A RESOLUTION DETERMINING THAT TRIACTIVE
FITNESS EQUIPMENT CANNOT BE REASONABLY
OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR AND PURCHASE TRIACTIVE
FITNESS EQUIPMENT FROM GREAT WESTERN
PARK AND PLAYGROUND, INC.
WHEREAS, the Recreation and Parks Department has received a $12,604
contribution from Ace Hydraulic, Inc; and
WHEREAS, Ace Hydraulic, Inc. selected Triactive Fitness Equipment as the
preferred playground equipment for the Kern River Parkway; and
WHEREAS, the Triactive Fitness Equipment is a patented design by Triactive
America that can only be reasonably obtained from the distributor because of the
design patent; and
WHEREAS, Great Western Park and Playground, Inc. is the regional distributor
of the Triactive Fitness Equipment
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The above - referenced playground equipment can only be reasonably
obtained from one vendor (Great Western Park and Playground, Inc.) due to the
patented design of the preferred fitness equipment for the Kern River Parkway.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for such equipment shall not exceed $12,604.
