A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DESIGNATING CERTAIN CITY PERSONNEL AS
CERTIFYING OFFICERS AUTHORIZED TO EXECUTE
ENVIRONMENTAL REVIEW RECORD PURSUANT TO
FEDERAL LAW.
WHEREAS, annually, the City of Bakersfield, pursuant to a grant, receives
federal funds form the United States Department of Housing and Urban
Development to undertake projects which benefit low -and moderate - income
persons; and
WHEREAS, federal law requires that environmental review for all projects
undertaken with federal funds comply with the National Environmental Policy
Act ( "NEPA ") prior to obligating funds; and
WHEREAS, such environmental review can be as simple as a one -page
finding of exemption to a multi - volume Environmental Impact Statement ( "EIS ")
and collectively all of the environmental review documents are referred to by
HUD as the Environmental Review Records; and
WHEREAS, federal law and regulations require the City to designate one or
more employees as Certifying Officers authorized to sign the Environmental
Review Record; and
WHEREAS, it is the City's intent to have the City Manager or his /her
designee be the Certifying Officer for all Environmental Review Records
requiring publication and submission to HUD for authority to use grant funds, but
to have the Community Development Director and the Planning Director be the
Certifying Officers for the simpler Environmental Review records, which do not
require such publication and submission.
NOW, THEREFORE, BE IT RESOLVED, incorporating the above recitals herein,
by the Council of the City of Bakersfield, as follows:
The above recitals are true and correct and incorporated herein by
reference.
2. The City Manager or his /her designee are designated as Certifying
Officers authorized to sign all federal Environmental Review Records requiring
publication and submission to HUD for authority to use grant funds.

3. The Community Development Director and the Planning Director
are designated as Certifying Officers authorized to sign all federal Environmental
Review Records that do not require publication and submission to HUD for
authority to use grant funds.
4. This resolution is hereby adopted and supersedes the Resolution No.
128 -07, which was adopted on June 20, 2007.
