HomeMy WebLinkAboutORD NO 188 Ordinance No. 188. An Ordinance reg,~lating tb~ hours of closing of saloons, bar-rooms or other places where intoxicating liquors are sold. The Board of ~rustees of the Oi~,y of Bakersfield, do ordain as follows:- Sec, 1. It shall be unlawful to sell oF give awe2 any spirituous, malt or vinous liquors in any saloon, bar-room, dram shop, tippling house, sample room, drug store, or in any drinking place or places where such articles are sold · either at wholesale or retail, between the hours of one o'olocE' a.m. and six o'clock a,m. of each or evor2 da2 of the week. Provided however that the foregoing provisions shall ' not apply to restaurants in the sale of spirituous, malt or vinous liquors in the original sealed pac~ageg containing quantities of not less than one pint each to be served with bona fide meals at the p£ace where said meals are eaten, at such restaurants having a license for such.purpose under the ordinances of the City of Bakersfield; and provided further that The foregoin~ provisions small not apply To ~he sale, by dru~ s~ores, of s=ch liquors upon ~he prescription in writing of a licensed physician, given for medicinal purposes .only. Sec, 2. The 'o~er, proprietor, manager or other person having charge or control of any .saloon, bar-room, dram shop, ti?pling house, sample room or other place where sold orgiven away either at wholesale or retail, excepting restaurants or .drug stores, shall securely close and lock. all entrances and exits, from an~ such place, or cause the same to ~e closed and locked and to keep the same in such condition. against the entry and exit of all persons other than the owner proprietor or manager thereof, or the servants regularly employed in and about the same, between the hours of one o'clock a.m. and six o'clock a.m: of each and every day of the week. ,~ec. ~. Any violation ~f. t~is ordinance or an2 provision thereof., shall constitute a misdemeanor, and any person guilty of. the violation of the same or a~i]~ provision thereof, shall, upon conviction, be punishable by a fine of not more than three hundred del±ars or by imprisonment in the county jail for a period not to exceed 90 days, or by both such fine and imprisonment. And it is hereby further, provided that any owner or owners, proprietor or proprietors, lessee or lessees, manager or managers of any saloon, dram Chop, bar-room, tippling house, sample room, bar or restaurant, drug store. or other place where liquors are sold, who shall permit ,any violation of this ordinance or any provision thereof., in or upon the premises occupied or controlled by him, or that is used for any' of the purposes herein'before mentioned shall be guilty of a misdemeanor, and punishable in the same manner as hereinbefore provided. See. 4.
