Miscellaneous News
• We received some positive news this week. Sales tax revenue showed a slightly
positive increase of 5.29 percent in the past quarter, as compared to the same
quarter in the previous calendar year. For the past four quarters the City has
experienced an increase of 4.09 percent compared to the previous four
quarters. Two memos from Finance Director Nelson Smith are enclosed which
provide additional information on sales tax revenue trends by quarter and
industry.
• Enclosed is the official news release from AEG regarding the Council’s
approval of the new facilities management agreement.
• Central Valley Magazine, a special publication of the Fresno Bee, published
the enclosed positive article on Bakersfield in a recent edition. The article
features information on many points of interest, local restaurants and hotels.
• March continues to be a busy month for visitors in Bakersfield. This past
weekend, music played a key role in two large groups meeting in our city. The
Sweet Adelines International Regional Competition was held at Rabobank
Theatre from Thursday to Sunday. At the Kern County Fairgrounds, the 48th
Bakersfield Fiesta brought square dancers from throughout the nation and
Canada for competitions Thursday to Saturday. Both events helped to fill local
hotel rooms and restaurants, and followed up on CIF Boys Wrestling and the
March Meet, which brought visitors to Bakersfield the previous two weekends.

SUBJECT: Quarterly Sales Tax Update
We received the most recent quarterly sales tax data, which reflects the activity and
sales during the months of October, November and December 2012. The quarterly
and annual trend information is as follows:
Comparing the most recent quarter with the same quarter last year-
positive ( +) 5.29 %.
Comparing the most recent four quarters with the prior four quarters-
positive ( +) 4.09 %.
These results are generally in line with our budget projections for the current fiscal year,
which estimated sales tax growth at an annualized rate of 3.0 %.
We do not have the detail results available by industry type at this time; this
information will be available in a few weeks.

SUBJECT: Sales Tax Quarterly Report by Industry
Attached is a copy of the Sales Tax Quarterly Report by Industry, comparing the top ten industry
categories second and third quarter results of2011 to their respective quarterly results of2012.
This provides a more specific look at what types of industries are doing better or worse than
citywide results for a given feriod. The overall growth for the 2nd quarter of2012 was 10.3% and
the overall growth for the 3r quarter of2012 was 2.5%.
Building Materials, New Car Dealers and Department Stores all show above average positive
movement compared to the same quarters last year, while Service Stations and Oil & Gas Services
& Equipment show below average results compared to the same quarters of the previous year.

AEG FACILITIES AWARDED LONG-TERM MANAGEMENT CONTRACT
FOR BAKERSFIELD’S RABOBANK ARENA AND OTHER VALLEY VENUES
LOS ANGELES, CA (March 21, 2013) – The Bakersfield City Council last night unanimously approved a 10-
year agreement for AEG Facilities to manage Bakersfield’s Rabobank Arena, Theater & Convention
Center complex, the San Joaquin Community Hospital Ice Center and Bright House Networks
Amphitheatre.
Under the agreement, AEG Facilities will provide full venue services including management, event
booking, exclusive sponsorship and naming rights sales, premium seating programs, venue operation
and access to AEG’s purchasing network and AEG’s 1EARTH sustainability campaign.
“After a closely scrutinizing both proposals on a variety of levels, AEG’s was clearly the better plan for
our arena, our other venues and our City,” said City Manager Alan Tandy. “Their experience, their
understanding of our venues and our market and their willingness to take risk to guarantee the fiscal
impact to our City set them apart. Finally, with AEG being the only company with a division (the second
largest in the world) that books and promotes concerts and other live entertainment, this choice will
also mean more and bigger events at Bakersfield facilities.”

Rabobank Arena, the main showcase of Bakersfield’s downtown public sports and entertainment
facilities has been the home of the Bakersfield Condors hockey team (ECHL) since the 10,000-seat arena
opened in 1998. The modern, multi-purpose and fully equipped facility is also the home of concerts,
family shows, special events, basketball and other sporting competitions as well as convention related
activities affiliated with events taking place at the Rabobank Theater and Convention Center located
adjacent to the arena which contains a 26,000-square foot exhibit hall along with 14 meeting rooms and
a 3,000-seat theater that is the seasonal home for the Bakersfield Symphony Orchestra, Community
Concerts and an annual Broadway tour. Also included in the portfolio of City-owned venues AEG
Facilities will now oversee is the 41,000 square foot San Joaquin Community Hospital Ice Center, a full-

Councilmember Sullivan requested that staff provide information on who is
responsible for the cleanup of the area around the Liberty Bell. She further asked
that staff provide information about the policy cleanup after an event.
The Liberty Bell and surrounding plaza is County owned property and therefore, the
County is responsible for details of the reservation and subsequent cleanup.
If an event is held in a city park area, the group pays a deposit of at least $500 to $1 ,000,
depending on the event location and type of event, along with proof of insurance.
For event p ermits issued outside of city parks but within the City's jurisdiction, the Code
requires a cleanup deposit of at least $200 and insurance. In both cases, if the area is
cleaned up after the event and no other damage has occurred, the deposit is refunded.

