DUCTING , ~{AINTAINING AND OPERATING MESSE~iGER CALL
SYSTE~,{, OR MESSENGER SERVICE: REQUIRING A PERNIT
TO CONDUCT, NAINTAIN AND OPERATE SUCH BUSINESS:
PRi:SCRIBING HOW AND BY WHO~L SUCH PERMIT ~AY BE OB-
TAINED: NAKING THE VIOLATION THEREOF A MISDEMEANOR:
PROVIDING A PENALTY THEREFOR, AND REPEALING ORDI~,IANCE
NO. 312.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAKERSFIELD,
as follows:
SECTION 1. It shall be unlawful for any person, firm or corporation
to carry on, conduct or maintain the business of messenger call
system, or messenger service in the City of Bakersfield, 'without
having first obtained a permit from the Council of the City of
Bakersfield. so to do.
SECTION 2. Nc, such permit shall be granted except upon. the written
application, of the person, firm or corporation desiring same. Said
application, shall be signed by the applicant and shall spec.ify the
location of' the place of business of said applicant. Said applica-
tion must be endorsed by at least three (3) reputable citizens of
the City of Bakersfield. Said application shall be referred to
the Chief of Police, who shall make investigation as to the character
of the applicant, and on or before the next regular meeting of said
Council, report thereon to said Council. After receiving such re-
port, the Council shall grant or deny a permit to said applicant to
engage in such business.
SECTION 3- Whenever it shall appear to said Council that the person,
firm or corporation to ~hom such permit has been granted is conduct-
ing, maintaining, operating, managing or carrying on the business
of messenger call system or messenger service in an improper, irreg-
ular or unl;,~wful manner, such permit, so gr~ntecl sh~ll be =evok~cl.

It shall be unlawful for any such person, firm or corpo-
ration, who:~e permit has been so revoked, to continue to carry on,
conduct or maintain the business of messenger call System or
messenger service within the City of Bakersfield, until such time
as said permit shall bs ren~:~'~ed.
SECTION [~. Tt~t no permit to so conduct, maintain or operate a
messenger call system or messenger service shall be issued for a
period extending beyond one (1) year, providing however, that this
Ordinance slhall not be construed tO apply to any person, firm or
corporation operating, maintaining or conducting a messenger call
system or m~ssenger service in said City of Bakersfield~ under a
franchise tlherefor, duly granted by said City.
SECTION 5. Every breach of this Ordinance, or of any of' its terms,
conditions, provisions or requirements~ shall separately or for
each day of its continumnce be d~emed to be, and shall be a
separate br~ach thereof.
SECTION 6. Theft any person, firm or corporation that shall violate
any of the provisions of this Ordinance shall be deemed guilty of
a misdemeanor~ and upon conviction thereof, shall be punished by
a fine not ~xceeding the sum of Two Hundred Dollars ($200.00), or
by impriso~ent in the County Jail for a term not exceeding ninety
(90)~days~ or by both such fine and imprisonment.
SECTION ?. Theft Ordinance No. 312, entitled~ "AN ORDINANCE REGULATING
THE BUSINESE (~F CONDUCTIi~G, ~..~AINTAINING OR OPERATING NESSE~GER CALL
SYSTEN OR ~[ESSE~GER SERVICE~ ~[AEING THE VIOLATION THEREOF A ~IS-
DENEANOR AND I~ROVIDING A ?E~ALTY THEREFOR" be and the same is hereby
repealed.
I iaereby certify that the foregoing Ordinance was passed
by the Council of the City ~of Bakersfield, on the ~/2~.~,daY. of
June, 1917, by the following vote:
