HomeMy WebLinkAboutORD NO 382 O~DINANCE NO..~~ AN ORDINANCE REGULATING THE COLLEC- TION, REMOVAL AND DISPOSAL OF GARBAGE: DEFINING SE~E AND PRESCRIBING A PENALTY FOR FIOLATION, A~D REPEALING ALL ORDI- NANCES AND P~TS OF ORDINANCES IN CON- FLICT HEREWITH. BE', IT ORDAINED BY THE COUNCIL OF THE CITY OF B~KERSFIELD, follows: SECTION 1.. For the purpose of this Ordinance the word "garbage" is defined ~o be all animal snd vegetable refuse and waste from kitchens ~,~d all animal and vegetable refuse and waste that shall have been prepared for or intended to be used. as food or shall have resulted from the preparation, consumption, storage and mar- keting of food. SECTION 2. It shall be unlawful for any person to deposit, keep or accumulate any garbage, or permit, cause or suffer any garbage to be deposited, kept or accumulated upon any lot, or parcel of land, or any ph~lic or private place, drive, alley or street, unless the same shall be in tightly closed receptacles which shall not be accessible to flies or rodents. SECTION 3. It shall be the duty of every owner, manager or person in possession, charge or control of any boarding house, restaurant, hotel, apartment house, eating house, snd the owner, ag~ent or man- ager of every dwelling house or flat building within the City of Bakersfield., whether occupied by one or more families, to provide or to cause to be provided, and. at all times to keep or to cause to be kept, as in this Ordinance prescribed, portable vessels, tanks or receptacles for holdinf~ garbage; each such vessel, tank or -receptacle shall be constructed of metal and shall be water tight, ~ end shall be so constructed as to contain not less than three or -1- more than sixteen gallons, and shall be provided with a handle or handles on the outside thereof and with a tight-fitting metal cover. The City Health Officer shall be the judge of the sufficiency of said vessel, tank or receptacle. Such cover shall not be removed except when necessary to place garbage therein or to take garbage therefrom. SECTION 4. Each vessel, tank or receptacle shall be kept or'placed in the manner following: Where there is an alley other than a blind alley in the rear of the premises, such vessel, tank or receptacle shall be placed on the premises within five feet of the rear property line. Where there is no alley other than a blind alley in the ~ear of the premises and there is a side entrance to the rear of said premises, each such vessel, tank or receptacle shall be placed on the premises at an accessible point not less than fifty (50) feet nor more than seventy-five (75) feet from the front property line. Where there is no alley other than a blind alley nor such side entrance, each such vessel, tank or receptacle shall be placed on the curb in front of the premises during the hours fixed for the collection of garbage therefrom. Each such vessel, tank or receptacle shall be accessible to the garbage collector whan called for. SECTIO~ ~. It Shall be unlawful' for any person to place or to cause or . p'6rmitlto be placed in any such vessel, tank or receptacle, any sub- stance or substances other than garbage. SECTION 6. It Shall be unlawful for any person Other than the owner, or someone authorized by him or an officer of ss, id City, to interfere in any manner with any such vessel, tank or receptacle, or the con- tents thereof, or to remove any such vessel, tank or receptacle from the location where the same was placed by the owner thereof, or to remove the contents from auy such vessel, tank or receptacle, pro- vided, however, that during any sdch time as a contract shall be in force between the City of Bakersfield and any garbage collector, such garbage collector shall remove all garbage from all places where the removal of the same i s. not otherwise provided for by the owner or occupant. SECTION 7.' No garbage shall be removed a.nd carried on or alOng the streetm or alleys of the said City except the same be carried in carts in water-tight cans, or in carts or wagons having water-tight boxes with proper' covers, so that the garbage shall not be offens'ive, and every such cart or wagon shall be kept clean, and said garbage shall be so loaded that none of it shall fall, drip or spill to or on the ground, sidewalks or pavement. SECTION 8. Nothing in this Ordinance shall be construed to prevent the owner or occupant of any house, or place, from removing or caasing to be removed, garbage accumulated thereat, provided that all the condi- tions and requirements' of this Ordinance be fully complied with. SECTION 9. Nothing in this Ordinance shall be constraed to prevent the owner or occupant of any house or place from feeding the garbage pro- d. aced in such house or place, to chickens in proper amounts for imme- diate consamption, provided s~ch garbage shall be wholly disposed of each day and shall be handled..at all times in a manner satisfactory to the Health Officer of the City of Bakersfield. SECTION 10. Every person, firm or corporation shall be guilty of a pub- lic off:ense for every day during any portion,of which any violation of any prowision of this Ordinance is committed, continued or per- mitted by s;uch person, firm or corporation, and shall be punish- able therefor, as provided for by this Ordinance. SECTION ll. Any person, 'firm or corporation failing to perform any duty prescribed, herein, or violating any of the provisions of this Ordi- nance shall be deemed guilty of a misdemeanor, and _upon .conviction therefor, s~hall be punishable by a fine in a s~m not exceeding Three Hundred Dollars ($300.00), or by imprisonment in the County Jail for a period not exceeding ninety (90)"days, or by both such fine ~d impri sonment, SECTION 12, All ordinances and parts of ordinances ~ conflict Herewith are hereby repealed., I hereby certify that the foregoing Ordinance was passed by the Council of the City of Bakersfield, on the ~°~-~v ..... ~ay of August, 1918, by the followi~ vote: (~eouncir 6f the City of Bakorsfieldo APPROVED this ~~ day of August, 1918.
