REGULAR MEETING-5:15 PM APPOINTMENTS Items 6a-g. Appointments to Various Boards and Commissions (All Wards) City Council plans to make at least eight appointments including: three appointments to the Miscellaneous Departments Civil Service Board; one appointment to the Fire Department Civil Service Board; one appointment to the Police Civil Service Board; one appointment to the Kern Mosquito and Vector Control District; one appointment to the Board of Directors of the North of the River Recreation & Park District;one appointment to the Planning Commission; and a set of appointments to form the Bakersfield Community Land Trust. ORDINANCES Item 7e. Adoption of Animal Control Regulations (All Wards) In 2019, the Legislative and Litigation Committee (Committee) held public meetings on animal-related ordinances.The Committee considered four proposed ordinances related to public pounds and dog licensing, dog kennels, mandatory spay and neuter of dogs, and breeder permits. On November 8, 2023 the Committee heard a presentation from City staff and animal care service providers on current trends, challenges, and ordinance options. The Committee moved all four ordinances forward for a first reading at the November 29t" Council Meeting. This item adopts all four amendments to Chapters 6.04, 6.06, 6.07, and 6.09. RESOLUTIONS Item 7f. CARE Court(All Wards) The City of Bakersfield recently joined the California League of Cities and Big City Mayor's Coalition, and supported several landmark reforms to the State of California's behavioral health systems and policies. In September 2022, the Governor signed Senate Bill 1338 which established the Community Assistance, Recovery, and Empowerment (CARE) Court Program. In October 2023, the Governor signed Senate Bill 43 which expands the definition of "gravely disabled" for purposes of involuntarily detaining an individual. The deadline for Kern County to complete implementation of CARE Court is December 1, 2024 but the Kern County Board of Supervisors may defer implementation until January 1, 2026. This agenda item urges expedited implementation of CARE Court and SB 43 by the County of Kern. AGREEEMENTS Item 7r. Retention of Duane Morris LLP (All Wards) The City of Bakersfield anticipates potential California Environmental Quality Act (CEQA) litigation for progress on Bakersfield Veterans, LLC. Duane Morris LLP is an experienced and well-qualified specialist in the field of such legal services. The City Attorney's Office desires to retain Duane Morris LLP for potential CEQA litigation in an amount not to exceed $100,000. Item 7t. Bakersfield Senior Center (Ward 2) On May 10, 2023, Council approved the City's FY 2023-24 US Department of Housing and Urban Development Action Plan with $90,000 in Community Development Block Grant (CDBG) funding appropriated for the Bakersfield Senior Center. This agenda item takes prior year project savings and increases this year's allocation by$60,000. Item 7u. FY 2023-24 Emergency Solutions Grant Agreements (All Wards) On May 10, 2023, City Council approved the City of Bakersfield's FY 2023-24 US Department of Housing and Urban Development Action Plan. At the time, Council approved Emergency Solutions Grant (ESG) funding for emergency shelter, street outreach, rapid rehousing, and homeless prevention activities with The Open Door Network, The Mission at Kern County, and Flood Bakersfield Ministries. This agenda item enters into agreements with all three homeless service providers for their previously approved funding amounts. Item 7v. Mt.Vernon Organics Recycling Facility(All Wards)The City's curbside and commercial green bin organic waste programs are collect and take organic waste to the Mount Vernon Organics Recycling Facility (Facility). Commingled organic waste is processed by separating nonorganic materials from the inbound collection program. A sorting crew is used at the Facility to fulfill the manual sorting component of the process. This agenda item enters into a one-year agreement with The Open Door Network for sorting services at the Facility. Item 7x. Sumps, Canals, and Basins (All Wards) The City of Bakersfield manages multiple sumps, canals, and basins dispersed across the city. These City facilities require routine cleaning services and maintenance. This agenda item enters into a one-year agreement with The Open Door Network to provide cleanup services for the City's sumps, canals, and basins. Item lab. Housing Opportunities for Persons with AIDS (All Wards) On October 5, 2022, City Council approved Agreement 2022-202 with the County of Kern. This agreement grants the $1,591,413 the City received from the Department of Housing and Urban Development (HUD) Housing Opportunities for Persons with AIDS (HOPWA) to the Kern County Public Health Department.These funds will increase access to decent, stable, and affordable housing for low-income persons living with HIV and AIDS and their families.This agenda item amends Agreement 2022-202 to add $1,047,875 in Fiscal Year 2023-24 HOPWA. Item lac. Homeless Street Outreach Services (All Wards) On July 19, 2021, the State of California established the Homeless Housing, Assistance, and Prevention Program (HHAP-4). The City of Bakersfield submitted a list of Proposed Use HHAP-4 funded projects and received $4,283,319.84. The City received $300,000 for street outreach services. This agenda item amends agreement 2022-237 with Flood Ministries to increase compensation by $300,000 and provide homeless street outreach services from December 31, 2023 through December 31, 2024. MISCELLANEOUS Item Tat. Housing Homeless Assistance and Prevention 4 Appropriation (All Wards) On July 19, 2021, the State of California established the Homeless Housing, Assistance, and Prevention Program (HHAP-4). The City of Bakersfield was allocated $4,283,319.84 in HHAP-4 funds with 50 percent of those funds disbursed initially, and the remaining 50 percent granted upon demonstration that the City has obligated no less than 75 percent and spent no less than 50 percent on HHAP-4 initial disbursement by May 31, 2025. This item appropriates the initial disbursement of $2,141,659.92 to the General Fund Economic & Community Development Department Operating Budget. PUBLIC SAFETY / VITAL SERVICES MEASURE Item 7ba. 6th Street Apartments to Kern Housing XIV (Ward 2) The City of Bakersfield supports affordable housing development by providing gap financing to projects that need a subsidy to operate at rents affordable to low-income households. On January 19, 2022, City Council and the Housing Authority of the County of Kern entered into agreement 2022-020 to provide $1 million in funding to support the development of 40 one-bedroom units of affordable housing for the 6th Street Apartments. This amendment modifies the legal description of the original agreement and recorded documents by assigning the project and property to a limited liability company, Kern Housing XIV LLC to comply with HUD requirements. Items 7bb-bd. Clean City Initiative (All Wards) The Clean City Initiative (CCI) is a multi-pronged program aimed at improving the quality of life for residents and visitors by reducing the amount of litter, debris, and illegal dumping throughout the City of Bakersfield (City). Item 7bb extends the City's agreement (2020- 266) with the California Highway Adoption Company through December 31, 2024, and provides an additional $581,760 for their Clean City Initiative Cleanups. Item 7bc extends the City's agreement (2020- 006) with the Open Door Network through December 31, 2023 and provides an additional $693,680 for their Downtown Street Ambassadors program. Item 7bd extends the City's agreement (2020-009) with the Open Door Network through December 31, 2023 and provides an additional $1,129,440 to provide litter and bulky waste abatement for the Clean City Initiative.
