TO POWER TR.,~'SIT & LIGHT COI~.AI:r~', .q. CORPORATI01'T'..
The Board of Trustees. of the City of Bakersfield' .do ordain as follows:
Section.1. The right, privilege and franchise is hereby granted to Power,
Transit and T, ight 0omp~ly, a corporat'~ion,~ t'~"~0nstruct, lay 'down, ;..main~ain
and operate, for the ·term of fifty years from and after the date hereof, a
s'ingle or double track street railroad, with all necesmary and convenient
stations, Side tracks~ switches, turn outs, trolleys, poles, connecting wires
and s~ppliances far the purpose of operating, maintaining.and running street
· cars, motors and o'ther appliances for propelling street cars for the ca. rry~
lng and transporting of passengers along and upon the· follow~'ng streets of
the City of Bakersfield, ·Kern County, 0alifornia, to wit:-
'Cemmencing at a point on '~,I" street opposite the North line of
in Block '~" of the Hudnut' Tract·, in the City of Bakersfield, County of Kern,
~ State of California, and r~ning thence South along· "~" street to the center
-of' 23'd--street.'; thence west'-'alon.'g-23d-~stre'et to the c'ente~b-f Chester ~venue .....
and ._t.'o. c'j_unction at s~id Doint with tho existing line of electric· street
railroad now operated.by petitioner on Chester Avenue; including' the.. right .
to make such curve as proper '~actice and engineering shall dictate at the
point or ·points where there is s~n angle in the foregoing description.
The' said railro-~d to be operated by electricity by use of motive power
by trolleys or by such other motive power or appliances as may be necessary
and as science may invent .and the law allow, and the said Power, Transit and
~ight Company is hereby authorized to collect fares from passengers traveling
on said railroad.· .~
Section· 2, The said. Power, Tra~isit & T, ight 0.ompany, a 6orporation, or its
'field two per cent of the gross annual receipts arising from its use, oper-
a, ion or possession. .-
That no per centage shall be paid for the first ·five years succeeding
the date of the franchise, but .thereafter such per centage shall be payable
annually, or in the' event of said ps~rment not being made said franchise shall
be forfeited.
That the said franchise being an extension of an existing system of
street railroad, the gross receipts shall be estlmate~ to be one-half of the
prbportion of the total gross receipts df said syst'em which -the -mileage of
such extension bears to the total mileage of the whole system, and said
estimate shall be conclusive as to the 'amOunt of the gross receipts of said
ext ens.i on. "
Section 3, That the said franchise shall in all respects conform to and
be deemed .to contain and be subject to all of the terms and stipulations and
cond~ti'ons set forth and described in an act of the Zegislature of the State
of 0alifornia entitled "An act .providing for the sale of street railroad
and other· franchises in counties and municipalities, and providing conditions
for the granting of such franchises by legislative or other' governing bodies~
and repealing conflicting acts.,, Approved March 25, 1905, as amended by an
act of the~Degislature of the-S-ta~e 'of California a~p~oved March 3, 190.9,
Section 4. This ordinance shall te~ke effect from and after the date of its
passage, and Shall be published at' least once in. the Bakersfield 0alifornian,
a newspaper printed and published in said City of Ba~.ersfield, and shall be
PoSted in. at least three public places in the said City of' Bakersfield..
