HomeMy WebLinkAboutORD NO 322 ORDINANCE NO. ~2 AN ORDINANCE REQUIRING ANY PERSON, FIRM OR CORPORATION TO PROCURE A PERMIT TO FURNISH, CONDUCT, OR OPERATE, OR HOLD THE~SELIrES OUT AS FURNISHING, COI~DUCTING OR OPERATING ANY ST~A]~, HAI~IAM, TURKISH, OR OTHER BATH OR BATH PARLORS, OR MASSAGE TREAT~ENTS OR ~ANIPULATIONS USUALLY OR FREQUENTLY GIVEN AT SUCH PLACES: PROVIDING FOR REVOCATION OF SUCH PERi, ITS: MAKING VIOLATION OF THIS ORDINANCE A I~ISDEMEANOR AND PROVIDING A PENALTY THEREFOR. BE IT ORDAI!~ED BY TEE COUNCIL OF THE CITY OF BAtt~RSFIELD, AS FOLLOWS: SECTION 1. It shall ce unlawI'ul ~or any person, l~rm, or corporation to furnish, conduct or operate, or hold themselves out as furnish- ing, conducting or operating any steam, hsmmumm, turkish or other bath, or batlh parlors, or stay massage treatments or manipulations usually or frequently given at such parlors, without having first procured from the Council of the City of Bakersfield, a permit so to do. SECTION 2. Such permits shall be granted for the unexpired portion of the calendar year and must be renewed on or before January first for each succeeding year thereafter. Such permits shall be granted only to such persons as the Council, after investigation, shall find to be of good moral charscter, and they may be revoked at any time by said Council when it is shown to i~s satisfaction that immorality or acts of lewdness are committed or permitted upon the premises covered by such permits. SECTION 5. Ali. applications ahall be made on forms to be obtained from the City Clerk's office and when filled out, shall 'be filed in such office. Such applications shall show the names of the owners, proprietor or keeper of the bath or other establishment for which a permit is sought, whether baths or massage or other treatments or manipulations are to be furnished to men only, to women only, or to both men and women, whether male or' female - i - assistants or operators or both are to be employed and, if both sexes are to be served, that certain hours of certain days shall be set apart for women patrons, and that under no circumstances shall both men and women be served or permitted in any such steam, hammam, turkish or other bath parlor at the same time. SECTION 4. Any person, firm or corporation furnishing, conducting or operating, or holding themselves out as furnishing, conducting or operating any steam, hammam, turkish, or other bath or bath parlors, or any massage treatments or manipulation usually or frequently given at such places, without first having procured from the Council of the City of Bakersfield, a permit so to do, or in violation of any provision of this Ordinance, shall be guilty of a misdemeanor, and on. conviction shall be subject to a fine not exceeding the sum of Three Hundred Dollars ($300.00), or by imprisonment in the County Jail not exceeding ninety (90) days, or by both such fine and im- prisonment. Each day that such steam, h~m~am, turkish, or other bath or bath parlors or any massage t. reatments or manipulations usually or frequently given in such places, is conducted in viola- tion of the terms of this Ordinance shall be deemed guilty of a separate offense. SECTION 5. This Ordinance shall be in effect from and after thirty days from the date of its passage.
