Correspondence Received Clerk Typist announced the KRGSA had received nine items of correspondence: 1. Correspondence dated March 22, 2017 from Paul Hendrix, requesting to receive agenda announcements. 2. Correspondence signed by Eric Everett from the Kern Groundwater Authority accepting the terms and conditions with the KRGSA participating in the Authority's study titled "Remote sensing of historic evapotranspiration using ITRC- METRIC for the valley portion of Kern County." 4. Correspondence signed and delivered to the KRGSA by the below agencies that wish to participate in Phase II Scope of Work with Todd Groundwater. Amendment to Todd Groundwater Agreement No. KRGSAI6 -002 Motion by Chair Member Smith, APPROVED seconded by Chair Member Lundquist, approving amendment one to Agreement KRGSA 16 -002. Motion by Chair Member Smith, APPROVED seconded by Chair Member Lundquist, directing staff to draft a response letter to the KGA stating that the KRGSA approves the concept of participating in the peer review, subject to further review. iii. Lamont PUD Participation Request General Manager of Kern Delta Water District Mark Mulkay made staff comments. iv. Request for Timely Completion of the C2VSim Model Update ID4 Manager David Beard made staff comments. We are a small company with decades of experience as a licensed consultant, and expert witness, for water resources projects in California and throughout the United States. Lytle Water Solutions' staff are experts in water resources, groundwater modeling, and sustainability. A digital Statement of Qualifications (SOQ) is attached which contains resumes for our key team members. It also contains links to videos which depict both comprehensive and simple geologic models, and discusses our approaches to managing data, geologic modeling, flow modeling, similar recent projects, and references. Occasionally, our work involves building very comprehensive basin -wide models, which support many uses, and are sometimes jointly funded by multiple users. However, much more often we develop less robust local models to answer specific questions. Many times we've been asked to review and update /improve previously constructed models and management plans prepared by others. We want to be very clear that we have great flexibility working on both small and large projects, from a few square miles in size up to several hundred square miles, and we tailor our work to meet our clients' needs and budgets. Our standard approach is to work with our client and local experts to utilize their knowledge of the basin, history, and available data, while performing the bulk of the engineering and hydrogeology workload with our team's efficient staff who have thousands of hours assessing California basins. Thus, we can provide deliverables which are cost - effective, and involve local expertise. Box 942836 Sacramento, California 94236 -0001 SUBJECT: NOTIFICATION OF INTENT TO DEVELOP GROUNDWATER SUSTAINABILITY PLAN Dear Mr. Joseph, The purpose of this letter is to notify you that the Kern River Groundwater Sustainability Agency (KRGSA) intends to develop a Groundwater Sustainability Plan (GSP) pursuant to Water Code Section 10727.8 for its service area within the Kern County Subbasin (Basin Number 5- 22.14, DWR Bulletin 118). The KRGSA is an exclusive GSA whose formation was posted by DWR on April 21, 2016. The KRGSA is engaged in several coordination and outreach efforts across the Kern County Subbasin, as well as, within the more specific service area of the KRGSA. The KRGSA actively participates in technical and planning meetings and forums with other GSAs in the Kern County Subbasin, recognizing that the findings of the KRGSA's GSP will need to be coordinated with other GSP development efforts occurring in parallel within the Kern County Subbasin. The KRGSA has taken the lead in developing modelling tools that will facilitate integration and plan alignment among multiple GSAs /GSPs in the Subbasin. The KRGSA holds monthly public meetings to review and discuss on -going planning activities in support of the GSA and GSP development process. These meetings welcome public input and feedback to the GSA and the GSP development process. Once the GSP process is more fully underway, the KRGSA will also be holding quarterly meetings with the specific objective of reviewing progress in developing the technical elements of the GSP. These quarterly GSP update meetings will be open to the public and welcome participation by other GSAs in the Kern County subbasin, interested parties within the basin or KRGSA service area, or other members of the public. In addition to these coordination and technical efforts described above, the KRGSA will also be holding educational workshops specifically intended for the interested parties and general public (residents) living in the KRGSA service area. These additional workshops will have an educational focus to inform attendees on the overall role and purpose of the GSA, describe the method and process to develop the GSP, and share our understanding on how the GSP will eventually be implemented. One of the key goals of these public workshops will be to hear comments and feedback from the public that can be used to further inform the GSP development process. SGMA and State Intervention In 2014, Governor Edmund G. Brown Jr. signed SGMA, which creates a framework for sustainable, local groundwater management for the first time in California history. SGMA requires the formation of local