A license ~mt be procured i~ediately by those no~ eng~ed'~r hereafter to engage in the City of Bakersfield in any business liable to m license t~, from the City Narsh~, which license authorizes Zhe p~ty obtaining the s~e to transact the business described in ~ch license in a p~ticular locality of the city. Separa'~e licenses must be obtained for each branch es- tabltsI~ent or separate .house of business; and said licenses must be t~en out in the quarters sequencing from the first !5onday of ~anuary, April, ~uly and October of each year, 'provided that the person taking out a license under the provisions of this ordin~ce after the beginning of any quarter shall only pa~, a pro rata ~o'~t of said s~ for the balance of the time to the co~enc~ent of the next ensuing quarter, unless herein'o.th~wise specified. Section 5, Against any person, firm, or corporation within the city of Bakersfield required to take out a license, ~ho fails, neglects or refuses to take out such license, or ,~':ho carries on, or attempts to carry on business v:ithout such license, the Harshal may direct suit, in the name of the City of .Bakersfield, ~s plain%iff, to be brought for the recovery of the license tax, and in such case either the Marshal or City Attorney may make the necessary affidavit for, and a.writ of attachment m~:' issue without an.,,, bonds being given on behalf of the plaintiff; and in case of a recovery by the plaintiff, $15.00 damages must be added to the judgment and be paid into the General ~-bAnd of the ~ityo -- Section 6. The l.{~rshal must make diligent inquiry as to all persons in this City liable to pay a license as provided in this ordinance, and must require each person to state under oath or affirmation the probable amount of business D?hich he, or the firm "~f. ,~e~__i_~s..a member, or for ..-:hich he is an agent or attorney, or the association or corporation of which he is president, secretary or managing agent, will do in the next succeeding three months; and thereupon such person, agent, president, secretary or other officer must procure a license from the Warshal for the term desired, and the class for v;hich such person, firm or corpora- tion is liable to pay. Section 7. Every license shall beco',me null and void at the expiration of the term specified in the receipt issued by the City Clerk and ~arshal, and the person, fi.~n or corpora.tion holding such receipt shall be deemed not to hold or to retain any license by virtue of having been previously licensed. Section 8. Upon the trial of any action, authorized by this ordinance: the defendant is deemed not to have procured a proper license, unless he either produces it, or proves that he did pro- cure it, but he ma:,, plead in bar of the action a recovery against him, and payment by hire, in a civil action, of the proper licen~e~, , ,...A ..... .,.$~ · .~.,,.~ .~.. ~..,...... ~ ........ ~, ~.;~.,.. tax, together with the dmuages and costs. Section 9. On the first ~,'~onday of each month the City liar- eh'all'must returnm~I to the Clerk all licenses unsold and be cre- dited therewith, and must, on the order of the City Clerk, pay into the Tree,surer for '~he use of the General ?-~nd, all moneys collected for licenses so sold during the preceding month, take the Treasurer's receipt therefor , s~ud file duplicates thereof with the City Clerk. The Clerk must credit the ~_arshal and charge the Treasurer therewith. The Marshal must also, At the end of the quarter, .file with the Clerk a statement showing the names, .occupations and residences of all persons, firms and corporations within this city, liable under its ordi~.ance to pay any license, and showing what is and hs~s been, during the preceding quarter, the ~nount of their liabtl~+~r and the ,amount actually paid b~ them, /" which statement must be verified by hi~ oath, deposing that he has made diligent search and inquiry to ascertain, and has ascer- tained the facts therein required to be reported, and that such statement truly states all such facts. Section lC. Every person, firm, or corporation who, at a fixed place of business in the City of Bakersfield is engaged in, or ?ho ma:~ engage in the business of selling any goods~ wares or merchandise, drugs or medicines, Jewelry or wares or precious metals, whether on commission or otherwise, must obtain from the City shal, a license, and must pay quarterly therefor an amount of money to be determined by the class in w..hlch such person, firm or cor- poration is placed by the ?~ar~hal; such business to be classified and regulated by 'the ~ount of the average monthly ss. les made, at t~be rates following: 1. Those who are estimated to make average monthly sales to the amount of thirty thousand dollars or more, constitute the first class,, and must pay twenty-five dollars per quarter. ~. Of twenty thousand dollars and less than thirty thousand dollars, constitute the second classand must pay fifteen dollars per quarter. 3. Of fifteen thousand dollars and less than twenty thousand i'. dollars, constitute the third class, and must pay twelve dollars per quarter. 4.. Of ten thousand dollars and less than fifteen thousand dollars, constitute the fm~h class and must pay ten dollars per quart e r · §. Of five thousand dollars, and less than ten thousand dol- lars, constitute the fifth class and must pay seven an~ §0/100 dol- lars per quarter. 6. Of two thousand five hundred dollars and less than five .. thousand dollars,constitute the ~ixth Class and must pay Five Dol- lars per o. uarter. ?. Of one thonsand dollars and less than two thousand five hundred dollars, constitute the seventh cla~s, and must pay three -' and 50/100 dollars per quarter. 