HomeMy WebLinkAbout11/19/14 CC AGENDA HIGHLIGHTS, A � GAy,,,w AGENDA HIGHLIGHTS { November 19, 2014 COUNCIL MEETING REGULAR MEETING - 3:30 p.m. NOTE: A separate meeting will be called to order at 3:30 p.m., followed by Public Statements that will encourage comments pertaining only to Closed Session matters. The Council will then recess into Closed Session. Upon conclusion of the Closed Session, any action will be announced and the meeting will be adjourned. At 5:15 p.m., the Regular Meeting will then be called to order to address the remainder of the agenda items. CLOSED SESSIONS There will be a conference with legal counsel pertaining to two matters of potential litigation and one item pertaining to the City Attorney's Performance Evaluation. REGULAR MEETING - 5:15 p.m. CONSENT CALENDAR Resolutions Item 8h. Resolution to Express Intent to Comply with Prevailing Wage Law. The City Council previously adopted Resolution No. 122 -12, which exempts the City from paying prevailing wage for most public works projects. Last year the California Legislature passed SB 7, which prohibits charter cities from receiving or using State funding for local construction projects if the charter city has a resolution or ordinance exempting projects from the State prevailing wage requirements. As a result of the legislation and to be in compliance with SB 7, staff is recommending the Council repeal Resolution No. 122 -12 and approve a resolution expressing intent to comply with prevailing wage law. If SB 7 is stayed or found either invalid or inapplicable to charter cities by a court or is otherwise repealed, the proposed resolution will automatically sunset and will be of no further effect. Item 8e. Salaries and Benefits for Employees of the Bakersfield Police Officers Association. The City and BPOA have concluded negotiations with both sides tentatively agreeing to a new Memorandum of Understanding (MOU). The Resolution recommended for approval is consistent with Council guidelines. The Resolution includes such negotiated items as a new term, salary increases (2% increase for all BPOA members and an additional 1% equity increase for Detectives), bilingual pay adjustments, and results in a reduction to the overall "catch -up" provisions approved in the previous MOU, from 4% to 2% for this group. Agreements Item 8k. Agreement with Parsons for Advanced Preliminary Engineering Services for the Centennial Corridor Proiect. The Centennial Corridor is a Thomas Roads Improvement Program project, which will ultimately connect the existing State Route 58 freeway east of State Route 99 with the new Westside Parkway freeway west of State Route 99. Staff is recommending approval of this agreement with Parsons Transportation Group for advanced 02114116 CC A EN A PACKET FAG 899 preliminary engineering services. These services will support the completion of the environmental document and will allow the final design of the project to begin upon approval of the environmental document, which is expected in summer 2015. In addition, approval of this agreement would further define the limits needed for the project and promote the continuity of the property acquisition phase. Funding for the agreement would primarily come from Federal funding (88%), with the balance provided by local funds (12 %). Construction bidding for the project is anticipated to occur in late 2016. Miscellaneous Item 8aj. Cul -de -sac at Beech Street. To date, cul -de -sacs have been fully constructed on Pine, Myrtle, Spruce, Cedar, and A Streets, south of 24th Street. Most recently, the property owners on Beech Street have met the requirements set forth by City Council resolution to construct a cul -de -sac. All of the property owners between 22nd and 24th Streets on Beech Street have agreed to the construction of the cul -de -sac and the end property owners have agreed to donate the needed property for the project. This project is separate from the 24th Street improvements identified in the Thomas Roads Improvement Program. Staff is recommending the City Council approve the construction of the cul -de -sac on Beech Street. Upon approval, construction will be completed by City street crews. Funding was previously budgeted for the project as part of the FY 2013 -14 Capital Improvement Program. CONSENT CALEDNAR PUBLIC HEARINGS Item 9a. First Public Hearing for HUD Consolidated Plan and Associated Documents. Every five years, the City is required by HUD to develop a Consolidated Plan, Analysis of Impediments to Fair Housing Choice, and Citizen Participation Plan. These documents are required to receive the City's annual allocation of HUD funds. These documents are intended to ensure that residents have an opportunity to participate in the planning, implementation, and assessment of the HUD programs and projects. The City is required to hold two public hearings to gather input on the planning process. This public hearing is intended to provide an update on the community needs gathered thus far and to obtain public comment regarding the respective needs. A second public hearing will be scheduled prior to the submission of the Consolidated Plan and associated documents. Staff anticipates that the draft Consolidate Plan will be presented for Council consideration in April 2015.
