HomeMy WebLinkAboutRES NO 79-47RESOLUTION NO. 679 4 7, IN THE MATTER OF WIDENING AND RESURFACING 23rd STREET BETWEEN G STREET AND CHESTER AVENUE IN THE CITY OF BAKERSFIELD CALIFORNIA. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF- B.AIIERSFIELD, that certain improvements are proposed to be done and made within the boundaries of the proposed assessment district hereinafter described. In connection therewith, the Council hereby finds and determines, to wits 1. That the nature of the proposed improvement consists of the widening of a portion of 23rd Street with asphalt concrete pavement, resurfacing existing pavement with plant -mixed asphaltic surfacing material and the removal and construction of cement concrete curbs and gutters to provide additional width for roadway area of said street. 2. That the location and extent of the proposed improvement will require the construction of the above - described improvement on 23rd Street in said City, as shown and indicated on a map en- titled "Plan and Profile for the Improvement of 23rd Street Between G Street and Chester Avenue," approved by the City Council, March 179 1947, and more particularly described in the specifications entitled tispecifications, Information to Bidders, Special Provisions, Bid Proposal and Contract for Public Improvement District No. 666." Said map and specifications are on file with the City Clerk and open to inspection. 3. That the boundaries of the district in which the lands proposed to be specially assessed to pay the costs and expenses of said proposed improvement are located, are generally defined as follows: Beginning at the intersection of the north line of 23rd Street with the westerly line-of line Chester Avenue; thence northerly along .Avenue to a point in a line, distant northerly, 132 1 . feet measured at a right angle from-the northerly line of 23rd - Street; thence westerly along a line distant northerly 132 feet from and parallel to the northerly line of 23rd Street and'the westerly pro- longation thereof to A point in the center line of G Street; thence southerly along the center line of G Street to a point-in the westerly prolongation of a line distant southerly 132 feet, measured at a right angle from the southerly line of 23rd Street; thence easterly along a line distant southerly 132 feet from and parallel to the southerly line of 23rd Street and the westerly prolongation thereof to a point in the westerly line of Chester .Avenue; thence northerly along the westerly line of Chester Avenue to the point of beginning. The extent of the territory proposed to be included in the assessment district is indicated by a green boundary line on map known and designated as "Flan and Profile for the Improvement of 23rd Street Between G Street and Chester Avenue," which map is on file in the City Clerk's office and open to inspection. 4. That no amount or percentage is proposed to be paid toward the cost of such improvement from any source other than special assessments upon benefited property. 5. That the law under which the proceedings are to be con- ducted is an act of the Legislature of tkie State of California, entitled "Improvement Act of 1911," and subsequent amendments thereto, being Division 7 of the Streets and Highways Code of the State of California. -- - - - - -- 000-- - - - - -- 2. I HLiMY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 30th day of June, 1947, by the follow- ing vote: AYES! RESOLUTION U_ TION NO 2 6 47 WHEREAS, the Council of the City of Bakersfield did on the 30th day of June, 19471 pass and adopt Resolution No. 7A, entitled "IN THE K&TTER OF WIDENING AND RESURFACING 23rd STREET, BETVMEN G STREET AND CHESTER AVENUE IN THE CITY OF BAIKERSFIELD, CALIFORIML." NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of Bakersfield does hereby find and determine that the probable assessments to be levied to pay the cost of the improvements proposed in said Resolution No. V—i will not exceed the limitations set up by the Special .Assessment, Investigation, Limitation and Majority Protest Act of 1931 being Division 4 of the Streets and Highways Code of the State of California. BE IT FURTHER RESOLVED, that the City Clerk be and he is hereby ordered to give notice of the Council's findings and proposed action by mailing prepaid postcards in the form and manner and to the persons prescribed in Division 4, Part 7 of the Streets and Highways Code of the State of California. -- - - - - -- 000-- - - ---- I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 30th day of June, 1947, by the following vote: AYES: CARNAKIS, CROSS, KNEW!
