A RESOLUTION SUPPORTING PROPOSITION 35, ALSO
KNOWN AS THE "CALIFORNIANS AGAINST SEXUAL
EXPLOITATION" ACT, WHICH PROPOSES, AMONG OTHER
THINGS, INCREASING PENALTIES AND FINES FOR
CONVICTED HUMAN TRAFFICKERS AND REQUIRING
CONVICTED HUMAN TRAFFICKERS TO REGISTER AS SEX
OFFENDERS
WHEREAS, human trafficking is the fastest growing and second largest
criminal industry in the world, second only to drug trafficking; and
WHEREAS, a convicted sex trafficker receives a sentence of 15 years to life
under federal law but under existing California law, the same sex trafficker
would only receive a sentence ranging from 3 to 8 years; and
WHEREAS, the Californians Against Sexual Exploitation ( "CASE ") Act
proposes to increase criminal penalties for human trafficking, including prison
sentences of up to 15- years -to -life and fines up to $1,500,000; and
WHEREAS, the prevalence of the internet and the anonymity it fosters has
fueled the rapid growth of sex trafficking, making trading of women and
children easier than ever before; and
WHEREAS, existing law does not adequately address the impact of the
internet on human trafficking because existing law does not require convicted
human traffickers to register as sex offenders and does not require registered sex
offenders to notify law enforcement agencies about any change in his or her
online account; and
WHEREAS, the CASE Act proposes to remedy this problem by requiring
convicted human traffickers to register as sex offenders and by requiring
registered sex offenders to include in the registration form all of his or her internet
identifiers; and
WHEREAS, the CASE Act would also require registered sex offenders to
provide written notice to law enforcement agencies about any change in his or
her online account within 24 hours of making a change; and

WHEREAS, the CASE Act, in addition to the above, would also do the
following:
1. Prohibit evidence that a victim of human trafficking engaged
in sexual conduct from being used against the victim in court
proceedings;
2. Require police officers to complete human trafficking
training; and
3. Allocate 70% of the fines collected to the Victim Witness
Assistance Fund which provides funding to community based
organizations that serve victims of human trafficking; and
WHEREAS, the City of Bakersfield recognizes the need for amending
existing laws and supports all of the changes the CASE Act proposes.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
I . The above recitals are true and correct; and
2. The City of Bakersfield supports the CASE Act and its proposals to
amend, among other things, laws regarding punishment imposed
on convicted human traffickers and the requirement of convicted
human traffickers to register as sex offenders.
