a. APPOINTMENT OF HEARING OFFICER AND SELECTION OF DATES FOR PERSONNEL
APPEAL HEARING - Deputy City Attorney Viridiana Gallardo-King advised the
commissioners that a Termination Appeal Hearing was held in January 2019. The
hearing was appealled to the Superior Court and the Court recently gave the City
an order to reopen the hearing for the limited purpose of establishing the
credibility of the witnesses that testified. To insure continuity of the hearing process,
Mrs. Gallardo-King contacted Mike Payne, Commissioner at the time and retired
Judge Gary Friedman, Hearing Officer at the time, regarding their availability for
the upcoming hearing. Mrs. Gallardo-King advised the commissioners that Mike
Payne is moving out of state at the end of December and Judge Friedman will be
going back to Superior Court full-time at the end of December. Mrs. Gallardo-King
then explained that she received an email on October 20, 2020 from Russell Perry,
attorney for appellant, stating that none of the dates proposed would work and to
seek additional dates in January and February, 2021, from the Commission. Mrs.
Gallardo-King explained to the Commission that 11 separate days were being
proposed to opposing counsel, which is more than reasonable and takes into
consideration the schedule limitations from all parties. Mrs. Gallardo-King then
requested a motion from the Commission for the following sets of dates:
November 3-5, November 16-20 and December 1-3, 2020, with the appeal hearing
generally starting at 2 p.m. and appointing retired Judge Friedman as the Hearing
Officer. A motion was made by Mr. Lucas; the motion was seconded by Ms.
Thompson and carried unanimously.
