ORDINANCE AMENDING TITLE 15, SECTION I, BUILDINGS
AND CONSTRUCTION, BY ADDING CHAPTER 15.30,
SECTIONS 15.30.010, 15.30.020, 15.30.030 AND 15.30.040
OF THE BAKERSFIELD- MUNICIPAL CODE RELATING TO
CALIFORNIA ENERGY CODE.
WHEREAS, Health and Safety Code Section 17958 provides that the City of
Bakersfield shall adopt Ordinances and regulations imposing the same or
modified or changed requirements as are contained in the regulations adopted
by the State pursuance to Health and Safety Code Section 17922; and
WHEREAS, the State of California is mandated by Health and Safety Code
Section 17922, to impose the same requirements as are contained in the most
recent edition of the California Energy Code (hereinafter referred to as "Code");
and
WHEREAS, Health and Safety Code Section 17958.7 permits the City to make
modifications or changes to the Code, which are reasonably necessary because
of local climatic, geographic or topographic conditions; and
WHEREAS, the Building Division staff determined that the local amendments
to the Code are necessary due to unique conditions that exist in the City of
Bakersfield which include conditions conducive to steep terrain, extremely high
temperatures in the summer and .extremely poor visibility due to Tule fog
conditions in the winter; and
WHEREAS, the City of Bakersfield typically exceeds temperatures of 90° F
during the summer months of June, July, August, and September and during the
winter months typically experiences a high percentage of poor visibility days from
zero visibility to 300 feet; and
WHEREAS, the City of Bakersfield is situated in the southern San Joaquin
Valley which is surrounded by the Sierra Nevada Mountains on the east, the
Coastal Range on the west, and the Tehachapi Mountains on the south and
is subject to periodic seismic activity from earthquake faults associated with
those geologic features; and
WHEREAS, the Building Division has reviewed and recommended that
changes and modifications be made to the Code and have advised that certain
said changes and modifications to the California Energy Code, 2022 Edition, are

needed to clean-up technical inconsistencies and feasibility concerns for Battery
Energy Storage Systems installed in single family residential homes; and therefore
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Title 15, Section I, of the Bakersfield Municipal Code is hereby amended to
add Chapter 15.30, sections 15.30.010, 15.30.020, 15.30.030 and 15.30.040 as
follows:

15.30 California Energy Code.
15.30.010 Adoption.
Except as otherwise provided in this chapter, that certain energy code known
and designated as the California Energy Code, 2022 Edition, is adopted as
modified and amended in this chapter. A copy of such code is on file with the
Ordinance Amending Title 15, Section I, Buildings and Construction, by adding Chapter 15.30 �PKF9s

building department of the city for use and examination by the public, is adopted
as the energy code of the city, and each provision and portion thereof, except
as otherwise in this chapter provided, is referred to and made a part of this
chapter to the same effect as if fully set forth in this chapter.
15.30.020 Deletions.

15.30.030 Modifications.
The Sections of the California Energy Code, 2022 Editions, mentioned in Section
150.30.040, as adopted by reference, are modified and amended as provided
in Section 15.30.040.
15.30.040 Section 150.0(s) amended- Battery Energy Storage Systems (BESS).
Section 150.0, subdivision (s) is amended to read as follows:
Battery Energy Storage System (BESS) ready. All single-family residences that
include one or two dwelling units shall meet the following requirements. All
electrical components shall be installed in accordance with the California
Electrical Code:
1. One of the following shall be provided:
A. Multi -mode BESS system capable of supplying the branch circuits
identified by Section 150.0(s) (2) when in the island mode. System
capacity shall be in accordance with Section 710.15 of the California
Electrical Code.
B. A minimum 120/240-volt, 125-ampere, load -center supplied by a 60-
ampere feeder from the service panelboard. The service
panelboard and load -center shall each include an empty spare 1 "
minimum raceway stubbed to accessible attic space.
2. The following branch circuits shall be supplied by the BESS or load -center of
(1) above:
A. One 20-ampere, kitchen countertop, small appliance, branch circuit.
B. The branch circuit supplying the refrigerator outlet.

C. One lighting branch circuit that provides illumination for the primary
egress.
D. One branch circuit that supplies a receptacle outlet located in a
sleeping room.
3. The service panelboard shall have a minimum busbar rating of 225-
amperes.
SECTION 2.
This Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and
after the date of its passage.