groundwater sustainability agencies (GSAs) in California's high- or medium - priority groundwater basins or the submittal of an alternative that demonstrates a basin is already sustainable.1 GSAs are required to develop groundwater sustainability plans that make basins sustainable within 20 years of implementation. If locals are unable or unwilling to sustainably manage their basin, the State Water Board is authorized to intervene. State intervention is triggered by one of the following events: • July 1, 2017 No GSA or Alternative for entire basin • February 1, 2020 Basin is in critical overdraft and there is no plan or DWR fails plan • February 1, 2022 No plan or DWR fails plan and basin is in long -term overdraft • February 1, 2025 DWR fails plan and basin has significant surface water depletions Beginning July 1, 2017, portions of basins not within the service area of a GSA are considered unmanaged.z Any person that extracts groundwater from an unmanaged area must submit annual reports to the State Water Board.a If locals fail to form a GSA, fail to develop an adequate sustainability plan, or fail to implement the plan successfully, the Board may designate the basin probationary and directly manage groundwater extractions.4 Any person who extracts groundwater from a probationary basin must submit annual reports to the State Water Board, although the Board has discretion to exclude certain extractors from reporting.s Annual reports are due to the Board by December 15 of each year for extractions made during the previous water year (October 1 - September 30). A report must be submitted for each well and must identify well owner information, well location, well capacity, monthly extraction volumes, and place(s) and purpose(s) of use. Extraction volumes must be measured by a method satisfactory to the Board.e Electronic Filing of Reports The emergency regulation includes a requirement that groundwater extraction reports be filed electronically, as authorized by SGMA7. The State Water Board is developing a web -based electronic reporting system for the preparation and submission of reports of groundwater extraction. The reporting system will ease the burden of preparing reports by 1) providing resources to identify groundwater extraction information; 2) identifying information on behalf of extractors; and 3) providing mapping resources in lieu of well owners acquiring maps or consulting services to satisfy requirements for locational information. State Water Board Fees Any person that files an extraction report must pay a filing fee to cover the Board's SGMA- related costs.s The emergency regulation specifies these fees, as required by SGMA,9 and allows the Board to update the fees as necessary to reflect changing conditions and programmatic costs. These fees will not apply in basins where local implementation of SGMA is successful. Fees for the 2017 Water Year In an effort to prioritize GSA formation and well registration, and to avoid undue burden to unmanaged extractors, the State Water Board adopted simplified fees for the 2017 Water Year, as detailed below: • The annual fee for reports due by December 15, 2017 is a flat fee of $300. The late fee for reports due by December 15, 2017 is $100 for each month late up to a maximum of $1200 (inclusive of the $300 flat fee). If a GSA forms between July 1, 2017 and September 30, 2017, extractors within the GSA service area are considered unmanaged for the 2017 water year and must report to the Board by December 15, 2017, but the annual fee is waived. Fees for the 2018 Water Year The fees are tied to the "level" of state intervention occurring in a basin. Each level is associated with particular types of activities increasing staff workloads and other costs. 1. Unmanaged Area: An unmanaged area is a portion of a basin not within the service area of a GSA. Extractors in unmanaged areas must submit annual reports to the Board.so Board staff will have to identify unmanaged extractors, collect and review reports, verify extraction data, and evaluate the impact of unmanaged extractors on groundwater conditions in a basin. 2. Probationary Basin: If local failure triggers state intervention, the Board may designate the basin "probationary. "11 Extractors in probationary basins are required to submit annual extraction reports to the Board.12 In addition to the workload associated with locating extractors in a basin and managing reports, Board staff will have to evaluate basin conditions and investigate potential solutions for unsustainable conditions. 3. Interim Plan: In certain cases, the Board will need to directly manage extractions in a basin. Therefore, the costs associated with these reports are not currently included in the emergency regulation.14 Metered Extraction Discount To be eligible for the $10 per acre -foot unmanaged area rate, extractors must measure groundwater extraction volumes with a meter that meets the following criteria: • The meter must be equipped with a totalizer and permanently attached to the well. • No water use can occur between the point of extraction and the meter. • The meter must be calibrated by a qualified individual to be accurate to within ± five (5) percent by volume upon installation and at least once every five years. • The meter must be accessible for reading, inspection, testing, repair and replacement. • The meter must be available for inspection by the State Water Board. Extractors are responsible for the installation and maintenance of meters and all