BE IT ORDAINED BY T~ CO~CIL OF T~ CITY OF B~ERSFIELD, SECTION 1.. In this Ordin~ce the phrase "carb-line" sh~l be used ~d constraed to me~ a line in the street, avenue, lane or alley parallel with the property-line between the "sidewalk space" sad the roadway as hereinafter defined. .~ The phrase "property-line" shall be used and constru,~d[~ me~ a line between a street, awnue, l~e or alley ~d the blocks, squares or lines abmtting mpon Smch street, avenue, l~e or alley. The phrase "sidewalk space" shall be used ~d constrmed to me~ the space between said property-line ~d cmrb-line. The phrase "parki~-space" shall be used and constrmed to mean as m~ch of the sidewalk space next to the curb-line as the Co.~cil of said City of Bakersfield may in ~y wise detemine. The word "sidewalk" shall be ~sed and constrmed to me~ that portion of the street which i s set apart by dedicati.on, ordin~ce or othe~ise ~d improved for the use of pedeetrians, or such part of the sidewalk space as the Co~cil may specify. The word ~roadway" shall be msed ~d construed to be so much of the street, avenue,l~e, or alley as lies between t~ curb-lines thereof. Reference is hereby m~de to "Plan of Typical Bl°ck of the City of Bakersfield" approved ~d adopted by t~ Board of Trustees of the City of Bakersfield on the 17th day of November, 1910~ ~d on file in the office of the City ~gineer, for further expl~a, tions of the foregoi~ definitions. SECTION 2. (1). On all streets or avenues 60 to 7o feet ·wide, except as hereinafter provided, each curb~line shall be 12 feet from its ad- jacent property-line. ~ (2). On all streets, avenues or lanes 70 to 85 feet wide, except as hereinafter provided, each curb-line shall be 14 feet from its adjacent property-line. (3). On all streets or avenues over 85 feet wide, except as hereinafter provided, each curb-line shall be 17 feet from its ad- j acent property-line. (4). On all streets or alleys more than 33 feet and less than 41 feet wide each curb-line shall be 8 feet from its adjacent property.-line. (5). On all alleys 28 to 33 feet wide each curb-line shall be 6 fee~.~ from its adjacent prOperty line. (61). On all alleys less than 28 feet in width, each curb- line shall be 3. feet from its adjacent property-line. (7). (a) Provided that on Nineteenth Street between the easterly line of Chester Avenue and the westerly line of 0 Streef~ each curb-line shall be 12 feet from its adjacent property-line; al so (b) That on Chester Avenue from the southerly line of Twentieth Street to the northerly line of Sixteenth Street, each curb-line shall be 15 feet from its adjacent property-line; also (c) That on the east side of Chester Avenue from the northerly line of Sixteenth Street to the northerly line of Fif- teenth Street, 'the curb-line shall be lg feet from its adjacent property.-line; also (d) That on H Street from the southerly line of California Avenue to the northerly line of Fourth Street, each curb-line shall be 14 feet from its adjacent property-line; also (e) That on California Avenue from the Westerly curb-line of reet produced, to the easterly curb-line of Oleander Avenue the curb-line shall be 17 feet from its adjacent property-line from the south ~-~ ' , ~:,~de of said. California Avenue be- tween the points above designated; also (fO That the curb line on the northerly side of Calif- ornia Avenue between the westerly curb-line of F Street prod. iced, and. the easterly curb-line of Oleander:Avenue, shall be 10 feet from its adjacent property-line; also (g) That-on Lake Street from the easterly line of Union Avenue to the westerly line of Williams Street, each curb- line shall be 3 feet from its adjacent property-line; also (h) On Seventeenth Street west of the westerly line of Cedar Street, the curb-line shall be 21.2~ feet from its adjacent property-line; also (i) On I Street north of the northerly line of Twenty- third Street. the curb-line shall be 2!.2~ feet from its adjacent property-line; also (j) On Twenty-third Street from the westert,y line of I Street to the westerly line of Oak Street, the curb-line shall be 21.2~ fset from its adjacent property-line; also (k) On Twenty-fifth Street from the westerly line of I Street to the westerly line of Oak Street, the curb-line shall be 21'.2~ feet from its adjacent property-line; also (1) On Twenty-sixth Street from the westerly line of I Street to the westerly line of Oak Street, the curb-line shall be 21.2~ feet from its adjacent property-line. (m) On ~.~'iyrtle Street from the southerly line of Eighteenth Street to the northerly line of Truxtun Avenue, the ct~rb-!i_~e.shall be 21.2~ feet from its 2d,]:acent pro)e'rty-il-ne; ........ also (n) On Beech Street [f;~m~he .southerly line of-Ei-ghteen- th Street to the northerly lin~ Of Truxtau Avenue, .the curb,line shall be 21.2~ feet from its adjacent property-line. (8). The radius of all curb returns at the intersection of streets with streets or avenues, ,~hall be 7 feet, (9). The radius of all curb returns at the intersection of alleys with streets or avenues, shall be 3 feet. (I0). The cross section of.the surface grade .of all side- Walks shall ha'ye a surface slope downward of three (3) inches from the property-line to the curb-line, except in alleys where the slope on six (6) and eight (8) foot walks shall be two (2) inches, and on three (3) foot walks, one (1) inch. SECTION 3. There shall be no sidewlaks constructed on any street or ave- nue less than 6 fee.t in width, and when in the opinion of the Superintendent of Streets, the public convenience requires a wider walk, he shall designate the width at the time he grants the permit for layir~E said walk. SECTION 4. It shall be mulawful for any person, firm or corporation to lay or construct any sidewalk upon any public street or alley within the City of Bakersfield, without first obtaining a permit from the Superintendent of Streets of said City, to do said work. SECTION ~. Whenever any sidewalk shall be laid. or constructed, as pro- vided in this Ordinance, the Superintendent' of Streets shall place an inspector over such work, whose duty it shall be to see that the work and material used in the construction of said side- walk conforms to the requirements of all Ordinances of the City of Bakersfield relating to the construction of sidewalks and to the "Spec_ifications for the construction of cement sidewalks and curbs within the City of Bakersfield", adopted by the Board of Trustees of said City on the 17th day of November, 1910, and on file in the office of the Superintendent of Streets of s~id. City. SECTION 6. Nothing in this Ordinance shall be con,~trued as. in any way affecting such rights as public service corporations have under '~ · existing Ordinances and laws to uncover water, gas or other pipes or conduits heretofore laid under streets, alleys or parking spaces for the purpose of making necessary connections or repairs. SECTION 7. Any person violating any of the terms or provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon convic- tion thereof, shall be punished by a fine not to .exceed One Hundred Dollars ($100.00) or by imprisonment in the ~ounty Jail not to ex- ceed Thirty (30) days, or by both such fine and imprisonment.
