WITHIN THE CITY OF BAKERSFIELD' REGULAT- ING THE PLACES WHERE SAME ARE SOLD OR DISPOSED OF: PRE- SCRIBING CONDITIONS UPON WHICH LICENSES NAY BE GRANTED, REVOCATION THEREOF: FIXING THE AMOUNT OF THE LICENSE FEE: PRESCRIBING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE' PEAL NG 0 DINANCES NUMBER 1 O~DtN~C~ NUMBER q27 AND ALL OR.DINANCES AND PARTS OF ORDINANCES IN CON~I~I~T HEREWITH. WHEREAS, the passage of an emergency Ordinance prohibit- lng the selling, serving, and giving away of intoxicating liquor's in the City of Bakersfield on Sunday, is deemed necessary for the immediate preservation of public health, peace and safety, and as a war measure; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows' SECTION 1. That Section 27 of Ordinance No. ~29 of the City of Bakersfield, ['~.~'~.~ ,'", entitled' "AN ORDINANCE REGULATING THE SALE AND DISPOSITION OF SPIRITUOUS, MALT AND FERMENTED LIQUORS, WINES AND CIDERS, AND NIXED INTOXICATING LI~UORS, WITHIN THE CITY OF BAKERSFIELD' REGULATING THE PLACES WHERE SANE ARE SOLD OR DISPOSED OF: PRESCRIBING CONDI- TIONS UPON WHICH LICENSES MAY BE GRANTED, REVOCATION THEREOF: FIXING THE AMOUNT OF THE LICENSE FEE: PRESCRIBING A PENALTY FOR THE '¥IOLA- TION OF THIS ORDINANCE' REPEALING ORDINANCES NUMBERS 133, 114, 1~5, 136, 156, 188, 206, 208, AND SECTIONS 8, 9, AND 10 OF ORDINANCE NU~ER 327, AND ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH", be snd the same is hereby amended to read as follows' SECTION 27. It shall be unlawful for the owner, proprietor, ~manager, licensee, or other person .or~ p~ers0ns having charge of any. establishment conducted under a wholesale liquor license, retail liquor license, or a "Class B" hotel, eating house, or restaurant liquor license, to sell, serve, give away, or dispose of any spirit- uous, malt, vinous or mixed intoxicating liquors~ or p~.rmit liquor to be sold, served, given away, or disposed, of, or consumed on the p~emises for which the license is granted between the hours of 11:30 o'clock P. M., of any week day, and 6 o'clock A. M., of the day following, or between the hours of 11:30 o'clock P. M., on Saturd~y, and 6 o'clock A. M., on the Monday following. SECTION 2. Theft Section 28 of said Ordinance No. 329, be and the s~me is hereby amended to rea~ as follows: ~SECTION 28. It shall be unlawful for the owner, propr~ietor, manager, or any other person or persons having cha~ge or control of any establishment conducted under a wholesale liquor license, or retail liquor license, to permit any person or persons other than the owner, ~ropriet0r, manager, or person or persons in charge. thereof, to be or. remain in said place of business between the hours of i[1:30 o'clock P. ~., of any week day, and 6 o'clock A.M., of the day following, or between the hours of 11'30 o'clock P. M., on Saturd~y and 6 o'clock A. M., on the Monday following, or to permit or allow any entrance or exit of any such place to remain open or ~locked,. or permit the entrance or exit of any person other than the owner, proprietor, manager, or person or persons in charge thereof, between said hours of 11:30 o'clock P. M., and 6 o'clock A. M., following, of every week day, or between the hours of 11:30 o'Clock P. M., on Saturday, and 6 o'clock A. M., on the Monday following. SECTION 3. This Ordinance is enacted for the immediate preservation of the public health, peace and safety, and is hereby declared to be an emergency measure, and shall be in full force and effect ime- diately upon its passage.
