Councilmembers may continue to elect to attend the meeting telephonically or via zoom and the public may view a live video stream of the meeting at https://bakersfield.novusagenda.com/AgendaPublic/ or through the local government channel (Kern County Television). Downtown Master Sewer Study Presentation (Ward ) The Downtown Master Sewer Study is a key component of the City Council Goals for addressing aging infrastructure within the downtown area. The aim of the study was to develop a list of future Capital Improvement Program (CIP) Projects that will help meet the goals of the Downtown Area Vision Plan. Michael K. Nunley & Associates, Inc. recently completed the Downtown Master Sewer Study and will be making a presentation on their findings. CLOSED SESSION Items 4a. and 4b. Conference with Legal Counsel Regarding Initiation and Existing Litigation (All Wards) RIEGU11 AR Mll:,�IE [NG 5:15 CONSENT CALENDAR - ORDINANCES • Item 8c. Parking space requirements for the Central District (downtown), Old Town Kern and other mixed-use areas (Ward 2) This item is in response to a referral by Councilmember Gonzales for staff to review a fifty percent parking reduction for residential uses within the Central District (downtown) and other mixed-use areas. The ordinance would update the parking requirements for residential projects to address tandem parking, guest parking, and reductions based on density of development to encourage infill and investment city-wide. This version includes amendments made by Councilmember Gonzales at the first reading the January 20, 2021 Council meeting. Item 8f. Urban Hens (All Wards) On October 21, 2020, the City Council approved various ordinances allowing hens in residential zones with certain requirements. Shortly after, Channel Law Group, LLP, representing Citizens for the Preservation of R-1 Zones announced legal action against the City. On January 20, 2021, City and Petitioners participated in a mandated settlement conference. On the same day, during Closed Session, Council was presented with the Petitioners' demands which were the following: o Rescind the various hen ordinances; o Conduct an appropriate environmental review without relying on exemption(s) if and when anew ordinance is pursued/adopted by the City; and o Pay $9,151.36 in attorneys fees If approved by Council, the various hen ordinances will be rescinded and City will enter into a settlement agreement with Petitioners which will include the items above in return for a dismissal of the CEQA lawsuit. CONSENT CALENDAR - AGREEMENTS item 8i -o. Sale of Surplus Land Resulting from Centennial Corridor Project (Ward ) As part of the Thomas Road Improvement Program (TRIP), the City of Bakersfield acquired 422 properties ranging from full parcels to partial portions of properties to construct the Centennial Corridor Project. The Centennial Corridor will connect the existing State Route 58 at South Real Road and State Route 99 to the Westside Parkway north of Truxtun Avenue. The completion of these improvements created small remnant parcels landlocked between the adjacent properties and the Centennial Corridor sound wall. Due to the size and location of this remnant it is not feasible for the City to maintain this parcel without gaining entry through the adjacent owners' property. Additionally, since the property is landlocked the only parcel to benefit from this parcel is the contiguous land owner. The City now desires to enter into an agreement with contiguous property owners for the sale of the "Exempt Surplus" real properties for $1.00. Item 8t. A/V and Broadcast Updates to Council Chambers (All Wards) The Council Chambers A/V and Broadcast project will replace the current analog equipment with a high definition digital audio/visual solution, greatly improving the broadcast quality of all recorded meetings within the Council Chambers and significantly improve the ability for staff to produce video for live television and internet streams. The proposed contract change order consists of deleting the originally quoted 32 -input/output audio video switcher and replacing it with a 64 -input/output audio video switcher and the associated cables, parts, and installation. This change allows for future expansion or modification of the new broadcast system as the current equipment utilizes all available connections. The contractor has agreed to do the above-mentioned change for the lump sum price of $18,171.93. The original total for the quote on Agreement 202-242 is $648,954.00, with this change order the new total is $667,125.93. CONSENT CALENDAR - MISCELLANEOUS • Item 8v. Transportation Development Act Funds Audit Reports (All Wards) Kern Council of Governments (Kern COG) administers Transportation Development Act (TDA) funds and laws governing the use of TDA funds require annual audits. There were no findings to report for the Bakersfield TDA in fiscal year 2019-20, therefore, there is no agreed upon conditions report for this item. Staff recommends acceptance of the audit. Item 8w. City's Annual Audit Reports (All Wards) The City's Comprehensive Annual Financial Report (CAFR), commonly referred to as the Annual Audit Report, for the fiscal year ended June 30, 2020 has been released and the current year audit opinion issued by the outside auditors was "unqualified," which indicates that the City complied, in all material respects, with accounting principles generally accepted in the United States of America. Staff is recommending these reports be received and referred to the Budget and Finance Committee for review and discussion. The reports will come back to the full Council for acceptance at a future meeting after the Committee review process is completed.
