Miscellaneous News
We received notice this week that the County Auditor-Controller’s Office has
processed a refund of approximately $3.3 million to the City for property tax
administrative fees overpaid to the County since 2006-07. Although this is good news, it
is a one-time repayment of monies which have accrued over the past six years.
Moving forward, the reduction in property tax administrative fees will be much more
modest on an annual basis. Therefore, the majority of this amount does not represent
recurring revenues. Please do not confuse this with the funds being withheld from the
City by the County on the Tax Split and Fire Fund issues. While those are parallel, they
are separate matters.
As you are aware, the team that has been evaluating the proposals submitted for
management and operation services for the City’s civic facilities has completed their
review, and will be recommending the selection of AEG Facilities. Subject to
successful contract negotiations with AEG, we plan to request City Council approval
at the March 20th meeting.

According to information provided by the Public Works Department, the Keep
Bakersfield Beautiful (KBB) program was recently recognized as a member of the Keep
America Beautiful President’s Circle for maintaining good standing.
An award was also received by KBB from the Downtown Business Association on
February 14th to recognize the grant projects KBB did downtown that included
enhancing the Garces Circle monument, the painting of several utility box murals
downtown and in Mill Creek, and the provision of public cigarette butt containers as a
means of litter prevention. These particular projects earned four Beautiful Bakersfield
Award nominations from the Chamber of Commerce, the banquet for which will be
held June 1st.
The Solid Waste Division of the Public Works Department will be honored on March 7th
with the Ken Volpe Environmental Resources Award for the school food recycling
program. A memo provides more detail. Great job!

SUBJECT: Storefront Window Advertising Ordinance

Councilmember Maxwell requested that staff provide clarification to him regarding
what the owners of a store located at 2305 Chester Avenue were told about how
much advertising could be painted on the window, per the City’s ordinance.
The business at 2305 Chester Avenue had covered 100% of their window area with
advertising. The City’s sign regulations allow window advertisements, provided they
are not used on more than two building elevations, must be on the 1st floor, and
cannot exceed an area for each elevation of 32 square feet or 25% of the window
area, whichever is less.
Correction notices were sent to the business owners that were followed by a meeting
with Code Enforcement staff. The business owners then modified the advertisements
to comply with the Ordinance, and the case was closed.
This issue originated with a citizen complaint. While investigating the concern, the
Code Enforcement officer found no other violations in the area.

SUBJECT: Expansion of Rosedale Highway

Parker Lane currently has a “full access” type of intersection with Rosedale Highway, so
both right-turns in and out as well as left-turns in and out are permitted. But Rosedale
Highway is a much busier street today than when Parker Lane was originally
constructed, and Caltrans has had concerns with the safety of this intersection for some
time. And with the construction of the TRIP Rosedale Highway Widening project, left-
turning traffic at Parker Lane will have to cross even more lanes on Rosedale Highway
than exist today. Because of these concerns and the fact that Mohawk Street is
located just to the West of Parker Lane, Caltrans required that the median in Rosedale
Highway at Parker Lane be closed with the widening project. This closure will result in
right-turns into and out of Parker Lane still being allowed, but will prevent the left-turns in
and out.
Parker Lane and its intersection with Rosedale Highway are entirely outside of the City.
Parker Lane currently has its south terminus at the City corporate boundary; Ward 3
exists south of this terminus. One of the property owner’s along Parker Lane has
proposed that an access roadway could be built that would connect to Mohawk
Street along the alignment shown on the attached exhibit. A traffic signal was installed
with the Westside Parkway Phase 1 Project (Mohawk Street Extension) at this Mohawk
Street connection point. The City responded to this property owner that if this local
roadway was constructed by the property owner to City Standards, and the City
Standard local street width was offered for dedication to the City, that the City would
accept this dedication and road as a public street and operate and maintain it as
such.
Councilmember Maxwell requested that staff investigate the concerns brought
forward from business owners on Parker Road regarding the number of trucks that
travel in the area. He further asked that staff look at the petition that was provided to
him, and review how this situation, as it relates to the expansion of Rosedale
Highway, can be handled.

Staff now understands that this property owner wants the City to pay for and construct
this proposed access road. This access road is a local street, and so construction could
not be paid for with regional traffic impact fees.
At the time the grade separation for Rosedale Highway over the railroad east of Parker
Lane is constructed, there will need to be provisions designed to maintain access
to/from Parker Lane. But there is currently no funding identified for that grade
separation, and its construction isn’t scheduled for another 10 to 15 years.
