HomeMy WebLinkAbout11/05/14 CC AGENDA HIGHLIGHTSREGULAR MEETING - 3:30 p.m. NOTE: A separate meeting will be called to order at 3:30 p.m., followed by Public Statements that will encourage comments pertaining only to Closed Session matters. The Council will then recess into Closed Session. Upon conclusion of the Closed Session, any action will be announced and the meeting will be adjourned. At 5:15 p.m., the Regular Meeting will then be called to order to address the remainder of the agenda items. CLOSED SESSIONS There will be a conference with legal counsel pertaining to three matters of potential litigation. REGULAR MEETING - 5:15 p.m. This meeting will include the 60th annual "Teen City Government Day" student introductions during the Roll Call. APPOINTMENTS There will be one appointment to Kern Mosquito and Vector Control District. CONSENT CALENDAR Ordinances Item 8c. Update and /or Minor Corrections to Various Ordinances. Periodically, City departments request minor changes in existing ordinances to reflect current practice, correct typographical errors, or to make a section read better. This item requests the adoption of a series of minor revisions, as described in the Administrative Report from the City Attorney's Office. Pursuant to City Council's vote at the first reading of the ordinance on October 22, 2014, the time for submission of permits was revised from the proposed 45 days to 30 days. Upon Council approval, the ordinances will become effective after 30 days. Resolutions Item 8h. Intention to Establish a Police and Fire Services Community Facilities District. The City previously entered into a development agreement with PB Ventures, LLC, regarding the future development of 1,868 acres of land in west Bakersfield (formerly Old River Ranch). A component of the agreement includes the formation of a Community Facilities District (CFD). Due to new legislation and litigation regarding tax exempt financing assistance to developers, the City and developer proposes that the CFD be formed for "services only." The primary concern is that financing public improvements with these funds potentially triggers prevailing wage requirements. Services included in the proposed District are Fire and Police protection in the amount of $287 per residential unit for the first 10 years and $174 per residential unit for the remaining term. There are currently no residential units in the district boundary. This resolution is required to commence the process to establish a CFD. 02114116 CC A EN A PACKET FAG 897 CONSENT CALEDNAR PUBLIC HEARINGS Item 9b. Martin Luther King Community Center Gym Floor Replacement. Staff is requesting Council approval to amend the City's FY 2014 -15 Housing and Urban Development (HUD) Action Plan to increase funding for the replacement of the gym floor at the Dr. Martin Luther King Jr. Community Center. Over the previous three fiscal years, numerous capital improvements have been made to the facility, including renovating the kitchen and public restrooms, acquiring new weight room equipment, repainting walls and cabinets, resurfacing the tennis courts, and installing or refurbishing the floors throughout most of the community center. The most significant remaining capital improvement need within the community center is the replacement of the 40 -year old gymnasium hardwood floors. Upon a recent review by HUD, staff was notified that a previously completed landscape project was determined to be ineligible for HUD funding. As a result, the City is required to return and reallocate the HUD funds by December 8, 2014. This proposed action remedies the finding and addresses a need at the facility, which currently serves an estimated 40,000 people annually. NEW BUSINESS Item 13a. 2015 Calendar Year City Council Meeting Schedule. Council is requested to approve the resolution setting the dates for the City Council meetings, Budget Hearings, and Department Budget Presentation for 2015. Holidays, spring break, election deadlines, and the League of California Cities Conferences were considered in the formation of the proposed schedule.
