BE IT ORDAINED BY THE COUNCIL OF T.MZE CITY OF BAKERSFIELD, as follows: SECTION l: It shall be unlzwful for the owner or person in charge of ~ny hack, coach, carrisge, omnibus, automobile, cab or other vehicle used in carrying passengers, freight, baggs~ge or merchs~ndise, for hire to allow any such vehicle, while awaiting employment, to occupy any stand upon the streets of the City of Bakersfield wil~hout h~ving first obtained from the Council of said City a written permit therefor, which permit shall in all cases continue in force for one year from the date thereof, unless sooner ~evoked, as hereinafter set forth, ~nd at the expiration of such period of one year such' permit shall be void and of no effect; pro- vided, that no such permit shall be granted except upon the written consent of the occupant of the first floor of the portion of the building in front of whi.h it is desired that such vehicle shall sts~nd; provided, however, that if ther~ is no building on the pre- mises, in front of which it is desired that such vehicle sh~ll stand, or if there is a building and the first floor of the s~me is not occupied, then such permit may be granted upon the written consent of the owner or lessee of such premises or building. SECTION 2: Not more than eight such vehicles shall be permitted to stand upon a street within the limits of any one b2ock and not more than four ~uch vehicles shs~!l be perrnitted to stand on one side of such street within any such block, o~nd not more than two such vehicles shall be permitted to st~od upon one si.de of such street within the limits of any one-h~_f b~ock. ~ hTo such vehicle shall be permitted to strand withi~ forty (~0) feet of ~ ~ ~notn.r such vehicle upon the s~ne side of any street -,nd no such vehicle shall be permit- ted to stand within forty (40) feet of any street intersectio~?~or within twenty-five (~) feet of any alley intersection. PROVIDED, however, that the f~regoinE restrictions in this section shall not apply to automobile stages running on regular schedule between Bakersfield and other points. ~ND PROVIDED FURTEER, that no stage.~ shall occupy its stand to exceed one hour prior to its schedule time for leaving Bakers- field. No suc~l permit shall be granted except upon the written applic~.tion of th~ person desiring ss~ne, filed with the City Clerk, stat- lng the kind of w~hicle for which such permit is sought, and if an auto- mobile the license number thereof, snd the proposed location for the stand of soch vehicle, together ~ith the written consent of the o~ner, occ~ps~nt or lessee of the premises in front of which it is desired that such vehicle may stand, s~s required by the provisions of this Section; provided that in no case shall a permit be granted for any such vehicle to stand on Nineteenth Street between "F" and "N" Streets, or on Baker Street between the Southern Pacific Railroad trs~cks and Grove Street. SECTION ~: A separate permit shall be issued for each vehicle, and all permits issued by the said Council pursuant to the provisions hereof, shall contain the ns~e of the person to whom the ss~ne is granted,~he kind of vehicle, and if an automobile the license number thereof, and the place designa'~ed as a stand for such vehicle. SECTION 4: Every driver or person in charge of any vehicle for which a permit shall ~mve been obtained, pursuant to the provisions of this 0rdinsnce, shsll h~ve such permit ~tt~ched to such ~ehicle in a conspic- uous place at all times while driving or in charge of such vehicle, and shs~ll permit the examination of such permit whenever requested to do so by any police officer or the Superintendent of Streets. SECTION §: Upon written notice the Council ~,~y in its discretion revoke ~he permit of any person upon written chs~rges filed, and after giving at least f.~ve days written notice of the hes~ring of said charges. From the time of ~he revocs~tion of any such permit it shall be unlawful for the person whose permit is so revoked to allow the vehicle for which such pe~nmit is granted to stand while awaiting -2- emplo~nuent, upon any street in the City of Bakersfield, or to all, any vehicle to stand, while awaiting employment in the location designated in such revoked Dermit, unless a new permit shall ~ ~ave been procured for such vehicle. SECTION 8: Any person viol~ating any of the provisions of this ordinance shall be deemed guilty of a misde.~e~nor, ~nd upon conviction thereof, shall be punishable by s~ fine of not more than fifty dollars ($50.00), or b~r imprisor~uent in the county jail for a period of not more than twenty-five (ES) days, er by both such fine and imprisonment. SECTION 7: Ordinance No. ~10, entitled "An ordinance regulat- ing stands for automobile rent cars, providing for the issuance of permits, and providing a penalty for the violation thereof." is hereby repealed.: ~ ~ SECTION 8: This ordinance shs_ll be in effect from and after thirty days from the date of its passage.
