The following terms, whenever used in this ordinance, except as otherwise specifically indicated, shall be deemed to have and shall be held to include each of the meanings -. respectively set forth in this section, and any such term used in ..~. the 'singular number shall be held to include the plural. Street: Every avenue, boulevard,' highway, roadway, lane, alley, strip, pat~,"square or place used by or laid out for the use of vehicles, whether in ~he city or in any territory belonging to' or under the jurisdiction or control of the city. Curb: The lateral boundaries of that portion of ~km a street designated for the use of vehicles, whether marked by curbing con- strutted of stone, concrete or other material, or not so marked. Vehicle: Every'wagon,' hack,' coach; carriage,' omnibus, push- cart, bicycle;' tricycle, automobile, motorcycle, or other Convetmnce~.,' .. except baby carriage, railroad, street and interurban railway cars.:. · in whatever manner or by whatever force or power .the ·same may/be .. driven, ridden or propelled, which is or may be used for or adapted ... to pleasure riding,' traveling, or the transportation of passengers,.. baggage, merchandise or freight upon any street; and every draft ....... 5r--~i'd-ing-animal,' whether--ridden or led, or is .st_anding'still, ex- cepting that an animal or animals attached to any vehicle ~h~il, '"' ... ~with such vehicle, constitute one vehicle. The driver of any vehicle in or upo$ any street ~hall drive such vehicle upon such street in'a careful manner and with due regard .f..or the safety and convenience of pedestrians and all other vehicles upon such street, s. Section ~. The driver· of any vehicle, upon meeting any other vehicle at any place upon any street shall turn to the right; and;' on all occasions, shall travel on the right hand side of such street;~ and as near the right hand curb thereof as possible. Section 4. The driver of any vehicle shall,' in overtaking and pa. ssing any other vehicle in or upon ~ny street, pass to the · left of such vehicle, and. shall not drive to the right until clear of such vehicle, and the driver of such vehicle being so. overtaken and passed shall give way to the right. Section ~. The driver of any'vehicle moving slowly in~ along or upon any street shall keep such vehicle as close Ss possible to the curb on the right, allowing more swiftly moving vehicles free passage on the left. Section 6. The driver of any vehicle in or upon any street. shall, in turning to the right into another street, turn the corner as near the right hand curb as pos§ibis. Section V. The driver of. any vehicle in or upon any street shall,· in turning to the. left into another street, pass to the right of and beyond the center of the stree.t intersections be- fore t urn$_~g. Section S. Section ~1. No vehicle shall be left becked up to the curb except while such vehicle is being actually loaded or unloaded and the~ only when the horse or horses are swungE around at right angles to the vehicle an~ facing in the direction i~J"which traffic is moving on the side of the street on which th~. vehicle is standing, and in no case ~here such position interferes with or impedes street o~ suburban car traffic upon such street. Section It shall b~ unlawful for the driver of any vehicle standing at the curb in or upon any street to fail or refuse to give way promptly to a vehicle .for the 'purpose of receiving or discharging passengers, freight or merchandise. Section ~. It shall be unlawful for any person to ride~' drive or propel, or to cause to be ridden; driven or propelled .............. in, along, or upon any street within the cengested distri'ct any vehicle in a backward direction, if, by so doing, the free uninterrupted passage of another vehicle or of any street car is impeded, except as a means of relieving such vehicle from a congested position.' SectiQn 1~. It shall be unlawful for the driver of any V~hicle to back suc~i vehicle without first giving visible or audible warning to drivers of vehicles or street cars Ur to pedestrians behind such vehicle sO backing. Section ~. It shall be unlawful for the driver of any vehicle t© pass any street, suburban or interurban car, heade~ or going in the same direction, while such car has stopped or is stopping for the purpose of taking on or discharging pas- sengers; and no vehicle going in an opposite direction to sai~ car, while the same is so stopped or stopping, shall pass within ten'feet thereof~ and no such vehicle under any circumstances sha~l .pass to the left of a~y street, suburban or interurban car, Sect.~on ~. It shall be unlawful ~or any person, while in an intoxicated condition to drive, any animal or to drive any vehic'le in any public street in' the Oity of Bakersfield, or in any park or Other place belonging to or under the jurisdiction of said city. Section ~. ~t shall be unlawful for any person to ride or drive, or cause to be ridden or driven, any animal, or to ride, drive or propel or cause to be 'ridden, driven or propelled, any vehicle over or across any newly made ps..vement in any public Street, .across or around which pavement there' is a barrier, or at, over or near which ~here is a person or a sign w~rning persons not t'o drive over or across such pavement, or a sign '-~--~t~i-nE the street .is clo_sed. ........ ..._ ._.. ._. drive or propel, .or to cause or permit to be ridden, driven or propelle~., any motor vehicle in, upon or along any public stree, t, or to operate, or cause· or permit to be operated, the motor.i~.~t. any such vehic.le, in an.y public street;~ if such motor ..vehicle , or' the motor in such vehicle, is not provided with a muffler properly attached to such vehicle or such motor, of such construction 'and sufficient to muffle or deaden the sound of the exhaust, from SUch motor, or, if the exhaust from the motor in SUch exhaust is ejected otherwise than through such muffler, or if such exhaus~ :~ is ejected' toward the surface of the street or gro .Und. .... ~or ~he purposes of this section the 'term "motor vehicle" shall include automobiles, motorcycles· and all other vehicles operated by power other than animal power. Section ~. It shall be unlawful for any person to ride or drive, or cause to be ridden or driven, any horse or other animal, or to ride, drive or propel; or cause to be ridden, driven or propelled, any vehicle upon or along any public-side- waiL, or to leave any such animal, o.r vehicle upon any public side- W~lk,' or to permit any such animal or vehicle to stand thereon, Section ~ _._ It shall be unlawful for any person to ride or drive, or cause to be .ridden or driven, .any dangerous or unbroken animal upon. any public' street,' or to use, or to cause to be used, any such .street for the purpose of breaking or training any animal. Section ~1~. It shall be unlawful for any pedestrian cross- ing any street within the congested district of the City of ......... B~sf-ield~, either .w~thin the limits of any~. b_l_.ock or at any _ corner thereof, to cross the same except at right angles. Section ~. Except as herein otherwise provided, the driver of any vehicle at street intersections shall have the right - of way over the driver of another vehicle, going at right angl~j$~,''' ..~...' approaching from the left hand siA-e; and' the driver of any such vehicle shall, give the right of way to any vehicle approaching from the. ·right hand side. Section 5. The officers and f~remen'of the fire department;~ and their apparatus, of all kinds, when going to or on duty at a fire, and all ambulances, whether of public or privat, e character,' when employed in carrying sick or injured persons 'to hospitals or other places for relief or treatment~ and the ~ officers and policemen,' an~ vehicles of the police and fire departments, while responding to calls or alarms, shall have the right of way .'.'>' over all other persons and vehicles on any street and through any J p~ocession, Section ~. It shall be Unlawful for the driver of any vehicle or the motorman of any street car in or upon any street in the City of Bakersfield,' or for any person standing or walking in any such ·street,' to fail, refuse or neglect, to allow the right , of way to any officer or fireman,· apparatus of the fire depart- "?"'j":~' merit when the same is goisg to or on duty at fire, or to ambulance, whether of public or private character, when such vehicle is employed in going for or carrying a sick or injured .~,~"~.~ person' to a hospital or other place for relief or treatment, or to any officer or policeman or vehicle of the police or fire department, while responding to calls or 'alarms, or to vehicles under control of the City of Bakersfield used fo~^flushing the -p~b~-i-c--e?t~eets 'or s.ew_e.~s_,._ ._o_~. for the collection.., of garbage. . .. ~ection- '~. Upon the approach of any"apparat~''''6~f-t~f~ 'fire department 'or any police patrol ~gon,^or any ambulance .~o~arrying a sick or injured person,· the driver of any vehicle in or u~"em~i?any street shall immediately stop such Vehicle as near as ",' possible to the right hand curb of such street, and it shall be unlawful for any such driver to ca~se or permit such Vehicle to_ '"'":'"' ..¥~.ii. be mover until such apparatus, police patrol Wagon or ambulance shall have passer such vehicle; and.upon the approach of any apparatus of the fire department the motorman in chs, rge of any street car shall bring such car to a full stop and shall not. cause or permit such car to be moved until such fire apparatus shali have passed such car. Section ~. The driver of any vehicle .turning to the lef~ from one a. treet into another street mhall allow the right of way to vehicles traveling in the direction in which such vehicle is ~urning; an~ the driver of any vehicle traveling in the direction in ~hich such vehicle is turning shall have the right of way over such vehicle so turning. Section S~. ~he driver of any vehicle turning to the righ~ from one street into another street shall have the right of way over vehicles traveling in the direction in which such vehicle is turning; and the driver of any vehicle traveling in the direction