A RESOLUTION DISPENSING WITH NORMAL BIDDING
PROCEDURES DUE TO NEED FOR EMERGENCY
REPLACEMENT OF BOILER SERVING LARGE COMMERCIAL
DISHWASHER AT THE RABOBANK ARENA THEATER AND
CONVENTION CENTER, NOT TO EXCEED $54,000
WHEREAS, Public Works staff was notified that the boiler serving the large
commercial dishwasher at Rabobank Arena Theater and Convention Center (Arena)
had failed and could no longer stay ignited, thus not meeting health department
standards; and
WHEREAS, due to the age of the boiler, repair is not an option; and
WHEREAS, numerous events serving food require the use of the large commercial
dishwasher; and
WHEREAS, the health and safety of Arena patrons necessitates the immediate
replacement of the boiler; and
WHEREAS, to remedy this emergency, the Public Works Director authorized
ACCO Engineered Systems to proceed with the purchase and installation of the boiler.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
The above recitals are true and correct and incorporated herein by
reference.
2. The City Council hereby determines that based on the above recitals the
boiler serving the large commercial dishwasher at the Arena must be
purchased and installed immediately to guarantee health department
standards are met for the health and safety of Arena patrons. Therefore,
its immediate purchase and installation is of urgent necessity to preserve
the health of the community.
3. The Finance Director is authorized to dispense with bidding in accordance
with Section 3.20.060.D.4 of the Bakersfield Municipal Code.
