AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD ADDING CHAPTER 1.10 TO TITLE 1 OF THE
BAKERSFIELD MUNICIPAL CODE TO AUTHORIZE THE
ELECTRONIC AND PAPERLESS FILING OF CAMPAIGN
DISCLOSURE STATEMENTS AND STATEMENTS OF ECONOMIC
INTEREST.
WHEREAS, California Government Code Section 84615 provides that a
legislative body of a local government agency may adopt an ordinance that
requires an elected officer, candidate, committee, or other person required to
file statements, reports, or other documents required by Chapter 4 (commencing
with Section 84100) of the Political Reform Act, as specified, to file those
statements, reports, or other documents online or electronically with a local filing
officer; and
WHEREAS, the City Council desires to approve the use of online or electronic
filing as an option for City filers to facilitate efficient and effective filing of
campaign disclosure statements and statements of economic interest with the
City Clerk; and
WHEREAS, the City Council authorizes the City Clerk to only accept a filing
in a standardized record format in compliance with State law requirements for
the electronic filing of campaign disclosure statements and statements of
economic interest; and
WHEREAS, the online filing system will be available free of charge to filers,
but use of the system will not be mandatory; and
WHEREAS, the City Council therefore finds that the electronic filing system
will operate securely and effectively and would not unduly. burden filers.
NOW, THEREFORE, INCORPORATING ALL OF THE RECITALS ABOVE HEREIN, THE
CITY COUNCIL OF THE CITY OF BAKERSFIELD DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
The City Council expressly adopts this ordinance to approve the use of
online or electronic filing pursuant to Government Code section 84615. The City
Council finds that the City Clerk's online or electronic filing system that complies
with State law requirements will operate securely and effectively and would not
unduly burden filers.

SECTION 2.
Title 1 of the Bakersfield Municipal Code is hereby amended to add Chapter 1.10
to the Bakersfield Municipal Code as follows:

Chapter 1.10 Electronic Filings
1.10.010 Political Reform Act Filings
A. The City Clerk may provide an online filing system to accept electronic
statements, reports, or other documents ("Statements") required to be filed
by any elected officer, candidate, committee, or other person under
Chapter 4 of the Political Reform Act (California Government Code Section
84100 et seq.). The City Clerk's online system shall comply with the
requirements set forth in Section 84615 of the California Government Code,
as may be amended from time to time.
B. Anyone who has electronically filed a statement using the City Clerk's
online system is not required to file a copy of that document in paper
format with the City Clerk.

SECTION 3.
This Ordinance shall be posted in accordance with the Bakersfield
Municipal Code and shall become effective thirty (30) days after the date of its
passage.