8. Of one thousand dollars or less, constitute the eighth class and must pay two and 50/100 dollars per quarter. .Section 11. Corn doctors or chiropidists practicing their business or occupation, traveling msrchants, hawkers, vendors of books, charts, .maps, patent medicines, or an~r other minor article of trade, or peddl~rs who engage in the business of vending goods, wares or .~,erchandise of any kind, must pay a license of ten dol- i' lars per month, and every such traveling merchant, hawker or ped- dlmrwho uses a wagon o~ one or more animals for the purpose of vend- ing such goods, wares and msrchandise of any kind, must pay a li- cense of fifteen dollars per month. For any person, firm or corporation engaged in the busines~ of running theaters, as follows: If for less than one month, fire'.dollars per day; if for one month, ten dollars per month; if for one year, sixty dollars per year or twenty dollars per quarter, such license to be issued for not less than two quarters or six months. -W. or each exhibition or minstrels, opera or concert singers, the license shall be the same as required for theatrical perform- ances. The provisions of the above subdivision of this ordins, nce do not apply to exhibitors or entertainments given for the benefit of churches, schools, or o.~her charitable entertainments of any amateur association or literal, society of this city. 4. For each exhibition mx ~z~ for pay of a caravan or menagerie, or any collection of animals, circus, or other acrobatic performance $~--~A-' ~ for each performance, and for each show for i" pay of any panorama, figures, jugglers, necromancers, magicians, wire or rope dancing or slieght of hand exhibitions, five dollars; : and whenever a separate price is charged, each must be considered a separate exhibition, and an exhibition in the day time must be ". considered one exhibition, and an exhibition after dark on the same day considered anotl~er exhibition. §. l~rom each proprietor, or person, firm or corporation, · . ha~.ing at his place of business for patronage by the public any phonographic machine or candy, cigar or cigarette machine, or any · _nickle-in-the-slot machine in which.; on deposit of a nickle, coin or five cent piece or any other piece of money of any denomination whatsoever, or any article representing money, within or in connec- tion with such machine, music is played, or candy, cigars, cigar- :,f~.' ettes, or money· of any kind or denomination, or any other article or articles are ejected or delivered from. said machines respective- ly depending upon any contingency, or otherv.rise, or any prizes offer- ed in connection with any such machines, five dollars per quarter ~or each machine so used or exposed to the public. 6. For each amusement, game or test of skill, strength, ph~sical endurance or cape,city of any kind not otherv~ise provided for, and for participation in r~hich a fee is charged, or which is conducted for profit, two and §0/100 dollars per day; ten dollars per week, or twenty dollars per month. ~ ?. For every person, firm or corporation who keeps a lodging house of ten or more rooms, five dollars per qua?tot; and for every person, firm or corporation who keeps a restaurant, five dollars per quarter. $. For keeping or cond~cting billiard, bagatelle or pool tables or bowXtng alleys, tx,~o dollars per quarter for each billiard, Bagatelle or pool table o~' bo~'~ling alley or beds no license to be granted for less thwart t_~e current quarter. 10. 2or laundries at fixed places of business in this city, and. for each person, firm or corporation who shall solicit, in the .City, !a~.ndry v~ork or orders therefor, not to be 'done in the city, five dollarsper quarter. 11. ~or carrying on, pursuing, or conducting the business of fire; accident or life in smrance, ~nd for every agent, sub-~gent or broker soliciting insurance of any kind, or receiving for ~'i. and forwarding or transmitting to any company or agent, applications to insure in this city, five dollars per quarter. 12, ~or any warehouse used for the storage of any merchandise or goods of other persons for profit x~here the gross receipts are more than five hundred dollars per quarter, ten dollars per quarter; where the gro~s receipts are less than five hundred dollars per quarter, five dollars per quarter. 15. For the business of supplying or furnishing water to the City of Bakersfield, or to the residents thereof twenty-five dollars per quarter. 14, For the business of supplying or furnishing gas for fuel or illuminating purposes, twenty dollars per quarter. 1§. ?or t~e business of supplying or furnishing electricity for illuminating, heating or power~ twenty dollars per quarter. 16. .Vor the business of telephoning or renting telephones, ': " in said city, twenty-five dollars per quarter. 17, For the business of supplying or selling ice, ten dollars per quarter. 18. Ail persons~ firms or corporations engaged in or to be- come engaged in, the bu~.iness of keeping an automobile or authmobiles out on t.be public street at a r. eF~ular stand, and soliciting patron- age and running such authmobile or automobiles w~kk~r~x for hire within the corporate limits of Bakersfield, for each automobile so kept and run for hire, five dollars per quarter. Ail pew~ous engaEed in or to become e~gaged in the m~ business of keeping or conducting a skating rink, fifteen dollar~ p~r quarter. 40. Ail persons engaged in, or to become engaged in the business of keeping, ~onducting or operating a flour or grist mill, ~n dollars p~r quarter. Section 1~.
