CLOSED SESSION Items 4a-4b. Conference with Legal Counsel Regarding Existing and Potential Litigation (All Wards) CONSENT CALENDAR-RESOLUTIONS Item 8c. (Ward 1) Resolution approving anapplication to the Kern County Local Agency Formation Commission tnannex uninhabited territory into the City identified as Annexation No. 700 (South Union No. 17), generally located on the northwest corner of the South Union Avenue and Astor Avenue intersection. Item 8d. (Ward 3) Resolution approving anapplication tnthe Kern County Local Agency Formation [nnonoissinn to annex inhabited territory into the City, identified as Annexation No. 703 (Landco No. 4), located at the southeast corner of the Hageman Road and Landco Drive intersection. CONSENT CALENDAR-AGREEMENTS Item 8j. Isabella Dam Remediation Prowec (All Wards)The Kern River Interests with storage rights in Isabella Reservoir (Buena Vista Water Storage District, Kern County Water Agency, Kern Delta Water District, North Kern Water Storage District and the City of Bakersfield) have determined that expert consultants be retained to advise the Kern River Interests on issues regarding Isabella Dano and Reservoir and to ensure the Army Corps nfEngineers completes the necessary repairs expeditiously and with the least impact to the Kern River Interests. The proposed term of this cost sharing Agreement is five(5)years with an annual cost of$60,000.Of this cost,the City of Bakersfield's share is fourteen (14%) percent nr$O,400ayear. Item 81 Council Chambers Audio Visual System(All Wards)This project will replace the current analog equipment with a high definition digital audio/visual solution, greatly improving the broadcast quality of all recorded meetings within the [nund| Chambers and significantly improve the ability for staff tn produce video for live television and internet streams. Technology Services staff issued a request for proposal (RFP) and the review committee selected Pacific West Sound, Inc. due to their comprehensive proposal which included additional system features and functionality within the estimated budget.The cost nfthe project isnot tnexceed $700,000. Item 8w. (Wards 2-7) |nZ01S,the State enacted Senate Bill 88 (SB88) which changed river flow measurement and reporting requirements. The new law requires that real time telemetered water diversion data be shown via a public website with data updated on a weekly basis. City staff are requesting an amendment to the previously approved agreement with W.M. Lyles Amendment to engineer the project. If approved,Amendment No.1 will add $1,752,252 for a new revised not to exceed amount of$2,169,402. City staff also recommends appropriation of $375,000 from the fund balance to the Water Resources Capital Improvement Budget within the River and Ag Water Fund. The rest of the funds are available in the department's current year Capital Improvement budget within the Agricultural Water Enterprise Fund. Item Bab-ae. Construction of U.S. Department of Housing and Urban Development (HUD) Funded Curb and Gutter Improvements (Wards 1, 2 and 7) Bids were solicited for the construction of curb, gutter and sidewalk improvements in five areas of the city receiving HUD funding including the Castro, La France,Oleander and Old Town Kern/Beale areas. Staff finds the bid submitted by J. L. Plank, Inc., dba Cen-Cal Construction in Bakersfield, to be acceptable and recommends approval of contracts for$103,989, $141,354, $113,561 and $92,617. CONSENT CALENDAR-MISCELLANEOUS Item Bah. Bitwise Industries, Inc. CARES Apprenticeship Program (All Wards) This agreement authorizes the City Manager to negotiate and execute an agreement with Bitwise Industries, Inc.for the Bakersfield CARES-Apprenticeship Program in an amount not to exceed $748,800. CONSENT CALENDAR-MISCELLANEOUS Item 10a. APPEAL of Conditional Use Permit for Truck Stop at Taft Highway and South H Street (Ward 7) Lane Engineers, LLC, applied for a conditional use permit ("CUP") to allow a Love's Travel Stop and Country Store ("Loves Travel Stop")at the northeast corner of Taft Highway and South H Street.The CUP was approved by the Board of Zoning Adjustment("BZA") on October 13, 2020 and subsequently appealed on October 23, 2020.