related costs. Fee Examples 1. There is an exception for extractors in areas where a GSA forms after September 30, 2017. These extractors are required to report for the entire water year, but the annual fee is limited to extractions made during the months the extractors were unmanaged. For example, if a GSA forms on March 15, 2018, extractors in that area will only be charged for extractions made during the entire months of October 2017 through March 2018. On the other hand, if a GSA rescinds its formation notice and an extractor is no longer within the management of a GSA after September 30, 2017, the fee will be based on extractions made during the entire previous water year. De minimis Extractors SGMA defines a de minimis extractor as "a person who extracts, for domestic purposes, two -acre feet or less per year. "ZS A person who extracts two acre -feet or less per year for a non - domestic purpose is not considered a de minimis extractor. Domestic purposes do not include commercial activities. A person who extracts more than two acre -feet per year from a parcel is not a de minimis user. De minimis users are exempt from reporting in unmanaged areas. However, the State Water Board may require de minimis extractors to report in a probationary basin if necessary.1e The emergency regulation clarifies how the term "domestic purposes" will be interpreted when determining if an extractor is de minimis. Stakeholder Input The State Water Board held outreach meetings and presented fee schedule proposals at local events to get a better understanding of stakeholder concerns and solicit feedback on how to best structure the annual fees. A draft of the emergency regulation was released for public comment on March 10, 2017 and followed by a workshop on March 21, 2017. The emergency regulation incorporates input provided by a wide range of stakeholders including local governments, water suppliers, businesses, and individuals. Interim Plans and Groundwater Sustainability Plans State intervention is intended to temporarily protect groundwater resources until local authorities can demonstrate their ability and willingness to manage groundwater sustainably. An interim plan is not intended for permanent management of a basin. Local efforts to address the deficiencies that caused state intervention will need to be funded by local agencies while groundwater extractors also pay State Water Board fees; this will likely result in a scenario of extractors paying both local and state fees. Page 4 of 5 State Water Board Flexibility SGMA provides the State Water Board with three means of flexibility in the intervention process. The provisions described below will affect the applicability of the state intervention fees. 1. Areas in compliance with the sustainability goal will be excluded from probation. 17 2. Extractors may be excluded from probationary reporting and related fees.18 3. (g) "Domestic purposes" has the same meaning as "domestic uses" as defined in section 660 of Division 3 of Title 23 of the California Code of Regulations for the purposes of identifying if an extractor is a de minimis extractor. (h) "Meter" means a device that measures groundwater extractions and that meets the requirements of section 1042. (i) "Person" has the same meaning as defined in section 10735 of the Water Code. Q) "Qualified individual" means one of the following: (1) A California- registered Professional Engineer or Professional Geologist. (2) A California - licensed contractor authorized by the State License Board for C- 57 well drilling or C -61 Limited Specialty /D -21 Machinery and Pumps. (3) An individual under the supervision of a California- registered Professional Engineer or Professional Geologist and employed to install, operate, and maintain water measurement and reporting devices or methods. (4) The manufacturer of the device or a representative of the manufacturer. (k) "Report" means a report of groundwater extraction as required by section 5202 of the Water Code, prepared on a form provided by the board and including the information required by section 5203 of the Water Code. (1) "Water year" has the same meaning as defined in section 10721 of the Water Code. Authority: Sections 348, 1529.5, 1530, 5107, 5208, and 10736(d)(3), Water Code. Reports required pursuant to Part 5.2 of Division 2 of the Water Code shall be submitted to the board electronically on forms available at the board's website. Authority: Section 348, Water Code. References: Section 5200, Water Code. Article 3. Filing Fees. Section 1040. Annual Filing Fee Schedule. Except as provided in section 1041, any person required to file a report shall submit to the board an annual filing fee in accordance with the following schedule: (a) For groundwater extractions described in section 5202, subdivision (a)(2) of the Water Code, but not section 5202, subdivision (a)(1) of the Water Code: (1) The annual fee is $300 per well plus: (A) $10 per acre -foot of groundwater extracted during the preceding water year if the person uses a meter to measure groundwater extractions and certifies on a form provided by the Board that the measurements were made using a meter. (B) $25 per acre -foot of groundwater extracted during the preceding water year if the person does not use a meter to measure groundwater extractions or fails to certify on a form provided by the Board that the measurements were made using a meter. (2) For groundwater extractions in an area that became part of an agency's management