The Council will recess into closed session. Upon conclusion of the closed session, any closed session action will be announced prior to adjournment of the meeting. At 5:15 p.m., the regular meeting will be called to order to address the remainder of the agenda items. SPECIAL MEETING – 4 p.m. CLOSED SESSION There will be a conference with legal counsel regarding one item of existing litigation. REGULAR MEETING – 5:15 p.m. APPOINTMENTS Bakersfield Public Safety/Vital City Services Measure Citizens Oversight Committee. Item 7.a. The Bakersfield Public Safety and Vital Services Measure (N) calls for the creation of a Citizen Oversight Committee (Committee). The Measure requires that the City Council establish the Committee of no more than nine residents of the City to act in an advisory capacity to review the expenditure of revenues generated by the tax imposed by the Measure. On January 9, 2019, the City Council approved the formation of the Committee. On January 23, 2019, the Council discussed and approved the voting processed to be used to appoint members to the Committee. At this meeting, the Council will consider the appointment of nine individuals to the Committee, selecting from a pool of 82 eligible applicants. CONSENT CALENDAR Resolutions Affordable Housing Project Contribution.This item proposes the commitment of $1.5 Item 8.h. million of the City’s federal HOME entitlement funds to construct an 81-unit affordable housing complex in northeast Bakersfield. The project is being led by the Housing Authority of Kern County and carries a total estimated cost of $18.9 million. The $1.5 million contribution will assist the Housing Authority in completing other component of the funding plan for this project. The project will provide affordable housing for low-income individuals and veterans in Bakersfield. The City has previously identified a high priority need for this type of housing being proposed by the developer. Staff is requesting an approval of a resolution committing the HOME funds to the project, conditional on receiving the necessary funding from other sources to complete the project. Agreements Small Cell Wireless Agreement. The City has continued to work with Item 8.o. telecommunications companies to locate small cell facilities within the city’s right-of-way, including installation on City-owned street lights. Small cell facilities help supplement the carrier’s larger wireless infrastructure and help meet the customer demand for data usage. The legislative landscape has changed drastically over the past two years, with the federal government recently adopting regulations that limit the City’s ability to manage the deployment of these types of installations. However, the City does retain some control over the placement and appearance of the small cells. To this point, the Council adopted an emergency ordinance and resolution on December 12, 2018 establishing standards for small cell installations in the City’s rights-of-way. Since that time, the City has met with several telecommunications carriers to outline the framework to begin installing these facilities. AT&T and staff have come to an agreement to authorize the installation of these facilities within the City. Under the current regulatory environment, the proposed agreement calls for AT&T to pay the City $750 per installation, per year for the first two years. After the two years, AT&T will either pay the amount allowed under the federal regulations or continue to pay $750 annually, depending the outcome of current litigation regarding the federal regulations. All installations completed under this agreement are required to meet the City’s standards for design and location as outlined in the emergency ordinance and resolution that the Council previously approved. Therefore, staff is requesting the Council approve the agreement with AT&T to allow the installation of AT&T’s cellular equipment on City’s streetlights, to the extent possible under law, and allow AT&T to expand its coverage within the City. Bids Curb, Gutter and Sidewalk Projects. As part of the City’s Housing and Urban Items 8y-8ac. Development Action Plan, several projects were programmed in the current year to fund the installation of curb, gutter and sidewalks within low and moderate income areas of the City utilizing Community Development Block Grant Funds. The following project areas were identified and approved as part of the FY 2018-19 budget: Wilson area, Old Town Kern/Beale area, Oleander area and East California area. Staff has received acceptable low bids for each of these areas and requesting the Council award the bids to install the improvements.
