W~_~REAS, the public peace and safety .demand that an ordin-
ance suppressing _~ ~ 'gambling is Carried
on in the City of Bakorsfisld, now, therefore, the Board of
Trustees of the Git2 of Bakersfield do Ordain as follows:
Section 1.- It shall be unlawful for any person to deal.~
play or carry on, or open or cause to be opened, or conduct er'
cause to be conducted, either as o',:mer or emplcye or otherwise,
whether for hire or not, any game not mentioned or included in
~':"section ~0 of the Penal Code of California, played with cards,
dice or any other device for money, checks, credits, or any other
representative of value, ~'zithin the corporate limits of the. City
of Bakersfield,
Section 2, - It shall be unlawful fo~-' any pcrson,' either
as o?mer, principal, agent, clerk, servant of employs, to estab-
lish, open, keep, maintain or carry on or assist in carrying on,
in the Oity of Bakersfield, ~n2 house,, room, or other place,
where gambling is carried on.
Section 3.- It shall be unlar~ful for any person to become an
inmate of, or a visitor at any gambling house or place where
gambling is practiced or carried on within the corporate li.m~ts
of the City of Bakersfield, ..
Section 4,- Any house or place in said .City of Bakersfield
where any games are played with cards., dice~ or any other device
for money, checks, ships, credit, or anything of value,' or re-
presentative of value is risked or stzked on the issue of any
game is hereby declared, to be a nuisance, and to be included in
~ the term gambling house or place, within the meaning of this or-
dinance.
Section §.- It shall be the duty of the marshal and all
deputies and emch and every police officer of said City to use
all legal means in detecting and convicting persons of violating
any provision of this ordinance, and to exercise the right of'
..... search given by the law of this state, and to sieze and safely
k'eep all chips, checks, cards, apparatus and~things used for
~ling purposes 'at-any place .that may exist contrary to this.

Section. 6. - The provisions of this ordinance shall not be
construed to prohibit a social game of cards for drinks or
cigars, or to prohibit any game played with cards, dies, bil- ·
liard balls, peel balls, cues, er. other devices, played for mer-
chandise only ~t or in any regularly established place of business
maintained for the sale of such merchandise; and provided further
that this ordinance shall not be construed to prohibit social
games of cards played at one'~ home or private ..residence,
Sec. ~. Any person violating any of the provisions of this ordin-
ance shall be deemed guilt2 of a misdemeanor, and upon conviction
shall be punished by a fine or not less than ten dollars or more
than three hundred dollars, or by imprisonment in the county
~- .... Jail not. less 1;hah ten days or more than ninety-days, or by both
such fine and impri.$o~nment.' .........................
Section 8/;- This ordinance shall be in full force and
effect imr~cdiately upon its passage and approval and due publication
· as required by law. All other ordinance and parts of ordinances in
cou£1ict herewith are hereby repealed.
