His father, Arthur Carmona Jr., is currently employed as a Solid Waste Equipment Operator in the Solid Waste Division of the Public Works Department. Due to the possibility of Arthur Carmona III being considered for the Heavy Equipment Operator position, the issue of nepotism must be addressed. Arthur Carmona III is currently employed as a Service Maintenance Worker in the Wastewater Division of the Public Works Department. The following information has been compiled for your review and determination of whether nepotism creates an adverse impact on supervision, safety, security or morale. SUMMARY OF DUTIES A summary of the duties and responsibilities for the position of Heavy Equipment Operator. is as follows: Under general supervision, performs manual and skilled work in the operation of heavy and complex refuse collection and recycling equipment; performs lead work directing crews in the completion of daily schedules and special projects and performs other work as required. A summary of the duties and responsibilities for the position of Solid Waste Equipment Operator is as follows: Under general supervision, performs manual and semi -skilled work in the operation of heavy and complex automotive refuse collection and recycling equipment such as (but not limited to) front loader, side loader, roll -off, grinder, screen plant, and compost turner; and performs other work as required. EMPLOYMENT OVERLAP According to the Public Works -Director, Nick Fidler, a potential for adverse impact would exist should Arthur Carmona III be promoted to a Heavy Equipment Operator position in the Solid Waste Division, of the Public Works Department as both he and his relative would be employed in the same division. Mr. Fidler has also recommended that relatives not work in the same Section of a Division. There are potential morale issues when relatives work together such as perceived favoritism in assignments or work product. Safety issues may also result because of the potential for family conflicts/ issues to impact the work environment. RECOMMENDATION The Public Works Director, Nick Fidler, and the Human Resources Department recommend denial of the nepotism waiver and that Arthur Carmona III not be promoted to a Heavy Equipment Operator position in the Solid Waste Division of the Public Works Department. Due to the possibility of Adolfo being considered for the Heavy Equipment Operator position, the issue of nepotism must be addressed. Adolfo is currently employed as a Solid Waste Equipment Operator in the Solid Waste Division of the Public Works Department. Under general supervision, performs skilled journey -level work in the construction, remodeling, maintenance and repair of City facilities, properties and equipment; prepares basic records and reports; purchases materials and supplies; may lead others in a small crew setting; and performs other work as required. A summary of the responsibilities for Streets Operations Lead is as follows: Under general supervision, leads multiple crews and participates in semi -skilled and skilled work involving the operation of heavy and complex automotive and construction equipment such as backhoes, bulldozers, graders, large road rollers, cold planers, paving machines and heavy skip loaders; coordinates vendor projects, directs all aspects of the operation in the absence of a supervisor and performs other work as required. EMPLOYMENT OVERLAP According to the Public Works Director, Nick Fidler, if Adolfo Celedon III is promoted to a Heavy Equipment Operator position in the Solid Waste Division of the Public Works Department, performance appraisals would not be reviewed or conducted by any employee for the other; no employee would be directly supervised by the other; and they would not report to each other within the chain of command as they would be assigned to different divisions. RECOMMENDATION The Public Works Director, Nick Fidler, and the Human Resources Department recommend approval of the nepotism. A summary of the duties and responsibilities for the position of Supervisor II is as follows: This is a multi - divisional classification for use in the Parks Division of Recreation & Parks, Public Works, Water Resources or other related departments. Under general direction, performs supervision and technical work in the operation, maintenance or repair of municipal facilities and equipment; participates in staff selection, training and development; organizes, assigns and reviews the work of skilled, semi -skilled and unskilled employees; oversees assignment of equipment; evaluates employee performance; recommends progressive discipline; prepares technical reports, correspondence and other written materials; maintains records; identifies and resolves problems; performs administrative analyses in support of department or division activities; responds to emergencies and public inquires; participates in budget preparation; participates in the development and implementation of goals, objectives, policies, procedures and work standards; performs special projects or other work as required. A summary of the duties and responsibilities for the position of Maintenance Crattworker I is as follows: Under general supervision, performs skilled journey -level work in the construction, remodeling, maintenance and repair of City facilities, properties and equipment; prepares basic records and reports; purchases materials and supplies; may lead others in a small crew setting; and performs other work as required. EMPLOYMENT OVERLAP According to the Finance Director, Randy McKeegan, if Macy lacopetti is promoted to a Financial Investigator I in the Treasury Division of the Finance Department, performance appraisals would not be reviewed or conducted by any of the employees for the others, none of the employees would be directly supervised by the others, and they would not report to each other within the chain of command as they would be assigned to different departments. RECOMMENDATION The Finance Director, Randy McKeegan, and the Human Resources Department recommend approval of the nepotism. BAKERSFIELD THE SOUND OFbeh,?Am f Ve* MEMORANDUM TO: Miscellaneous Civil Service Board FROM: Christi Tenter, Human Resources Director SUBJECT: Temporary Waiver and Extension of Minimum Qualifications DATE: January 19, 2021 Following the issuance of stay-at-home orders in March of 2020 the State of California Department of Motor Vehicles ("DMV") ceased in -office appointments in response to the COVID-19 pandemic. At this time, the DMV has provided the following guidance for current license renewals: "All commercial driver's licenses, endorsements, and certificates expiring March 2020 -February 2021 have an extension valid through February 28, 2021. The extension is the some for commercial license holders both under and over the age of 70." - htfps://www.dmv.ca.gov/iportal/­covid- I 9-relief-information/driver-license- extensions/ Many established blue-collar classifications require the successful obtainment of a commercial driver's license. This is a minimum qualification of the position included in the approved job specification. Obtainment of the license is usually required within the first 6 -months, or 1 -year, following appointment. This requirement has historically been strictly adhered to. At the April 21, 2020 meeting of the Civil Service Board for Miscellaneous Departments a motion was made, and approved, to provide a temporary waiver for the license requirement. Since that time, the DMV has offered limited in person services and many by appointment only due to the COVID - 19 Pandemic. One could estimate that the current extension may exceed the published date of February 28, 2021. Staff recommends extending the temporary waiver period to obtain required license(s) for a period three (3) months post license, endorsements and certificate extension and/or reinstatement of DMV commercial license renewal services.
