A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD CALLING AND GIVING NOTICE OF
HOLDING A SPECIAL MUNICIPAL ELECTION FOR THE
PURPOSE OF FILLING A VACANCY ON THE COUNCIL FOR
THE UNEXPIRED TERM IN WARD 1 AND REQUESTING THE
BOARD OF SUPERVISORS OF THE COUNTY OF KERN TO
ORDER CONSOLIDATION OF SAID ELECTION WITH ANY
OTHER ELECTION HELD WITHIN THE COUNTY OF KERN ON
TUESDAY, JUNE 4, 2013.
WHEREAS, pursuant to Sections 16 of the Bakersfield City Charter, a
Special Election may be called to fill a vacant Council seat; and
WHEREAS, the Council seat for Ward 1 became vacant on
December 2, 2012, more than six months prior to the next general election for
Ward 1 Councilmember; and
WHEREAS, City Charter Section 16 requires that the election be held
not less than ninety days nor more than one hundred eighty days from the date
of the certification of the petition; and
WHEREAS, it is the desire of this Council that the special election
above specified be consolidated with any other election held within the County
of Kern on Tuesday, June 4, 2013; and
WHEREAS, in accordance with § 10002 of the California Elections
Code, it is desirable that the Board of Supervisors of the County of Kern permit
the Kern County Elections Official to render services to the City relating to the
conduct of a Special Election and that the County Elections Department
canvas the returns of the Special Municipal Election.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:

SECTION 1. That pursuant to Sections 16 and 74 of the City
Charter of the City of Bakersfield a Special Municipal Election is hereby called to
be held in the City of Bakersfield on Tuesday, June 4, 2013, for the purpose

of filling the vacancy on the City Council for Ward 1 for the remainder of the
unexpired term.
SECTION 2. That pursuant to the requirements of Section 10403 of
the California Elections Code, the Board of Supervisors of the County of Kern is
hereby requested to consent and agree to the consolidation of a Special
Municipal Election with any other election held within the County of Kern on
Tuesday, June 4, 2013, for the purpose of electing a Member of the City Council
for Ward 1 to fill the unexpired term of Rudy Salas, ending November 2014.
SECTION 3. That the Board of Supervisors is requested to issue
instruction to the County Elections Department to take any and all steps
necessary for the holding of the consolidated election.
SECTION 4. That the County Elections Department is hereby
authorized and requested to canvass the returns of said Special Municipal
Election and to certify such canvass of the votes so cast to the City Clerk.
SECTION 5. That the City of Bakersfield recognizes that additional
costs will be incurred by the County Elections Department and shall reimburse
the County for services performed when the work is completed and upon
presentation to the City of a properly approved bill.
SECTION 6. The City Clerk is hereby authorized and directed to
certify the adoption of this resolution, transmit to and file with the Board of
Supervisors and the County Election Department of the County of Kern.
SECTION 7. The City Clerk is hereby authorized and directed to give
all notices and perform all advertising as required by law and perform or cause
to be performed all the duties and functions in the conduct of the election as
required by State law.
