Item 3a. Urban hens. (AH Wards) In response to a referral from Councilmember Smith, staff will
provide information on the City's policies regarding ownership of chickens in urban residential zones.
Item 3b. Quarterly update from the Bakersfield -Kern Regional Homeless Collaborative (BKRHC) on
Homeless System Performance Metrics. (AH Wards) In response to a referral from Councilmember
Gonzales, the Bakersfield -Kern Regional Homeless Collaborative will provide a quarterly update on
homeless system performance metrics.
CONSENT CALENDAR — ORDINANCES
Item 8c. Reassignment of the Board of Zoning Adjustment's (BZA) responsibilities to the Planning
Commission and Planning Director. (AH Wards) In response to a referral from Councilmember
Freeman, this item proposes to amend the Bakersfield Municipal Code related to dissolving the BZA
and assigning its responsibilities to the Planning Commission and the Planning Director. the City's
BZA has authority of three entitlement processes: (1) Zoning Modification; (2) Conditional Use Permit;
and (3) a wireless facility permit specific to the public right-of-way.
Item 8e. Amendments to City's policies regarding abandoned or junk vehicles. (AH Wards) In
response to a referral from Councilmember Parlier, this ordinance clarifies the definition of an
abandoned or junk vehicle and defines the type of cover that may be used when vehicles are stored
in a way that is visible to the general public.
Item 8i. Amendments to City's Landscaping Ordinance. (AH Wards) In response to a referral from
Councilmember Freeman, this item proposes to amend the City's landscape ordinance. The proposed
amendments would require that approved commercial landscape plans be revised if the
landscape/irrigation is substantially modified.
Item 8q. Emergency Sewer Repair at Chester Avenue and Brundage Lane. (Wards 1&2) 2) On Saturday
July 18, 2020, a portion of the 39 -inch sewer line at the intersection of Chester Avenue and Brundage
Lane collapsed causing a sinkhole. After assessing the condition of the sewer line, the Public Works
Director determined the repairs could not be made with city staff alone and declared the condition
to be an emergency requiring work, supplies, equipment, and materials urgently needed for the
preservation of life, health, and property. To remedy this emergency, the Public Works Director
authorized Griffith Company to repair 350 -feet of the 39 -inch sewer line and replace seven (7)
manholes and Rain for Rent to set up a bypass for the sewer in order to get it back to operation as
soon as possible. An appropriation of $2,300,000 from the Sewer Enterprise Fund is needed to fully
fund this repair including costs to contactor and material costs.
CONSENT CALENDAR - AGREEMENTS
Item 8ac. Contribution Agreements with the Bakersfield Symphony Orchestra and the Bakersfield
Art Foundation. (AH Wards) On June 24, 2020, the City Council approved the Fiscal Year 2020-21
budget, which includes a contribution to the Bakersfield Art Foundation (Bakersfield Museum of Art)
in the amount of $50,000 and to the Bakersfield Symphony Orchestra in the amount of $50,000.
Item 8ad. Master Tax Sharing Agreement with the County of Kern. (AH Wards) California Revenue
and Taxation Code requires cities and counties to agree on how specific revenues from taxes will be
split or shared upon annexation of land into the City's jurisdiction. State law further allows a county
and a city to develop and adopt a master tax transfer agreement to comply with this requirement.
The proposed extension simply extends the term of the agreement to November 2025.
CONSENT CALENDAR - PUBLIC SAFETY/VITAL SERVICES MEASURE
Item 8ba. Annual Salary and Benefits Limit for Public Safety and Vital Services Measure
Appropriations. (AH Wards) During the Fiscal Year 2020-21 budget process, multiple councilmembers
remarked that the City should consider placing a cap on the amount of Public Safety and Vital Services
revenue that can be allocated to salary and benefit costs annually. Additional comments on the same
topic were received by members of the Citizens Oversight Committee. Based on this feedback, staff
is requesting to refer this item to the Budget and Finance Committee for discussion.
HEARINGS
Item 10a. Bakersfield General Plan. (AH Wards) The Metropolitan Bakersfield General Plan (MBGP)
was adopted in 2002 and contains seven elements as required by State law: (1) Land Use; (2)
Circulation; (3) Housing; (4) Conservation; (5) Open Space; (6) Noise; and (7) Safety. Two additional
elements reflect the specific needs and objectives of the area: (1) Public Services and Facilities; and
(2) Parks. The City will now embark on an update to the MBGP and this item will include a report on
the potential options to approach this update process.
NEW BUSINESS
Item 13a. Coronavirus Aid, Relief, and Economic Security (CARES) Act Funding Overview. (AH
Wards) The federal Coronavirus Aid, Relief, and Economic Security (CARES) Act provides $2 trillion in
economic relief to individuals, businesses and governments in response to the economic and public
health related impacts of COVID-19. The State has allocated $33.5 million to the City as part of its
Fiscal Year 2021 budget. Based on guidance provided by the U.S. Treasury Department and the CA
Department of Finance, the City's initial utilization plan has been developed to include proposed
funding for small businesses, critical support for vulnerable populations and for reimbursement of
City expenditures incurred in response to COYID-19, such as eligible public safety-related costs and
acquisition of supplies and materials necessary to mitigate the spread of COVID-19.
