitled "Map of the City of Bakersfield, Kern County, California" filed in the office of the County Recorder of Kern County, California, November 25, 1898. ____- 000 - - - -- I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield on the day of , 1937, by the following vote: AYES, RODEN, GIST, KAWNSKT, WXWZW, SMTTN, SOLLERS, WILSON Sr... . ...... ....................... ......_....... it,y Clerk an x fie Merk of he ,,// Council of the City of Bakersfield.
