KRGSA 19-007 THIS AMENDMENT NO. ONE (1) TO AGREEMENT NO. KRGSA 19-007 is made and entered into on SEP 2 9 2022 , by and between the KERN RIVER GROUNDWATER SUSTAINABLITY AGENCY, (herein "KRGSA"), and HORIZON WATER AND ENVIRONMENT, LLC (herein "CONTRACTOR"). RECITALS WHEREAS, on October 21, 2019, KRGSA and CONTRACTOR entered into Agreement No. KRGSA 19-007, for CONTRACTOR to develop and submit a grant application to the Sustainable Groundwater Management Grant Program and if awarded, administer the grant on behalf of the entire Kern County Subbasin; and WHEREAS, the parties desire to amend Agreement No. KRGSA 19-007 to add an additional $6,800.00 for purposes of the grant work requiring additional administrative support related to the grant coordination, review, and submittal (Exhibit A); and WHEREAS, KRGSA and CONTRACTOR now desire to enter into Amendment No. 1 to Agreement No. KRGSA 19-007 to increase the compensation by an amount not to exceed $6,800.00 for a total compensation of $56,800.00 NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree as follows: 1. Section 2 of Agreement No. KRGSA 19-007 entitled "COMPENSATION" is hereby amended to read as follows: 2. COMPENSATION. Compensation for all work, services or products called for under this Agreement shall consist of a total payment not to exceed FIFTY SIX THOUSAND EIGHT HUNDRED DOLLARS ($56,800.00). The, compensation set forth in this section shall be the total compensation under this Agreement including, but not limited to, all out-of-pocket costs and taxes. KRGSA shall pay only the compensation listed unless otherwise agreed to in writing by the parties. 2. IDocuSigned by: m (, ia" ART CHIANELLO DAVID BEARD STEVE TEGLIA -- Page 2 of 2 Pages -- 1 AGENC`f ORIGINAL EXHIBIT W Horizon WATER an'd ENVIRONMENT Proposal Subject: Horizon Budget Augmentation for KRGSA Prop 68 Grant Administration Support Date: May 3, 2022 To: Art Chianello City of Bakersfield From: Ken Schwarz Horizon Water and Environment (Horizon) Thomasin Grim Horizon Water and Environment Background and Need Horizon Water and Environment (Horizon) has supported the Kern River Groundwater Sustainability Agency (KRGSA) with administering its Proposition 68 Grant with the California Department of Water Resources (DWR). Horizon has supported this grant administration effort since October 2019 and has not requested additional funding for this task. The grant administration process has continued, now 'well over two years since its inception. Recently, DWR has extended the grant's work completion date from June 30, 2022 to February 28, 2023. As a result of this extension, the KRGSA requires additional administrative support related to grant invoice coordination, review, and submittal during this new extended period. The KRGSA will also need support from Horizon to draft the grant completion (close out) report. Scope and Budget Request Horizon is requesting an additional $6,800 to Horizon's existing project budget with the KRGSA for the DWR Proposition 68 Grant Application Development project. More specifically, we are requesting the additional $6,800 to support Task 3 — Grant Administration. The duties and services to be; provided with this additional funding, include approximately 34 hours to: • Providing two additional quarters of support for invoice coordination, review, and submittal to DWR; and • Developing the grant completion report after the final quarter of grant activity. This scope of work and budget request assumes that the KRGSA and DWR will not have requests for additional substantive editing or modification of the grant completion report that Horizon develops. We have enjoyed supporting the KRGSA with the Proposition 68 grant and look forward to completing the remaining quarterly submittals and final grant completion report in the coming months.
