MAKING ..THE VIOLATION A EISDEMEANOR AND PROVIDING A PENALTY THEREFOR. BE IT .ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. (a) For the purpose of this Ordinance, rubbish shall mean and include all combustible and non-combustible waste and reffuse matter, excepting garbage, ordinarily accumulating in and about residences, flat, buildings', apartment houses, lodging houses, hotels, restaurants, eating houses, stores, shops, offices and other public buildings, and among other things it shall include tree trimmings, grass cuttings and dead plants and weeds, but shall not include brick, mortar or other debris incident to the construction or demolition of buildings. (b) For the purpose of this Ordinance, combustible rubbish shall include paper, pasteboard, carpets, rags, clothing, books, boots, shoes, straw, packing,barrels, boxes, furniture, and other and similar srticles that will cinerate through contact with flames cf ordinary tempe ratu~e. (c) For the purpose of this Ordinance, non-combustible rubbish shall include ashes, bottles, broken crockery, glass, tin cans, and other metallic substances, and other or similar articles or substances that will not cinerate through contsct with flames of ordinary teml~erature ~. ~ (d) For the purpose of this Ordinance, "Rubbish Inspector" sh.~ll mean..and include the man in charge of the City Dump Yards. (e) For the purpose of this Ordinance, ~ "RubbiSh Collector" is defined to be any person or persons, firm or corporation, who makes a business of going about from house to house and from place to place, col- lecting and hauling rubbish. SECTION 2. It shall be the duty of every resident, owner, lessee, tenant, or occupant of any privgte dwelling house, and of ·the owner, lessee or keeper of every flat building, apartment house, hotel, restaurant, eati-ng house, lodging house, store, shop, office and other public building or buildings, where rubbish will acctur~- ulate, to provide suitable boxes, barrels, or other proper recept- acles to be kept on e-~ch of s~id premises, sufficient to hold the rubbish which would ordin-~rily accumulate on such premises. No one of said receptacles shall h~ve ~ capacity exceeding fifty (50) gallons. The receptacle for holding the combustible rubbish shall be ~f wood or metal and have a cover to prevent the contents from being scattered or blown about by the wind. For ·holding ashe,~, each such receptacle shall be of metal and shall be water tiglht~ the seme she. ll hs. vea capacity of not less than three (3) gallons and not more than fifteen (15) gallons, and sh~ll be provided with a handle or handles on the outside and with .~ tight fitting cover which shall not be removed except when necessary, and nothing but ashes shall be placed therein. SECTION 3- It shall be unls. wful for any person, firm or corporation 1;o deposit, keep or accumulate, or permit, cause or suffer the deposit'ing, keeping or accumulation of ~ny rubbish of any kind whatsoever vsithin any house or building, or upon any lot within the City of Bakersfield~ except as herein after provided~ provided, however, that this provision shall not be construed as interfering with building under a building permit, or wood or kindling neatly piled for kitchen or household use. SECTION ~. Each such receptacle shall be plainly m~rked on the outside to designate the contents thereof, and it shall be unlawful for any person to place or cause or permit to be placed in the receptacle used for combustible rubbish, any ashes, Or non-cumbustible rubbish whatsoever, or to place in the receptacle used for non-combustible rubbish, any ashes or combustible rubbish. All papers, p~eteboard, books, and magazines shall be so kept that they can be separa, ted from the other rubbish for the purpose of' depositing same in the compartment in the rubbish wagon reserved for such papers, pasteboards, magazines and books. SECTION 5. It shall be the duty of the occupant of every dwelling house and the owner, agent or manager of every flat building, apartment house, hotel, restaurs~nt, eating house, lodging house, store, shop, office or other public building, to remove or cause to be removed, the contents of any box, barrel or receptacle whenever such receptacle is so nearly' full that any additional deposit of rubbish therein would cause the same to overflow. Such contents, when removed, must be de- posited at the City Dump Yards, or such other place as the City Manager ms, y designate or permit. SECTION 6. No rubbish shall be removed and carried on s,nd along the streets and alleys of said City of Bakersfield, except the same be carri'ed, conveyed or hauled in wagons of sufficient size to be divided into two compartments, in one of which shall be deposited all papers, pastebos~rds, books and magazines collected by said Rubbish Collector t~o be delivered at the City Dump Ys~rds. 