Adjournment Staff recommends motion to adjourn meeting POLICE CIVIL SERVICE COMMISSION REGULAR MEETING EXECUTIVE CONFERENCE ROOM POLICE DEPARTMENT Minutes February 7, 2018 8:00 a.m. Call to Order The meeting was called to order by Temporary Chairman, Steve Anderson at 8:00 a.m. II. Roll Call Commissioners Present: Steve Anderson Kelly Lucas Administrative Staff Present: Lyle Martin, Chief of Police Evan Demestihas, Assistant Chief of Police Mike Hale, Captain Jason Matson, Captain Brent Stratton, Lieutenant Joe Dougherty, Lieutenant Matthew Hilliard, Sergeant Richard Iger, Deputy City Attorney Lisa McGranahan, Human Resources Manager Anthony Gonzales, Human Resources Supervisor Maria Mojica, Human Resources Analyst Caryn Claiborne, Human Resources Analyst Shayla Woods -Collins, Human Resources Analyst Paula Kitchen, Secretary Public: German Lopez, Criminal Justice Student, Bakersfield College Adriana Chavez, Political Science Student, CSUB Tia Johnson, Social Service Student, Arizona State University III. Approval of Minutes Mr. Lucas motioned to approve the minutes. Before the motion was seconded, Anthony Gonzales noted an error in Item I of the minutes from January 3, 2017. Mr. Anderson amended the motion on Agenda Item IV to revise the minutes from January 3, 2017, with "The meeting was called to order by Temporary Chairman, Steve Anderson." and he seconded the motion for approval. IV. New Business A. Election of Officers Steve Anderson — Chairman Mike Payne — Secretary Kelly Lucas — Board Member Mr. Lucas made a motion to approve the suggested officers for 2018; the motion was seconded by Mr. Anderson. B. Review of Special Orders: Mr. Anderson requested a letter of congratulations be drafted from the Commissioners to Officer Jess Beagley for his retirement. C. Certification of Clerk Typist - Police Eligibility List, Examination #01022 (C. Claiborne, H.R.) Caryn Claiborne submitted Clerk Typist - Police Eligibility List, Examination #01022, to the Commission for review and approval for certification. She advised there are 14 candidates on the list with a tie for the number nine position. She thanked the Police Department and staff in Training for their time, professionalism and expertise in this recruitment. She said there are currently three openings for the position. Mr. Lucas made a motion to approve Clerk Typist - Police Eligibility List, Examination #01022; the motion was seconded by Mr. Anderson and carried unanimously. D. Nepotism Waiver Request for Clerk Typist - Police Candidates (C. Claiborne, H.R.) Caryn Claiborne submitted four Nepotism Waiver Requests to the Commission for review and approval for Clerk Typist — Police Candidates Teresa Matson, Kimberly Henderson, Kelsey Munoz and Christina Howell. She advised the Nepotism Waiver Requests were reviewed and approved by Assistant Chief Greg Terry. Mr. Lucas made a motion for approval of the Nepotism Waiver requests for Clerk Typist — Police Candidates Teresa Matson, Kimberly Henderson, Kelsey Munoz and Christina Howell, the motion was seconded by Mr. Anderson and carried unanimously. E. Certification of Crime Analyst Eligibility List, Examination #01045 (S. Woods -Collins, H.R.) Shayla Woods -Collins submitted Crime Analyst Eligibility List, Examination #01045, to the Commission for review and approval for certification. She advised there are seven candidates on the list with a tie for candidate number four. She thanked the Police Department for their assistance throughout the recruitment. Mr. Lucas made a motion to approve Crime Analyst Eligibility List, Examination #01045; the motion was seconded by Mr. Anderson and carried unanimously. F. Nepotism Waiver Request for Crime Analyst Candidate(s) (S. Woods -Collins, H.R.) Shayla Woods -Collins submitted one Nepotism Waiver Request to the Commission for review and approval for Crime Analyst Candidate Stephanie Teague. She advised the Nepotism Waiver Request was reviewed and approved by Assistant Chief Greg Terry. Mr. Lucas made a motion for approval of the Nepotism Waiver request for Crime Analyst Candidate Stephanie Teague; the motion was seconded by Mr. Anderson and carried unanimously. G. Reinstatement Request for Police Officer Jacob Dinsmore (J. Grimes, P.D) On behalf of Jeremy Grimes, Bobby Woolard advised the commissioners he received an official request from Jacob Dinsmore to be