CALL TO ORDER The meeting was called to order by Mr. Anderson at 8:00 a.m. 2. ROLL CALL Commissioners Present: Steven Anderson Kelly Lucas Kathleen Thompson Staff Present: Mike Hale, Acting Assistant Chief Viridiana Gallardo-King, Deputy City Attorney Shayla Woods -Collins, Human Resources Supervisor Paula Kitchen, Civil Service Secretary 3. PUBLIC STATEMENTS None 4. NEW BUSINESS a. APPOINTMENT OF HEARING OFFICER AND SELECTION OF DATES FOR PERSONNEL APPEAL HEARING - Deputy City Attorney Viridiana Gallardo-King advised the commissioners that a Termination Appeal Hearing was held in January 2019. The hearing was appealled to the Superior Court and the Court recently gave the City an order to reopen the hearing for the limited purpose of establishing the credibility of the witnesses that testified. To insure continuity of the hearing process, Mrs. Gallardo-King contacted Mike Payne, Commissioner at the time and retired Judge Gary Friedman, Hearing Officer at the time, regarding their availability for the upcoming hearing. Mrs. Gallardo-King advised the commissioners that Mike Payne is moving out of state at the end of December and Judge Friedman will be going back to Superior Court full-time at the end of December. Mrs. Gallardo-King then explained that she received an email on October 20, 2020 from Russell Perry, attorney for appellant, stating that none of the dates proposed would work and to seek additional dates in January and February, 2021, from the Commission. Mrs. Gallardo-King explained to the Commission that 11 separate days were being proposed to opposing counsel, which is more than reasonable and takes into consideration the schedule limitations from all parties. Mrs. Gallardo-King then requested a motion from the Commission for the following sets of dates: November 3-5, November 16-20 and December 1-3, 2020, with the appeal hearing generally starting at 2 p.m. and appointing retired Judge Friedman as the Hearing Officer. A motion was made by Mr. Lucas; the motion was seconded by Ms. Thompson and carried unanimously. ACTION TAKEN APPROVED 5. PUBLIC STATEMENTS None 4. APPROVAL OF MINUTES A motion was made by Mr. Lucas, seconded by Ms. Thompson and carried unanimously to approve the minutes for the Regular Meeting of September 2, 2020. 5. NEW BUSINESS a. REINSTATEMENT REQUEST FOR POLICE DISPATCHER, KIM HALBWACHS— Shayla Woods -Collins submitted a reinstatement request from Kim Halbwachs, as well as, a memorandum from Human Resources outlining the reinstatement request. Ms. Halbwachs would like to be reinstated as a Police Dispatcher II with the Bakersfield Police Department. Ms. Woods -Collins advised that Police Chief Greg Terry has been contacted regarding this request and he recommends Ms. Halbwachs be placed on the reinstatement list for Police Dispatcher which will remain valid for one year. Mr. Lucas made a motion to approve the reinstatement of Kim Halbwachs; the motion was seconded by Ms. Thompson and carried unanimously. nKERSr C' POLICE "L ACTION TAKEN APPROVED APPROVED b. REINSTATEMENT REQUEST FOR POLICE TRAINEE, JAMES AGUTALAR- Shayla Woods - Collins submitted a reinstatement request from James Aguilar, as well as, a memorandum from Human Resources outlining the reinstatement request. Mr. Aguilar would like to be reinstated as a Police Trainee with the Bakersfield Police Department. Ms. Woods -Collins advised that Police Chief Greg Terry has been contacted regarding this request and he recommends Mr. Aguilar be placed on the reinstatement list for Police Trainee which will remain valid for one year. Mr. Lucas made a motion to approve the reinstatement of Mr. Aguilar; the motion was seconded by Ms. Thompson and carried unanimously. C. NEPOTISM WAIVER REQUEST FOR POLICE OFFICER JACOB HEINSOHN AND POLICE OFFICER MARIYA CORRAL - Shayla Woods -Collins submitted one Nepotism Waiver Request for Police Officer Jacob Heinsohn and Police Officer Mariya Corral to reside in the same household. Ms. Woods -Collins advised that the request has been reviewed by Assistant Chief of Police Mike Hale and he recommends approval. Mr. Lucas made a motion to approve the nepotism waiver request for Officer Jacob Heinsohn and Police Officer Mariya Corral; it was seconded by Ms. Thompson. The motion was carried unanimously. d. CERTIFICATION OF SENIOR POLICE OFFICER ELIGIBILITY LIST, EXAMINATION #01355 Shayla Woods -Collins submitted Senior Police Officer Eligibility List #01355 to the Commission for review and certification of 10 candidates. Ms. Woods -Collins advised the commissioners that the overall score required to be placed on the eligible list was 85.35% and the highest overall score was 91.45%. Ms. Thompson made a motion to certify Senior Police Officer Eligibility List #01355; the motion was seconded by Mr. Lucas and carried unanimously. e. NEPOTISTM WAIVER REQUEST(S) FOR SENIOR POLICE OFFICER CANDIDATE(S) Shayla Woods -Collins advised that as a result of the Senior Police Officer Eligibility List, she is submitting two Nepotism Waiver Requests to the Commission for review and approval for candidates Jessica Amos and Ronnie Jeffries. Ms. Woods -Collins advised the Nepotism Waiver Requests were reviewed by Assistant Chief Mike Hale and he recommends approval. Mr. Lucas made a motion to approve the Nepotism Waiver for Senior Police Officer Candidates Jessica Amos and Ronnie Jeffries; the motion was seconded by Ms. Thompson and carried unanimously. CERTIFICATION OF RECORDS SUPERVISOR ELIGIBILITY LIST, EXAMINATION #01378 Shayla Woods -Collins submitted Records Supervisor Eligibility List #01378 to the Commission for review and certification of 3 candidates. Ms. Thompson made a motion to certify Records Supervisor Eligibility List #01378; the motion was seconded by Mr. Lucas and carried unanimously. 6. COMMISSIONER COMMENTS 7.
