HomeMy WebLinkAboutRES NO 010-13RESOLUTION NO. 0 10 — 1 3 A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL DISPENSING WITH FORMAL BIDDING PROCEDURES IN THE PURCHASE OF WET PLAY EQUIPMENT FROM VORTEX AQUATIC STRUCTURES INTERNATIONAL INC. FOR INSTALLATION AT SIEMON PARK, NOT TO EXCEED $150,000.00 DOLLARS. WHEREAS, on November 14, 2012, the Bakersfield City Council authorized the installation of wet play equipment at Siemon Park to replace the existing swimming pool; and WHEREAS, the City's Recreation and Parks Department has determined that the operating and maintenance costs for the wet play equipment can be reduced by installing wet play equipment at Siemon Park produced by Vortex Aquatic Structures International Inc. ( "Vortex "), the same manufacturer that produced the wet play equipment installed at Wayside Park, Jefferson Park, Dr. Martin Luther King Park, Planz Park, Beale Park, Jastro Park, and Greystone Park; and WHEREAS, Vortex is the only manufacturer of wet play equipment meeting all playground safety regulations, including American Society for Testing and Materials (ASTM) F 1487; and WHEREAS, Miracle Playground Sales of Southern California ( "Miracle ") is the exclusive authorized distributor of Vortex wet play equipment for the Southern California, Arizona, and Nevada territory, which includes Bakersfield; and WHEREAS, Bakersfield Municipal Code ( "BMC ") Section 3.20.060D.2 allows the City to dispense with bidding procedures when it is determined that work, supplies, equipment, or materials to be purchased can only be reasonably obtained from one vendor because of restricted availability of such work, supplies, equipment, or materials, or it is necessary to successfully integrate such work, supplies, equipment, or materials into an existing city project or system. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The wet play equipment for Siemon Park can only be obtained from Vortex through Miracle because Vortex is the only manufacturer of wet play equipment that meets all playground safety regulations, including ASTM F 1487, and Miracle is the sole distributor of Vortex wet play equipment in Bakersfield. 3. Purchasing the wet play equipment for Siemon Park from Vortex, the same manufacturer that produced the wet play equipment used by City in many of its other parks, allows the City to reduce the operating and maintenance costs for the wet play equipment at Siemon Park. 4. The requirements for the dispensing of bidding procedures under BMC Section 3.20.060D.2 are met, and the Finance Director is hereby authorized to dispense with bidding procedures in the purchase of wet play equipment for Siemon Park. 5.