in which such vehicle is turning shall allow such right of.way to such vehicle so turning. ".. Section ~. It shall be unlawful for any.driver wilfully to. ~'" stop or drive,' or cause to be stoppe~ or driven, any vehicle along or across any street, railway or interurban railway track in such manner as unnecessarily to hinder, delay or obstruct " -the ~'ov'ement of any.car, travelling upon such track; provided,' however, that vehicles of the fire and police department of the = .i. ty of Bakersfield and hospital ambulances shall b~ve the right of way, when in service or responding to Call. Section ~, It shall"' be unlawful for any person to obstruct the free and uninterrupted passage in, upon, lying along or through any public street of any funeral cortege or procession, or to obstruct, impede or prevent, the passage of any person or ....... $1~scns attending the conveyance of the ·body of any deceased person to a p~lace for holding services thereover, or to a place .of interment. Section ~. It shall be unlawful for any person to hitch or tie, or to cause or permit to .be-hitched or tied, any animal to any shade or ornamental tree in any street or park, or to hitch or tie, or cauwe or permit to be hitched or tied, any such animal, or to·allow the same to stand so near to any shade or ornamental tree as to permit or enable such animal to 'injure or destroy the same. section ~i It shall be unlawful for any person to hitch or tie, or cause or permit to be hitched or tied, shy'animal to any post used for the support of any lamp used in lighting· any public street, park or place. Section ~=~. It shall be unlawful for any person to feed, or to cause to be fed, any animal, upon any street, unless such animal shall be securely tied or hitched by a chain, strap or 'rope fastened to its neck, bridle Or halter, and to'a post or other permanent fastening. Section ~. It shall be unlawful for any person to feed,· or to cause to be fed, any animal upon any public street except by means of a nosebag fastened upon the head of such animal. Section ~. No vehicle shall be left standing nor any horse l~eft'~hi~ched ~within ~ twenty ~£0) feet O~f.any fire hydrant for any period of time whatever. Section ~. It sh~ll be unlawful for any person to leave ..... ..... Unattended upon any public street,.any motor veh$cle, '.wh:i~e' '.:"'"".. ,~?'.:',.any part of its machinery is ~i~ or is in motion. Section ~. It shall be ~la~ul for any person to ride, .,,.~' drive,' or p~pel, or to cause or pe~it to be ridden, driven or propelled, any vehicle upon or along any street, during the period of one hour·after su~et to one hour before s~rise, u~ess · there is attahhe~ to the front of such vehicle a l~p ~owing a .. whi~e ·light visible in the direction towards~'wh..i'eh ~ch.vehicle is proceeding and also a lamp attached to the rear of such vehicle showing a red light,' visible in the reverse direction; provided, howevers' that the provisions of this section shall n~ apply to any vehicle upon which lights are not required by any law in the Sta~e of Oalifornia to be exhibited while being so ridden~' driven or propelled. I~ shall be unlawful for any person to ride, drive or pro- pel, or ~o cause or permit to be ridden, driven or propelled, any motorcycle upon or along any street, during the period of one hour after sunset to one hour before sunrise, unless there is a~tached to the fron~ of such motorcycle a. 'lamp ahowing a white light visible in the direction ~owards which such mo~or- cycle is proceeding. Sec~ion.$~. It shalZ be unlawful for any person ~o ride~' drive, or propel, or to cause or permi~ to be ridden',·. driven or propelled,· any bicycle, ~ricycle, velocipede, motorcycle, %omobile or other riding machine or horseless vehicle, in, upon or along any public s~reet wi~hou~ having attached ~o such bicycle, tricycle, velocipede, motorcycle, automobile or other riding machine or horseless mE vehicle, a bell, gong, horn or o~her signal device, in g~od working order, a nd sufficien~ to give warning of ~he approach of such vehicle to pedestrians and ~o riders or drivers of animals or of o~her vehicles. It shall be unlawful for any person to use or to sound, or ..~. to cause or permit to be used or to be sounded, in or upon any public street, alley or other public place, any such bell, gong; horn or other signal device in any manner o-~her-thah- -t'o"produ'ce an abrupt sound sufficiently loud to serve as an of the approach pf the vehicle to which the same is attached, or' to sound, or to cause or permit to be sounded, any such bell, gongg- horn or other signaI device except when necessary.to give sUCh warning. Section ~. It shall be unlawful for any person to ride', drive or propel, or to cause or permit' to be ridden~ driven or .~-.~ propelled,' upon or along any public street, during the period from one hour ~fter sunset to one hour before sunrise, any vehicle that is requ'ired by any law of the State of Oalifornia to have a number displayed on the back of. such vehicle~' unless such -number so required is illuminated by means of a light shining upon such number or upon or t~rough the plate to which such number is attache~,' which light shall be of sufficient strength and shall be ~ so place~ as to render sai~ number plainly visible. Section ~. It shall be unlawful for any person~' firm or corporation~' either as o~ner~' employee or oth'erwise, controlling~~ operating or in charge of any street car or interurban car to cause such car to be stopped in or upon any street~~ that any portion thereof or of the fer~ler attached to such car shall .. project between the prolongation of the lines of the sidewalk of the street crossings, intersecting or terminating in the street in or upon which such car is st&ppe~; provide~ that the provisions of this section shall not apply in case of emergency,' or when any sUCh car is st~pped for the purpose of'.~voiding an accident. Section ~ It shall be unlawful for the driver of any vehicle to fail, neglect or refuse to stop such· Vehicle in obedience to any signal given by a police officer,' stationed at " the 'street .crossing, over which such driver proposed to cross, or for any such driver to ~ail, neglect or refuse to stop any vehicle under his control at least six feet behind any other vehicle which has stopped 'in obedience to any such signal. It. shall be unlawful for the driver of any vehicle which has stopped in obedience to a signal given by a police officer, to start such vehicle u~til s~ch driver has received--a..eignal from Such police officer to proceed. Section ,1~. It shall be unlawful for the driver of any vehicle standing along or t~ear the curb in any street to refuse or neglect to move such vehicle away from such curb when requested so to do by any police officer. Section-~. Section E. I~ ~all be u~aw~l for any person ~o ~hrow, ~eposit or place in or upon any public sSree~ a~ nails, ~acks~ crocEery,' sorap iron,' ~in, wire, bo~les, glass, thorns or ~horny clippings, or tho~y branches of ~rees or bushes, or a~ o~her a~icle or thug likely ~o puncture or injure ~he ~ire of any veh icl e. Section ~. Section ~. That it shall be unlawful for any pe. rson to ride, drive or propel any vehicle at a rate of speed greater than twenty miles per hour on or ~long any street or portion of any street in the City of Bakersfield; provided, however, that on'~r along those certain streets, or portions of streets, descr&bed in Section 1 of this ordinance, as the congested district, the rate of speed shall not be greater than fii~een miles per hour ~s specified in Section 48 hereof. Section ~. It shall be unlawful for any person to ride, .. or drive any horse or other animal at a rate of speed faster than a walk, or to ride, drive or propel any bicycle, tricycle; velocipede, motorcycle;' automobile, or other riding machine, or horseless vehicle, at the rate of speed greater than ten miles per hour on turning a corner from one street into another or on going, over, upon or across street crossings or street intersections, o~ any of the s. treets designated in Section 1 of this ordinance as the congested, district. ~ection. ~. That all carts,' vehicles, boxes and other re- ceptacles used for hauling or carrying dirt,' 'sawdust, sand, gravel or other loose substance on or over any of the streets in the City of Bakersfield shall be sufficiently t.~ght to prevent any sifting; leaking or spilling therefrom,- and no dirt, sawdust, sand,' gravel or other loose substance shall be hauled, carried or conveyed upon, along or 'over a//y "of the streets--of-the .. City of Bakersfield, unless such dirt, sawdust, sand, gravel or other substance is in a wagon bed, box or other~receptacle sufficiently .I · .,.- .,~ strong and tight to prevent any Sifting, leaking or'spilling therefrom; and no ·person, while carrying, .hauling or moving any ~ir~,' s:awdust, sand.' gravel or other loose substance~ 'upon, .... along .or 'over any street in the' City of Bakersfield, 'shall allow or permit any s~ch dirt, sawdust, sand, -gravel or other substance to sift, leak, spill or go upon such street. Section ~. That no 'person in charge of any vehicle shall leave the same,' or allow the same to stand in any alley of the City of Bakersfield for a longer period of time than one hour, nor shall any team, horse or other animal at any time be hitched or left standing in any alley, nor shall any vehicle be hitched or allowed to stand or left standing within a distance of twenty , feet of any fire hydrant, drinking fountain or watering trough : in the 0it'y of Bakersfieid, n~r shall any:person, firm or cor- poration place or caused to be placed upon the streets of the City of Bakersfield, anything which will prevent-, impede or · interfere with the free and unobstructed access of the fire department of the 0ity of Bakersfield to any fire hydrant in said city, or of the general p~blic to any drinking fountain or w~tering trough in sa~d city. Section ~ That it shall be unlawful for any person having charge, custody or control of any horse, mule, pony or donkey to leave the same unzttended and unsecured in any public street within the City of Bakersfield.
