RESOLUTION OF THE COUNCIL ORDERING THE VACATION
OF A PUBLIC UTILITIES EASEMENT LOCATED SOUTH OF
MING AVENUE AND WEST OF CANTER WAY. (WARD 6)
WHEREAS, the City has received a request to vacate a public utilities easement
located south of Ming Avenue and west of Canter Way; and
WHEREAS, this dedication is eligible for summary vacation per Section 8330 of the
Streets and Highways Code which authorizes the City Council to summarily vacate
street or highway that has been superseded by relocation; and
WHEREAS, for the above - described project, it was determined that the proposed
vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines
(General Rule) in that there is no possibility that the proposed action could have a
significant effect on the environment; and
WHEREAS, Planning Department approved the summary vacation on May 6,
2013, per local ordinance and found it to be consistent with the Metropolitan
Bakersfield General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
The above recitals are true and correct and are incorporated herein.
2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of California.
3. The Council orders the vacation of a public utilities easement located south of
Ming Avenue and west of Canter Way, (more specifically described and
illustrated in Exhibit A and Exhibit B, both of which are attached hereto and
incorporated herein), all in the City of Bakersfield, County of Kern, State of
California.
4. The City Clerk shall certify to the passage of this resolution and shall cause a
certified copy hereof, attested by the Clerk under the seal of the City, to be
recorded in the Office of the County Recorder of the County of Kern, California.

VACATION OF PUBLIC UTILITY EASEMENT
Legal Description
That portion of the 5 ft. public utility easement dedicated to public use according to the map of
Tract No. 3412, in the City of Bakersfield, County of Kern, State of California, recorded July 16,
1970 in Book 19 of Maps, Page 90, in the Office of the County Recorder of the County of Kern,
lying north of a line that is parallel with and 2.50 ft. north of the south line of Lot 4 of said Tract
No. 3412.
EXCEPTING THEREFROM that portion thereof lying within the public street right of way of
Ming Avenue.
Contains an area of. 1379 Sq. Ft., more or less.
