BE IT ORDAINED BY T~ COUNCIL OF T~ CITY OF B~ERSFIELD, as follows: SECTION 1. (a). For the p~rpose of this Ordin~ce, rubbish shall me~ ~d include all combnstible and non-combustible waste and refuse matter, excepting garbs~e, ordinarily acc~ulating i~ ~d. abo~t residences, :flat buildings, apartment house~, hotels, re~taur~ts, eating houses, lo~ing houses, stores, shops, office and other public buildi~s, m~d ~o~ other things it shall include tree tri~ings, grass curtius, s smd dead plants ~d weeds, but shall not include brick,'morta~ or other debris incident to the construction or demoli- tion of buildings. (b). For the purpose of this Ordinance combustible rubbish shall include paper, pasteboard, carpets, rs~s, clothi~, books, boots, shoes,, straw, packing, barrels, boxes, furniture, and other smd similar articles that will cinerate thro~h contact with flumes of ordinary temperature. (c). For the purpose of this Ordinance, non-combustible rubbish shall include ~shes, bottles, broken crockery, glass, tin c~s, ~d other metallic subst~ces, ~d other or similar articles or substsn- ces that will not cinerate thro~h contact with flsmes of ordinary temperature. SECTION 2. It shall be the' d~ty of every resident, o~er, lessee, tsn~t, or occup~t of ~y private dwelling honse, and of the o~er, l~ssee or keeper or every .flat buildi~, apartment house, hotel, re staur~t, /. ./ eating house, lodgi~ ho~se, store, shop, office and other public z[~-- building or bmildi~s, where rnbbish will acc~ulate, to pro'vide suitable'boxes, barrels, or other proper recepticles to be kept on each of said premises, sufficient' to hold the rubbish which would ordinarily accumulate on such oremises. No one of sai,.d receptacles shall have a capacity exceeding fifty (50) gallons. The receptacle for holding the combustible rubbish shall be of wo~d or metal and have a cover to prevent the contents from being scattered or blown about by the wind. For hold- ing ashes, each such receptacle shall be of metal and shall be water tight; the same shall have a capacity of not less than three (3) gallons and not more than fifteen (15) gallons, and shall be pro, vided with a handle or handles on the outside and with a tig~j:Tit- ting cover 'which shall not be removed except when necessary,*~nd nothing but ashes shall be placed therein. · SECTION 3. It shall be unlawful for any person, firm or corporation to '~ deposit, keep or accumulate, or oermit, cause or suffer the deposit- ing, keepir~ or accumulation of any rubbish of shy kind whatsoever within any house or building, or upon any lot within the City of ..~(.~ Bakersfield, except as hereinafter provided; provided, however, that this provision shall not be construed as interfering with building under a building permit, or wood or kindling neatly piled for kitchen or household use. SECTION 4. Each such receptacle shsdl be plainly marked on the autside to designate the contents thereof, and it shall be unlawful for stay person to place or cause or permit to be 'placed in the receptacle used for combustible rubbish, any ashes or non-combustible rubbish whatsoever, or to place in the receptacle used for non-combustible rubbish, any ashes or combustible rubbish. SECTION 5. It shall .be the duty of the occupant' of every dwelling house -and the owner, agent or manag~er of every flat building, apartment house, hotel, restaurant, eating house, lodging house, store, shop, office of other public building to remove or cause to be removed, the contents of any box, barrel or receptacle whenever such recep- tacle is so nearly full that any additional deposit of rubbish therein wotdd cs~e the same to ~oVerflow. contents, when re' moved, must be deposited at the City'dump or such other place as the City Manager may designate or Permit. SECTION 6. No r~bbish shall be removed, and carried on and alo~ the streets and alleys of said City of B~kersfield, except the same be carried,, conveyed or hauled in wagons made dust proof to the extent that it is impossible for any of the contents of s~ch wagons to sift through or fall out upon said streets and alleys. The contents of such wagons must be further protected so as to prevent same being blown or scattered upon the streets, alleys and adjacent lands. SECTION 7. It shs. ll be unlawful for any person, firm or corporation to 'deposit or 'to cause or permit to be deoosited any conbustible Or non-combustible rubbish or any refuse or waste matter of any kind whatsoever, upon or in any street, alley or other oublic place, or upon any premises or in any canal or ditch within the City of Bakers- fi eld. SECTION 8. Nothi~ in this Ordinance shall be construed to prohibit the burding of rubbish in a reasonable quantity on the premises where it accumulates or on vacant lots by the o~mers thereof or their agents or e~ployes, provided such burning be done between 'the hours · of six A. N,, end six P. N. and in such a manner as will not en- danger property or persons, and no person burning rubbish shall leave the same unguarded at any time until all the embers are wholly ex- tingui shed. It shall be unlawful for any person to burn any rubbish in any alley, street or public place within said City, except under the supervision and direction of the Superintendent of Streets. SECTION 9. It shall be unlawful for any person to deposit, keep or ac- cumulate stable manure, or permit, cause or .suffer any stable manure to be deposited, kept, or accumulated upon any lot, or parcel of land, or any public or private place, drive, alley or street, unless the same shall be in tightly closed receptacles which shall not be accessible to flies or rodents. SECTION 10. No stable manure from any premises within the City of Bakers- field shall, be permitted by the person having charge or control thereof, to accumulate or to be deposited on any street, alley, pu~ lic lane or place within said City, except as herein provided. manure acct~nulated at any stable, corral, shed or buidling, shall be removed at regular intervals of not less than once a week, or oftener if the Health Officer shall direct, to such place as may be: provided by the City Council of said City, and under such conditions as th6'Health Officer prescribes. All manure shall be conveyed and handled in such manner as to prevent any thereof from being dropped, spilled or scattered upon any street, alley, lane or other public place within said City. Any person either as lessee, tenant, qccupant~ or owner, having control of any premises where stable manure shall accumulate, shall provide a suitable covered box of such dimensions and of such capacity as to hold, accomodate and care for all manure that may be produced or accumulated on the premises, and such box shall be con- structed so as to exclude therefrom all flies or other germ bearing insects. SECTION 11. Any person, firm or corooration failing to perform any duty prescribed herein., or violating any of the provisions, Of this Or- dinance shall be deemed guilty of a misdemeanor, and upon convic. tion thereof shall be punishable by a fine in the sum not exceed- ing Three Hundred Dollars ($300.00) or by imprisonment in the_ County Jail for a period not exceeding ninety (90) days, or by both such 'fine ~nd imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for every day during any portion of Which any violation of any provision of this Ordinance is committed, con- tained, or 'permitted by such person, firm or corporation, and shall be punishable therefor as provided by this Ordinance.
