A RESOLUTION DETERMINING THAT CONSOLIDATION OF
MAINTENANCE OF IBM EQUIPMENT CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR
TO DISPENSE WITH BIDDING THEREFOR, NOT TO EXCEED
$49,156.
WHEREAS, the City of Bakersfield needs to pay to maintain certain IBM
Computer equipment; and
WHEREAS, the City has been paying IBM to maintain the City's IBM servers,
storage and tape equipment after their warranty period has expired; and
WHEREAS, IBM has established a program whereby their Premier Business
Partners can now consolidate service invoices and provide an additional discount
to government agencies if a pre- existing value -added business relationship exists;
and
WHEREAS, Computer Configuration Services is a Premier Business Partner and
has an established pre- existing value -added business relationship with the City of
Bakersfield; and
WHEREAS, IBM has designated Computer Configuration Services as the only
Premier Business Partner that can offer the City of Bakersfield the consolidation
service;
WHEREAS, Computer Configuration Services has agreed to consolidate the
IBM maintenance into a single annual invoice; and
WHEREAS, the City Manager recommends the Council find that said
consolidated maintenance schedule can only be reasonably obtained from
Computer Configuration Services, LLC, recommends that the Council authorize
dispensing with bidding requirements in accordance with subsection D.2 of Section
3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The Council hereby finds that the consolidated IBM maintenance can
only be reasonably obtained from one supplier (Computer Configuration Services,
LLC) for the reasons set forth above. Ik bAKF,9

3. The Finance Director is authorized to dispense with bidding therefor in
accordance with Subsection D.2 of Section 3.20.060 of the Bakersfield Municipal
Code and to negotiate the purchase of same, not to exceed $49,156.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held on
December 11, 2012, by the following vote:
