HomeMy WebLinkAboutRES NO 005-13RESOLUTION NO. 005- 13 RESOLUTION OF THE BAKERSFIELD CITY COUNCIL RECOMMENDING THE KERN COUNTY BOARD OF SUPERVISORS APPROVE AN AMENDMENT TO THE KERN RIVER PLAN ELEMENT OF THE METROPOLITAN BAKERSFIELD GENERAL PLAN FROM 8.4 (MINERAL PETROLEUM- MINIMUM 5 -ACRE PARCEL), 8.5 (RESOURCE MANAGEMENT - MINIMUM 20 -ACRE PARCEL SIZE) AND 8.5/2.5 (RESOURCE MANAGEMENT - MINIMUM 20 -ACRE PARCEL SIZE /FLOOD HAZARD) TO 7.1 (LIGHT INDUSTRIAL) ON 7.88 ACRES AND 7.1/2.5 (LIGHT INDUSTRIAL -FLOOD HAZARD) ON 30,735 SQUARE FEET LOCATED AT THE NORTHEAST CORNER OF ROBERTS LANE AND ANGUS LANE. WHEREAS, the Kern River Plan Element of the Metropolitan Bakersfield General Plan is a plan jointly adopted by the City of Bakersfield and the County of Kern; and WHEREAS, Gene Surgener, the property owner filed an application with the County of Kern, requesting an amendment to the Kern River Plan Element of the Metropolitan Bakersfield General Plan from 8.4 (Mineral Petroleum- Minimum 5 -Acre Parcel), 8.5 (Resource Management- Minimum 20 -Acre Parcel Size) and 8.5/2.5 (Resource Management- Minimum 20 -Acre Parcel Size /Flood Hazard) to 7.1 (Light Industrial) and 7.1/2.5 (Light Industrial -Flood Hazard); and WHEREAS, the Kern River Plan Element mandates that if application is made for amendment of the Plan under the County's jurisdiction, notice shall be first given to the City Council who shall conduct a public hearing and make a recommendation on the proposal to the Kern County Board of Supervisors; and WHEREAS, the County has submitted the application request to the City for City Council consideration as shown in Exhibit A; and WHEREAS, the Clerk of the City Council set Wednesday, January 9, 2013 at 5:15 p.m. in the Council Chambers to consider the County of Kern request for a recommendation for approval of the amendment as required by Government Code Section 65355, and notice of hearing having been given at least ten (10) calendar days before said hearing by publication in The Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as follows: 1. All required public notices have been provided. 2. The public necessity, general welfare and good planning practices justify the amendment to the Kern River Plan Element of the Metropolitan Bakersfield General Plan. 3. The property is located on Assessor Parcel Numbers 118- 150 -17 and 119- 012 -34 at 760 Angus Lane in the Oildale area. The request includes a change in zone classification from A to M -1 KRC PD on a 3,021 square foot (net) portion of the project site. The purpose for the request is to establish consistency between the General Plan Designation and zone classification in order to process a lot line adjustment encompassing the 8.59 acre site. Staff has determined that there will be no adverse effect on the environment as a result of the project and is exempt from CEQA by General Rule, Section 15061(b)(3) of the CEQA Guidelines. Pursuant to Chapter 1.3, Section B of the Kern River Plan Element, this letter shall serve as official notice of the proposed amendment so that the appropriate hearing body may promptly conduct a public hearing and make a recommendation on the proposal to the Kern County Planning Commission and the Board of Supervisors. Please advise this department of the proposed hearing date before the City Council. It is the intent of the County to schedule this case for consideration by the Kern County Planning Commission on January 24, 2013 and for the Board of Supervisor's consideration on Kern County's March 19, 2013 General Plan Amendment Window.
