5. APPROVAL OF MINUTES
A motion was made by Commissioner Anderson and seconded by Commissioner
Thompson to approve the minutes for the Regular Meeting of December 1, 2021.

A. REQUEST TO OPEN EXAM -POLICE LIEUTENANT (P) #01569
After discussion, a motion was made by Commissioner Thompson and seconded
by Commissioner Anderson to approve staff recommendation and approve the
request to open the exam for Police Lieutenant (P) #01569. APPROVED, ALL AYES
B. PROPOSED AMENDMENT TO POLICE CIVIL SERIVCE RULE #9
After discussion, a motion was made by Commissioner Anderson and seconded
by Commissioner Thompson to continue the item and direct staff to continue
review of and propose additional amendments to Police Civil Service Rule #9,
for further Commission consideration at the February 2, 2022 meeting or as soon
thereafter as practical. APPROVED, TWO AYES (Chair Lucas, Commissioner
Anderson), ONE NAY (Commissioner Thompson)
C. NEW JOB SPECIFICATION -ANIMAL CONTROL INTAKE #27210
After discussion, a motion was made by Commissioner Thompson and seconded
by Commissioner Anderson to approve staff recommendation and approve the
New Job Specification for the position of Animal Control Intake Technician
#27210. APPROVED, ALL AYES
D. APPOINTMENT OF HEARING OFFICER AND SELECTION OF DATES FOR PERSONNEL
APPEAL HEARING
After discussion, a motion was made by Commissioner Thompson and seconded
by Commissioner Anderson, to approve the request from the City Attorney's
Office, Ashley Zambrano, to set the dates for potential personnel appeal
hearings to be held on April 25-29, 2022 from 2p.m.-7p.m. each day, and June
20-24, 2022 from 2p.m.-7p.m. each day, and to appoint Hon. Judge Gary
Friedman (Ret.) as Hearing Officer for said appeal hearing. APPROVED, ALL AYES

Subject: Waiver Request for Police Lieutenant Promotional (#01569)
My name is Francisco Esguerra Jr. and I have been a police officer with the Bakersfield
Police Department since 2006. In August, 2019 1 was promoted to a Police Sergeant.
am applying for the Police Lieutenant Promotional, but I do not possess my P.O.S.T.
Supervisory Certificate. As a result, I am requesting a waiver for that particular
qualification. The police department typically provides the Supervisory Course, but due
to the COVID-19 Pandemic, which started soon after 2020, the department has not
been able to provide the course. Additionally, other entities that provide the course
canceled such courses because of the pandemic. Recently, the course has become
available from outside entities, but class space has been limited and there are long
waiting lists for one to attend.
As far as the other minimum qualifications, I have a Master's Degree in Public Police
and Administration; I completed the Police Sergeant Probation period in August, 2020;
and possess a valid California driver's license. There are obvious reasons for the
Supervisory Course, but I have been in a supervisory role for over two years. In that
time, I have learned several of the key concepts provided within the course from mere
experience. Furthermore, I have learned similar concepts from my college education
and from reading publications related to supervision. Since becoming a Sergeant,
have received 2 performance evaluations where I either meet or exceed the
expectations from my current supervisory position.
Based on the information provided, I hope this waiver is granted so that I can continue
with the promotional process. Thank you for your time and consideration.