reinstated as a Police Officer with the Bakersfield Police Department. Jacob Dinsmore is currently employed as a police officer for the City of San Luis Obispo. His tenure with Bakersfield Police Department began July 2006 and his official resignation was April 10, 2013. He lateralled over to San Luis Obispo Police Department and is in good standing there. While with BPD, he worked in Operations as a patrol officer and as a Special Enforcement Unit officer; he was also a member of SWAT. If his request to be reinstated is granted, he would like to begin employment with the City of Bakersfield the first week of April 2018. Bobby Woolard recommends reinstatement of Jacob Dinsmore. Mr. Lucas made a motion for the reinstatement of Jacob Dinsmore after he confirmed the City and BPD's policy regarding years of service. Bobby Woolard advised his time at both agencies would count toward total years of experience and toward his PERS retirement; his benefits and accruals will start over and he will be reassigned his original badge number. The motion for reinstatement of Jacob Dinsmore was seconded by Mr. Anderson and carried unanimously. H. Request to Extend Police Captain Eligibility List, Examination #00953 (G. Terry, P.D.) On behalf of Greg Terry, Evan Demestihas advised Police Captain Eligibility List, Examination #00953 has five candidates, four of which are acting in a capacity or actually promoted to Captain; Joe Mullins and Jeremy Grimes were promoted to Captain; Jason Matson and Mike Hale are currently appointed to Acting Captain. The Acting Captain positions are due to having two captains on the books that have been and will continue to be off for an extended period of time due to injuries while on duty. He said there are no other eligible candidates. He said retesting would create disruption since there are currently two acting in the position and fiscally, it would save money not to have to retest. It is requested the Police Captain Eligibility List be extended with the hope there will be resolution to the situation by the end of this year. Evan Demestihas also advised the commission the two Acting Captains will remain acting until there is an actual vacancy. If the two Captains who are injured and off duty now elect to retire, it will create vacancies allowing for promotion of the current Acting Captains only if the current list is still active. If the current list is not extended, there would have to be a new testing process for Captain and the current Acting Captains would have to retest. Anthony Gonzales advised the commissioners in accordance to Civil Service Rules and Regulations, the eligibility list can only be extended prior to the expiration date. The eligibility list for Police Captain expires on February 8, 2018. It is requested the list be extended for 6 months, until August 8, 2018. Mr. Anderson asked if there is a limit on how many times a list can be extended; Anthony Gonzales advised there is nothing in the Civil Service Rules and Regulations limiting how many times the list can be extended. Mr. Lucas made a motion to approve the request to extend Police Captain Eligibility List, Examination #00953 from February 8, 2018 to August 8, 2018; the motion was seconded by Mr. Anderson and carried unanimously. Approval to Extend Acting Captain position for Jason Matson (G. Terry. P.D.) On behalf of Greg Terry, Evan Demestihas advised the Commission the Chief of Police has the power to appoint someone to an acting position for up to 6 months but Civil Service Commission must approve an extension beyond 6 months. Effective February 8, 2018, Jason Matson will be past 6 months. It is requested that his acting position be extended an additional 6 months. It is requested the appointment date for Jason Matson be changed to August 7, 2017, in the memo included in the agenda packet. Mr. Lucas made a motion for approval to extend the Acting Captain position for Jason Matson until August 8, 2018; the motion was seconded by Mr. Anderson and carried unanimously. V. Commissioner Comments Mr. Anderson reminded everyone that evening during the City Council meeting, Ken Vetter will be honored for his years of service to the City as a councilman, and 40 years of service as Police Commissioner to the Bakersfield Police Department. VI. Adjournment There being no further business, the meeting was adjourned at 8:25 a.m.