area during the preceding water year and was within an agency's management area as of September 30, volumetric charges required by subdivision (a)(1) will be based on the volume of groundwater extracted during the portion of the preceding water year when the area was not within the management area of an agency. (3) For groundwater extractions in an area that is not within the management area of an agency as of September 30, the volumetric charges required by subdivision (a)(1) will be based on the volume of groundwater the person extracted during the entire water year. (b) For groundwater extractions described in section 5202, subdivision (a)(1) of the Water Code: (1) The annual fee is $300 per well plus a volumetric charge of $40 per acre -foot of groundwater extracted during the preceding water year, except that for de minimis extractors required to file a report, the annual fee is $100 per well. (2) For groundwater extractions in a basin where the board has determined pursuant to section 10735.4, subdivision (c) or section 10735.6, subdivision (b) of the Water Code that the deficiencies resulting in the probationary designation have not been remedied, an additional volumetric charge of $15 per acre -foot of groundwater extracted during the preceding water year shall apply to the fee required by subdivision (b)(1). (c) For persons required to file a report who fail to file the report by December 15, the annual fee shall include an additional charge of 25 percent of the annual fee described in subdivisions (a) and (b), plus 25 percent of the annual fee described in subdivisions (a) and (b) for each 30 -day period after December 15 in which the report has not been filed. In no case shall the additional charge exceed three times the annual fee described in subdivisions (a) and (b). Authority: Sections 1529.5, 1530, 5107, 5208, and 10736(d)(3), Water Code. An exception to section 1040 applies for annual fees for the water year ending September 30, 2017, for which any person required to file a report shall submit to the board an annual filing fee in accordance with the following schedule: (a) For groundwater extractions in an area that is within the management area of an agency by September 30, 2017, the annual fee is waived. (b) For groundwater extractions not subject to subdivision (a)(1), the annual fee is $300 per well with no additional volumetric charge. (c) For persons required to file a report who fail to file a report by December 15, 2017, the annual fee shall include an additional charge of $100, plus $100 for each 30 -day period after December 15, 2017 in which the report has not been filed. In no case shall the additional charge exceed $900. Authority: Sections 1529.5, 1530, 5107, 5208, and 10736(d)(3), Water Code. Section 1042 Meters. (a) A measurement device must be all of the following to be a "meter" used to measure groundwater extractions from the well for purposes of section 1040, subdivision (a)(1)(A): (1) Equipped with a totalizer that records the total volume of groundwater extracted from the well. (2) Permanently attached to the well discharge pipe between the point of extraction and the point of delivery for beneficial use. (3) Calibrated to an accuracy of within ± five (5) percent by volume. The calibration must be conducted by a qualified individual upon installation and at least once every five years thereafter, or more frequently if necessary to ensure accuracy is maintained. (4) Installed, maintained, operated, inspected, and monitored to ensure the accuracy requirement of subdivision (3). (5) Installed in a manner such that it is readily accessible for reading, inspection, testing, repair and replacement. (6) Reasonably accessible and available for inspection by an authorized representative of the board upon request. (b) The board may conduct a field inspection or request additional information from the extractor to determine if a meter is properly installed and meets the requirements of this section. Failure to provide reasonable access for an inspection or to provide records of calibration by a qualified individual upon request by the board is a sufficient basis for the board to determine that a meter has not been used to measure groundwater extractions for purposes of section 1040, subdivision (a)(1)(A). If more than one person is liable for a fee under this chapter, then that liability shall be joint and several. Authority: Sections 1529.5, 1530, 5107, 5208, and 10736(d)(3), Water Code. Section 1044. Administration of Fees. Annual filing fees shall be based on the regulations in effect at the time of filing. Annual filing fees for the report for the prior water year are due and payable on February 15, or thirty days after the Board issues an invoice, whichever is later. The board's determination that a person is required to pay a fee, or determination regarding the amount of the fee, shall be subject to reconsideration under chapter 4 (commencing with Section 1120) of part 1 of division 2 of the Water Code. Any petition for reconsideration shall be submitted by the fee payer in accordance with that chapter and article 12 (commencing with section 768) of chapter 2 of division 3 of this title. The petition shall specify why the petitioner believes that no fee is due or how the petitioner believes that the amount of the fee has been miscalculated. Failure to meet any of the requirements of this Chapter is a violation subject to civil liability of up to $500 per day pursuant to Water Code section 1846.