SUBJECT: CITIZEN REPORTING PROCEDURE
Council Referral No. 356
Council Member Johnson requested that staff revise the procedure for citizens to provide
reports to the Police Department. Specifically, he asked that staff assist citizens by taking the
reports over the phone, and then encourage them to use the online form themselves for
subsequent reports.
Last year the Bakersfield Police Department processed 5,646 telephonic reports and 6,467 on-line
reports submitted by crime victims. Individuals who are unable to complete on-line reports are
forwarded to the telephonic report process. The telephonic reports are received by the
Communications Center, and forwarded to a queue where they are handled in the order they are
received by the desk officer, and Police Service Technicians who are assigned to commit the first
hour of their shift to telephonic reports. The department strives to handle these calls within 72 hours
of receipt.
The department also uses officers and employees in modified duty positions to assist with the
handling of telephonic reports, and is currently in the process of developing a volunteer program
which also may be of assistance in the future.
Current staffing levels do not allow for immediate response to telephonic reports. The department will
be working on an analysis of staffing needs that would be required for that action. Consideration will
be given to it in the budget process, along with the fundamental shortage of sworn staff and related
considerations.

Red Curbs at Bus Stops

Councilmember Johnson requested that staff provide an update in follow up to
efforts being made to paint curbs at bus stops red to indicate a no-parking zone.
California Vehicle Code does not prohibit parking in front of a bus stop. The City, by
ordinance, is allowed to establish no parking zones in front of bus stops by painting the
curb red or installing no parking signs. Per CVC, buses may stop in a no parking zone
marked for buses.
Ideally, GET locates bus stops along collectors and arterials that are already signed no
parking for a substantial length. Per GET's standard, they prefer a 130 feet of "No
Parking" to move the 40' bus out of the traffic lane and then this also provides an
acceleration length back into traffic. At stops located at the far side of an intersection
or driveway, the no parking distance is adjusted since the bus move over can take
place in the intersection/driveway area. Therefore, the no parking zone length at bus
stops varies by location and need.
Staff has reviewed GET's 703 bus stops within the City of Bakersfield which GET marks
with a bus sign and/or bus shelter. Of those, 334 (48%) are in "No Parking" zones. Many
of the stops not in no parking zones are on collector streets and where there is also not
a conflict between parked vehicles and the bus loading hours of operation. Therefore,
it would be unnecessary to remove parking at every location. Also, in some areas,
removal of the preferred 130' feet of parking would severely impacting residential or
business parking areas. It should be noted GET changed many of their bus stop
locations and routes in October 2012.
The issue of no parking at bus stops was reviewed by the City's Legislative and Litigation
Committee in 2012. It was determined Public Works would continue to work with GET
and remove parking on a case by case basis. Also, the committee requested staff

SUBJECT: POSSIBLE INTERNET CAFÉ ON OAK STREET
Council Referral No. 370
Council Member Maxwell requested the Police Department investigate and follow-up on a
claim of an internet café on Oak Street, near Pizzaville, as there are reports of illegal activities
in the facility.
On February 14th, 2013, members of the Bakersfield Police Department/Kern County Sheriff’s Office
Joint-Vice Task Force responded to the report of possible illegal activity occurring at the Hot Spot
Cyber Center LLC located at 714 Oak Street.
Staff observed patrons at approximately 50 computers which were generating the sounds and
appearance of Las Vegas-style gambling/electronic slot machines. A poster listing sweepstakes rules
was displayed on the wall from Tel-Connect Phone Card Service, a company that supplies one of the
programs used by internet café businesses.
Based on this observation, a criminal investigation was initiated for this business being in violation of
Penal Code 330 (Possession of Illegal Gambling Device). This case will be submitted to the Kern
County District Attorney’s Office for charges.
In addition, a calls-for-service record check on the address and the business name revealed four
criminal cases generated during the past year, including three vehicle thefts and one vehicle burglary,
with a total of 24 calls for service.
Investigations Division staff contacted the Kern County District Attorney’s Office and was advised that
civil action has been pursued towards several internet café businesses using the Tel-Connect Phone
Card Service and the Figure Eight Internet Sweepstakes Programs for illegal gambling in the last
several months. The City of Bakersfield will immediately be notified once the California Appellate
Court makes a ruling.
Staff from the City/County Joint-Vice Task Force will continue to investigate any illegal or potentially
illegal activity regarding sweepstakes type gambling centers that are brought to their attention. All
completed investigations will continue to be submitted to the Kern County District Attorney’s Office for
case filing.

All sweepers are assigned to sweeping streets that are not on a set sweeping schedule.
NOTE: If raining, there will be no street sweeping service and all street cleaning personnel will be
assigned to cleaning plugged drains and part circle culverts. This also applies when a large number of
street sweeper are in Fleet for repairs. Areas that have been missed during this time will be swept at the
end of the month.
