RESOLUTION OF THE BAKERSFIELD CITY COUNCIL ADOPTING A
NEGATIVE DECLARATION AND ALLOWING THE CLOSING OF, AND
CONSTRUCTION OF CUL -DE -SACS ON, BEECH, MYRTLE, SPRUCE,
PINE, CEDAR, A, B AND C STREETS SOUTH OF 24TH STREET
WHEREAS, the proposal is to allow the construction of cul -de -sacs along the south side
of 24th Street at the intersections with Beech, Myrtle, Spruce, Pine, Cedar, A, B, and C Streets
as shown on the attached Exhibit A (the "Project "), and
WHEREAS, the Planning Department has determined that the Project implements the
Circulation Element of the Metropolitan Bakersfield General Plan; and
WHEREAS, the Planning Commission held a public hearing on November 1, 2012, and
approved Resolution No. 32 -12, which recommended that the City Council adopt a
Negative Declaration and approve the Project; and
WHEREAS, the Clerk of the City Council set Wednesday, November 14, 2012 at 5:15
p,m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as
the time and place for a public hearing before the City Council to consider the proposed
Negative Declaration and approval of the Project as required by Government Code
Section 65355, and notice of the public hearing was given in the manner provided in Title 17
of the Bakersfield Municipal Code; and
WHEREAS, during the hearing, the City Council considered all facts, testimony, and
evidence concerning the proposed negative declaration and proposed Project including
the staff report, initial study, special studies, deliberation, and action by the Planning
Commission.
NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as follows:
The Project implements the Circulation Element of the Metropolitan Bakersfield
General Plan,
The Planning Commission's findings as contained in its Resolution 32 -12 are
hereby adopted.
3. The Negative Declaration prepared for the 24th Street Cul -de -sac Project is
hereby adopted.
4. The Project is hereby approved subject to the following conditions:
a, All property owners between 24th and 22nd Streets along the
affected street must agree to the closure by their signing of a
petition signifying such closure,
b. End -of- street property owners (adjacent to 24th Street) must agree
to donate sufficient property to construct the cul -de -sac to City
standards.
