AN ORDINANCE OF THE CITY OF BAKERSFIELD ADDING
SECTION 17.04.463 AND AMENDING SECTION 17.08.050
OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO
MEDICAL MARIJUANA DISPENSARIES.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Section 17.04.463 is hereby added to the Bakersfield Municipal Code to
read as follows:

"Medical marijuana dispensary" means a facility or location where marijuana is
made available for medical purposes in accordance with California Health and
Safety Code Section 11362.5 et seq.
SECTION 2.
Section 17.08.050 of the Bakersfield Municipal Code is hereby amended to
read as follows:
17.08.050 Prohibited uses.
The following uses are specifically prohibited within any zone district:
A. Medical marijuana dispensary.
SECTION 3.
This Ordinance shall be posted in accordance with the Bakersfield
Municipal Code and shall become effective ten (10) days after the date of its
passage.