'Said wagon shall be made dust proof to the extent that it is impossible for any of the contents of such wagon to sift through or fall out uDon said streets and alleys. ' The.. contents of such wagons must be further protected so as to prevent same from being blown or scattered upon the streets, alleys and adjacent lands. SECTION ~. Every person, firm or corporation carrying on, conducting, maintaining or engaging in the business of rubbish collector must first ask for and obtain a permit from the COuncil of the City of Bakersfield to so c&rryon, conduct, maintain or enE~e in such business, which permit, when issued, entitles the holder-'of same to collect and haul rubbish and make a c~rge to the household, ers thereofr. Every application for such permit must be signed by said applicant, giving his residence or post- office address, and must be endorsed by at least ~~reputable citizens, owning or occupying real property within said City of Bakersfield, and giving their residence or place of business and occupation. SECTION 8. Whenever it shall appes~r to sa. id Council that said rubbish collector has failed to comply with the requirements of this Ordinance, or that same is carrying on, conducting and maintain- ing said business in an un~awful, improper manner, such permit~ so granted, shall be revoked after due notice to the holder thereof. SECTION 9. No rubbish of any kind whatsoever shall be dumped at the City Dump Yard except between the hours of 7 o'clock A.M. and 6 o'clock P.M. SECTION 10. It shall be unlawful for any person, firm or corporation to deposit or to cause or permit to be deposited any com- ~u_stible or non--combustible rubbish or any refuse or waste matter of ~,ny kind, whatsoever, upon or in any street, alley or other public place~ or upon any premises o~ in ~ny canal or ditch within the City of Bakersfield. SECTION ll. Nothing in this Ordinance shall be construed to prohibit the burning of rubbish in a reasonable quantity on the premises wh~re it accumulates or on vacant lots by the owners thereof or their agents or emDloyes, provided such burning be donw between the hours of~ six m.m. and six p.m. and in such ~ manner as will not endanger property or persons, and no person burning rubbish shall ie~ve the same ~guarded at ~ny time until all the embers are wholly extinguished. It shall be unlawful for any person to burn any rubbish in ~ny alley, street or public place within said City, except under the super- ~ision and d~rection of the Superintendent of Streets. SECTION 12. I~ shall be unlawful for a~ny person to deposit~ keep or accumul~te stable manure~ or pe~it, cause or suffer any stable manure to be deposited, kept, o~ accumulated upon any lot, or pmrcel of land, or any public or private place, drive, alley or street, unless the same shall be in tightly closed receptacles which shall not be accessible to flies or rodents. SECTION 13. No st~ble manure from any premises within the City of Bakersfield sh~ll be permitted by the person having charge or control thereof, to accumulate or to be deposited on any street, alley, public lane or pls~ce within said City~ except as herein provided. All manure accumulated st any stable, corr,.l, shed or building, shall be removed at regular intervals of not less than once a week, or oftener if the Health Officer shall direct, to such place as may be provided by the City Council of said City, ~nd under such conditions as the Health Officer prescribes. All manure sh~ll be conveyed and handled in such manner ~ to prevent any thereof from being dropped, spilled or scattered upon any street, alley, lane or other public place within ssid City. Any person either as lessee, tenant, occupant or owner, having c~ntrol of any premises where stable manure shall accumulate, shall~ provide a suitable covered box of such dimensions and of such c~pacity ~s to ihold, accommods~te and care for s~ll manure thst may be produced or aocumulated on the premises, and such box shall be constructed so ~s to exclude therefrom all flies or other germ bearing insects. SECTION 14. Any person, firm or corporation fs~iling to perform any duty prescribed herein, or violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof she. ll be punishable by a fine in the sum not exceed- ing Three Hundred Dollars ($300.00) or by imprisonment in the County J~il for a period not exceeding ninety (90) days, or by both such fine ~nd ~ie~nment · Each e~uch person, firm or corporation shall be deemed guilty of a separate offense for every day during ~ny portion of which any violation of any' provision of this Ordinance is committed, cont~ined, or permitted by such person, firm or corporation, and shall be punish- able therefor as provided by this Ordinance. --5-- SECTION 15.
