RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAKERSFIELD, CALIFORNIA,
ADOPTED PURSUANT TO PROVISIONS OF
SECTION 2808 OF THE "SPECIAL ASSESSMENT
INVESTIGAr ION, LIMITATION AND MAJORITY
PROTEST ACT OF 1931", OF DIVISION IV,
STREETS AND HIGHWAYS CODE OF THE STATE
OF CALIFORNIA.

WHEREAS, the City Council of the City of Bakersfield, California,
has received a communication from the Health Officer of the County of
Los Angeles (who acts as Health Officer in the City of Bakersfield
under an agreement with s aid County), and which communication is in
words and figures as follows:

Gentlemen:
As Health Officer of the County of Kern, California
and also acting as Health Officer of the City of
Bakersfield through an agreement with the County of
Kern, I wish to advise and call your attention to
certain matters pertaining to the area of the City
of Bakersfield, commonly known and referred to as
El Camino Park Annex.
1. The records of the City Clerk's office of the
City of Bakersfield will show that a certain area,
commonly known as El Camino Park Annex, has been
duly excluded from the Union Avenue Sanitation
District of the County of Kern.
2. The records of the County Clerk's office of the
County of Kern will show that, under proceedings
taken by the Board of Supervisors on the 11th day
of December, 1950, no s anitary sewer facilities
were included in said proceedings for said El Camino
Park Annex territory.
3. The present sewer facilities for said El Camino
Park Annex, described in paragraph (2) hereof,
are confined to septic tanks and/or cesa pits
and we are now advised that the Engineer for said
City has completed plans and specifications for
the construction of sanitary sewer collecting lines
and incidental work thereto to serve the area
generally referred to as El Camino Park Annex
within the corporate limits of the City of Bakersfield.
4. The essential present needs of this area in the
matter of sewage collection and disposal, which
is made necessary as a health measure, are as follows:

(a) The soil is not conducive to adequate
leaching and the lots are inadequate in
size to allow continued expansion of
individual sewage disposal methods;
(b) To construct lateral sewer collecting lines
to serve that certain area described in
paragraph (2) hereof;
(c) To make the necessary connections for said
collecting system to the existing trunk lines
heretofore constructed by said City.
In conclusion, it is my recommendation as such Health
Officer that proceedings be instituted for the construction
of said sewer system for said portion of the City of
Bakersfield, known as El Camino Park Annex, as a health
measure and for the ;reservation of public health and safety.
This recommendation is made pursuant to the provisions
of Section 2808 of the "Special Assessment Investigation,
Limitation and Majority Protest Act of 1931", Divis&on IV
of the Streets and Highways Code of the State of California.

ANDWHEREAS, the City Council has duly considered the said
communication and has received information from the City Engineer with
reference to the proposed sewer improvements, referred to in said
communication;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAKERSFIELD,
CALIFORNIA, DOES HERM RESOLVE, DECLARE, FIND, DETERMINE AND ORDER
as follows t
SECTION 1. That the improvements,referred to in said communi-
cation above quoted, are the construction of sanitary sewers and
appurtenant work in South Chester Avenue and other streets and alleys
(El Camino Park Annex), known as Public Improvement District No. 689.
SECTION 2. That the said City Council does hereby find and
determine that the construction of said sanitary sewers and incidental
work in connection therewith, and each of them, is necessary as a
health measure and such necessity for such construction is found to exist.

SECTION 3. That the City Clerk is hereby authorized and
instructed to spread the contents of said original communication
upon the minutes of this meeting of the said City Council at which
this resolution is adopted.
SECTION 14. That this resolution is adopted under and
pursuant to the provisions of Section 2808 of the "Special Assessment
Investigation, Limitation and Majority Protest Act of 1931", Division IV
of the Streets and Highways Code of the State of California, and the
City Council in adopting the same intends to meet each and every
condition and to make each aid every finding necessary on its part
in order to permit the proceedings for said sewer improvements to go
forward to completion without further reference to or application of
the provisions of said Division IV of the Streets and Highways, Code.
I HEREBY CERTIFY that the foregoing resolution was duly
passed and adopted by the City Council of the City of Bakersfield
